Recommended Posts

That reaction may look outsized in the United States, but the case touches on a string of issues that strike deeply in India, where the fear of public humiliation resonates strongly and heavy-handed treatment by the police is normally reserved for the poor.

End of story!

~~!! Devyani Khobragade- The Game behind USA !!~~

M_Id_449595_Devyani_Khobragade.jpga

The Devyani Khobragade controversy is not just about the provocative arrest of a senior Indian diplomat.

Highly placed sources have told Mail Today that Sangeeta Richard, the maid at the centre of the controversy, was previously employed by a senior US diplomat. Another intriguing part of the unfolding story is that a visa was issued to Richard family—Sangeeta’s husband Philip and their two children and they left the country by an Air India flight on December 10, even as New Delhi was engaging with Washington on the issue.

A Mail Today investigation has revealed how the saga unfolded, with the Indian Deputy Consul General finding it difficult even to lodge a missing persons report for Sangeeta Richard with the New York Police Department (NYPD), and how the US ignored India’s plea for action against Richard and instead piled pressure on India. Mail Today has accessed official documents to weave the story together. This is how it all went down:

435621-devyani-khobragade.jpg

NOVEMBER 2012: Sangeeta Richard enters the United States with Deputy Consul General Devyani Khobragade.

JUNE 23, 2013: Richard goes missing. In Delhi, her husband says he has no idea where she is. Richard had some days earlier sought Khobragade’s permission to take up another part-time job in New York; it was denied.

JUNE 24, 2013: Office of Foreign Missions (OFM) in New York informed, and its help requested in tracing Richard.

An intriguing part of the story is how difficult it became for Khobragade to file a Missing Persons Report with the NYPD. It was on the advice of the OFM, Khobragade went to file a missing person report at the police precinct concerned, but was told that she could not since Richard was an adult, and that such a report could only be lodged by a member of her family.

When Mr Richard, Sangeeta’s husband, was contacted, he refused to file a Missing Person Report, indicating his awareness of something being amiss.

JUNE 25, 2013: Unable to file a report, Devyani sends a letter to the police precinct concerned, requesting them to file a missing person report and trace Richard.

Sustained efforts resulted in the NYPD seeking inspection of Khobragade’s residence. As diplomatic premises are out of bounds for local law enforcement agencies, Khobragade was interviewed in front of the Permanent Mission of India, her residence, and a missing person report filed by the NYPD.

JULY 1, 2013: A woman claiming to be the Richard’s lawyer calls Khobragade to tell her that Sangeeta would not go to court only if, one, the Indian diplomat signs a 566 form authorising the maid to terminate her employment, and, two, change her visa status from government visa to normal visa, and, three, be compensated for 19 hours of work per day. Khobragade refuses to negotiate on phone, insisting that the caller first identify herself; the caller hangs up.

JULY 2, 2013: Khobragade informs the OFM about these developments in writing, seeking NYPD support in ascertaining the identity of the caller and her links with Richard, given that the conversations clearly indicate that the runaway maid has no intention of returning to India and seems keen to extort money by making false accusations.

No action is taken.

Khobragade files a written complaint with the Delhi Police against Sangeeta Richard and her husband Philip Richard, accusing them of cheating under Section 420 of the Indian Penal Code, and asking the police to book them for the offence and recover the maid’s official passport.

JULY 8, 2013: Khobragade is called to ‘Access Immigration’, Richard’s husband did not cooperate to discuss terms of settlement with Richard. Accompanied by the consulate officers, Khobragade meets Richard whose seeks payment of $10,000, grant of an ordinary Indian passport along with whatever immigration relief is required to stay on in the US on that ordinary passport.

Consulate officials tell Richard that she cannot remain in the US under any circumstances without legal authorisation, and that she should return to India as per her contract with Khobragade.

Richard is told that any argument over salary or working hours could be settled in the consulate before her return to India. Richard refuses, saying that she wants to remain in the US. Khobragade complains to the NYPD about the demands, but there is no response.

Richard’s passport is revoked and notice for termination of her personal identity also given to OFM with effect from June 22, 2013. Richard is now staying illegally in the US. Felony / theft charge filed with NYPD against Richard by Khobragade’s husband, reporting theft of cash, Blackberry phone, two SIM cards, a metro card (valued at $ 113) and documents such as contracts, signed receipt book- c**- working hour log. No action taken.

JULY 15 & 19, 2013: Philip Richard filed a writ petition against Khobragade and the Union of India, alleging that his wife Sangeeta Richard was in police custody in New York since July 8, 2013, charging the Indian diplomat with “slave labour” and illegally making Sangeeta sign a ‘second contract’ with far less pay and perks. The Union of India is accused of not paying according to the requirements of the local law. Richard withdraws his writ petition four days later.

JULY 30, 2013: A copy of Philip Richard’s writ petition is forwarded to OFM, which states that Sangeeta is in police custody in New York, for producing the maid at the Consulate so she can be repatriated to India as requested by her husband in his writ petition. Consul General is also informed that Richard was last seen at the office of Access Immigration on July 8, 2013. No action taken by the US.

SEPTEMBER 4, 2013: US State Department issues a one-sided letter to the Indian Ambassador, projecting the allegations of the maid which are of “considerable concern”, and asking for the allegations to be probed.

It also seeks a voluntary meeting between Khobragade and the Bureau of Diplomatic Security in the State Department as well as proof of payment of minimum wages from the embassy.

SEPTEMBER 10, 2013: In Delhi, MEA calls US officials and strongly protests against the tone and content of the letter.

SEPTEMBER 20, 2013: Delhi High Court issues an ex-parte ad interim injunction against Philip and Sangeeta Richard, restraining them from initiating any legal action or proceedings against Khobragade in any Court/Tribunal/Forum outside India with regard to her employment.

The final hearing in the matter is scheduled December 13, 2013.

SEPTEMBER 21, 2013: A reply is sent to the State Department by the Indian Embassy in Washington, rebutting the allegations and bringing out the facts of the case while highlighting the fact that Sangeeta Richard is seeking monetary settlement and a US visa, thereby seeking to subvert both Indian and US laws.

The letter also emphasises that the matter is an issue between the Government of India and one of its employees and is not subject to US regulation or adjudication. Assistance of the State Department is sought in locating and repatriating Sangeeta Richard to India.

NOVEMBER 19, 2013: Metropolitan Magistrate of South District, New Delhi, issues a nonbailable arrest warrant against Sangeeta Richard.

DECEMBER 6, 2013: The arrest warrant issued by the Delhi Metropolitan court is forwarded to the US State Department and the US Embassy in New Delhi, requesting them to instruct the relevant authorities in the US to arrest and repatriate Sangeeta Richard to India through the Consulate in New York, so that due process of law may be prosecuted in India. No action is taken by the US.

DECEMBER 12, 2013: Khobragade arrested on the basis of a Second District court warrant for visa fraud as she drops her daughter to school in New York. Immunity is denied under the Vienna Convention on Consular Relations (VCCR) for this “felony charge” Bail posted at $ 250,000, Khobragade’s passport is seized, and she is asked not to leave the country or seek another travel document though she can travel within the US after notifying authorities. She is been not to be in touch with Sangeeta Richard.

JANUARY 13, 2014: Next date of hearing is announced, but Khobragade’s attorney claims he is not free that day and is negotiating another date, which will be known in due course.

Pre-trial process commenced on December 16, 2013 where a urine sample was taken by US authorities for drugs testing.

India escalates diplomatic row after consul's arrest and strip-search in US
Handling of Devyani Khobragade's alleged visa fraud angers Indians with barriers removed from US embassy in reprisal
  •

The arrest and strip-search of India's deputy consul general in New York triggered an escalating diplomat dispute on Tuesday, as Indian politicians boycotted a visit by US congressmen and Delhi threatened to remove privileges for US diplomats.

Devyani Khobragade was released on bail two hours after being arrested last week for visa fraud and making false statements on an application for her Indian housekeeper to live and work in New York. prosecutors in New York say Khobragade, 39, claimed she would pay her maid $4,500 (£2,800) a month when applying for a visa at the US embassy in Delhi – but actually paid her $573 (£350) a month, or $3.31 – less than the US minimum wage.

But her public arrest and subsequent treatment as "a common criminal"has prompted outrage at home. India's national security adviser called the treatment of Khobragade on Tuesday "despicable and barbaric".

Nancy Powell, US ambassador to Delhi, was summoned by the Indian foreign secretary, Sujatha Singh, last week and on Tuesday officials said that US diplomats would be asked to reveal full details of how much they paid their own domestic staff in India to ensure compliance with local laws.

Earlier on Tuesday bulldozers removed security barriers outside the US embassy in Delhi – the most visible evidence of the anger in the country sparked by the incident last week.

Politicians – including Rahul Gandhi, the scion of the Nehru-Gandhi dynasty and vice-chairman of the ruling Congress Party, and Narendra Modi, the prime ministerial candidate of the Hindu nationalist opposition – refused to meet a visiting US congressional delegation.

Indian government officials told the Guardian that they were "hurt and shocked".

"No Indian diplomat has been treated this way for decades. [The US] is our friend and strategic ally and you can't just treat a friendly country's representatives like this. This is major, major ill treatment and is totally inexplicable," one said.

The arrest quickly became a major story in India, dominating TV bulletins. According to Indian officials, Khobragade was arrested and handcuffed as she dropped off her daughter at school, then strip-searched and kept in a cell with drug addicts before posting $250,000 bail.

India is acutely sensitive to its international image and status, and in the past far less serious incidents have provoked major clashes. Standard security checks in the US regularly are front-page news here when they involve visiting Indian dignitaries, who are largely exempt from being frisked while at home.

US diplomats in consulates across India have been asked to surrender identity cards issued to them and their families, which entitle them to special privileges. India has also withdrawn all airport passes for consulates and import clearances for the embassy.

The new demand for details of salaries of US consular staff's domestic workers in India could prove embarrassing for the embassy. Many are likely to be found in breach of local standards. "We are applying a principle of strict reciprocity," said the Indian government official.

Khobragade, 39, has pleaded not guilty to the charges, which could lead to a 10-year prison sentence, and plans to challenge the arrest on grounds of diplomatic immunity, her lawyer said last week.

In Washington, the US state department has said that standard procedures were followed during Khobragade's arrest. Officials argue that her immunity from prosecution extends only to actions directly connected to her position.

The consular official's father, Uttam Khobragade, told the TimesNow TV news channel on Tuesday that his daughter's treatment was "absolutely obnoxious".

"As a father I feel hurt, our entire family is traumatised," he said.

In 2010 there was uproar after India's UN envoy, Hardeep Puri, was reportedly asked to remove his turban at a US airport and detained in a holding room when he was refused. A hands-on search of India's US ambassador, Meera Shankar, at an airport in Mississippi that year also prompted claims that India had been "insulted".

In 2009 Continental Airlines apologised to the former Indian president APJ Abdul Kalam for searching him in Delhi before he boarded a flight to the US, and in 2005 India's former speaker of parliament Somnath Chatterjee refused to attend an international meeting in Australia without a guarantee that he would not have to pass through security.

Chatterjee said even the possibility of a security screening was "an affront to India".

The US will not drop charges against Indian diplomat Devyani Khobragade, the state department has said after her arrest last week led to a huge diplomatic row.

Ms Khobragade was arrested in New York on suspicion of visa fraud and making false statements, after being accused of underpaying her Indian maid.

She has denied all the charges and was later released on bail.

India has demanded an apology from the US over her alleged "humiliation".

Ms Khobragade was handcuffed and strip-searched last Thursday after a complaint from her maid, Sangeeta Richard. She has in turn accused Ms Richard of theft and attempting to blackmail her.

US Secretary of State John Kerry has expressed his "regret" over the incident, but a government minister on Thursday said that was not enough and that the US must apologise and admit it had made a mistake.

Delhi has ordered a series of reprisals against the US. Security barricades around the US embassy in the city were removed and a visiting US delegation was snubbed by senior Indian politicians and officials.

'Playing games'

State Department spokesperson Marie Harf answered in the negative when asked if Ms Khobragade would go "scot free" and the US courts would be asked to drop the charges against her.

"We take these allegations very seriously. We're not in any way walking back from those allegations or the charges," she said adding that this was "really a law enforcement issue".

Ms Harf said the US informed every country annually about "obligations they have for their staffs when they bring them to the US".

"We make those obligations very clear and we take any allegations that they haven't done so very seriously," she added.

_71866864_71866863.jpgAnger has been rising in India against the alleged ill-treatment of the diplomat

On Friday morning, India again insisted that the US must apologise as the action taken against Ms Khobragade was "unacceptable".

"The US is playing games with India. But America must understand that the world has changed, times have changed and India has changed," Parliamentary Affairs Minister Kamal Nath told reporters.

On Wednesday, angry MPs from several Indian parties called on the government to take tough action against the US and Prime Minister Manmohan Singh described Ms Khobragade's treatment as "deplorable".

But US prosecutor Preet Bharara said in a statement that Ms Khobragade "was accorded courtesies well beyond what other defendants... are accorded".

According to documents filed in a New York court, Ms Khobragade wrote on a visa application that the maid would be paid $4,500 (£2,746) a month.

But investigators said she instead paid only $573 per month - less than the New York state minimum wage.

If found guilty, Ms Khobragade faces a maximum sentence of 10 years for visa fraud and five years for making false statements.

Devyani Khobragade was Treated Very Well: US Attorney Preet Bhrara
By IndiaTimes | December 19, 2013, 1:39 pm IST

Manhattan's high profile India-born US attorney Preet Bhrara, also known as the "Sherriff of Wall Street", has defended his department's actions against Indian diplomat Devyani Khobragade, sparking a diplomatic row between India and the US, insisting she was not handcuffed and was given due courtesies.

This Dec. 8, 2013 photo shows Devyani Khobragade, India's deputy consul general, during the India Studies Stony Brook University fund raiser event at Long Island, New Yorkdevyani_khobragade_1_1387440226_540x540.

He also said the domstic help, Sangeeta Richard's family was "evacuated" from India to protect the "victim" as there were attempts to silence her and compel her to return to India.

Devyani Khobragade, India's deputy consul general in New York, who was strip-searched following her arrest on charges of visa fraud and underpaying his maid last week was accorded courtesies most other defendants wouldn't get, he said in a over 1,000 word long statement. Bharara claimed that US State Department agents arrested her discreetly last week and she wasn't handcuffed or restrained.

But he confirmed that Khobragade was "fully searched" by a female deputy marshal in private as per "standard practice" for "every defendant, rich or poor, American or not."

Otherwise, she was treated very well and was even given coffee and allowed to make phone calls in a car for two hours to arrange for child care.

"Because it was cold outside, the agents let her make those calls from their car and even brought her coffee and offered to get her food," Bharara said.

"It is true that she was fully searched by a female deputy marshal -- in a private setting -- when she was brought into the US Marshals' custody," he said.

"But this is standard practice for every defendant, rich or poor, American or not, in order to make sure that no prisoner keeps anything on his person that could harm anyone, including himself. This is in the interests of everyone's safety," Bharara added.

Expressing dismay over the focus on the treatment of the diplomat rather than on the alleged victim, Bharara asked: "Is it for US prosecutors to look the other way, ignore the law and the civil rights of victims ... or is it the responsibility of the diplomats and consular officers and their government to make sure the law is observed?"

Bharara also confirmed that the family of Khobragade's domestic help has been brought to the US as a "legal process was started in India against the victim, attempting to silence her, and attempts were made to compel her to return to India." He said, it was necessary to evacuate the victim's family from India as part of efforts "to make sure that victims, witnesses and their families are safe and secure while cases are pending."

Bharara said his office's "sole motivation in this case, as in all cases, is to uphold the rule of law, protect victims, and hold accountable anyone who breaks the law - no matter what their societal status and no matter how powerful, rich or connected they are."

Meanwhile, Dana Sussman, a lawyer for Khobragade's housekeeper, Sangeeta Richard, said the issue goes beyond a labour dispute.

"Our clients who work as domestic workers are living in the home with their employers," she told CNN. "So, if they leave, they not only leave their legal status, they leave their only source of income, they leave the only home that they've known in a foreign country."

She said Richard has no passport, is living with friends and has been granted temporary legal status that allows her to remain and work in the US until the matter is resolved.

Sangeeta Richard, the domestic worker whose allegations led to diplomat Devyani Khobragade's arrest in the US

Mumbai Sangeeta Richard, whose allegations of low wages and exploitation led to the Indian diplomat Devyani Khobragade's arrest in the US last week, had reportedly praised her employer in a diary entry, which has been made public by the diplomat's family.

The diary entry, posted on Facebook by Ms Khobragade's family, reads like a letter from Ms Richard and quotes her as saying that she did not feel like a domestic help, and her employers were nice to her. (Read: Sangeeta Richard governed by Indian laws not American, India told US)

It seems to have been written around the time Sangeeta Richard arrived in the US, and according to the diplomat's family, contradicts her complaint to the US authorities. (Read: No special treatment to US diplomats at airports)

"The whole family is very nice. I don't feel that I am their domestic help. The children call me 'tai' (aunt). Madam is also quite nice and keeps smiling all the time. Sir is quite sensible. He takes care of things so it gives me a lot of free time," reveals the written entry, said to be from Ms Richard's diary.

She also writes that she was given a separate room on the ground floor of their house, and Ms Khobragade's older daughter stayed in the room next to hers.

"I pray to my mother for this blessing before sleeping every night," she writes.

The US has charged Ms Khobragade with lying on the visa papers for Sangeeta Richard - who worked for the diplomat for nine months till June - and making her work a 40-hour week at just three dollars an hour, far less than $9.75 an hour promised in an agreement. (Read: No withdrawal of charge, says US)

Ms Richard's lawyer Dana Sussman has alleged that the diplomat had "no intention" of paying her help fair wages and overtime. "US laws apply to everyone. Ms Richard was not given paid leave or health insurance. She worked seven days a week with a few hours off on Sunday," Ms Sussman said. (Watch)

India has accused US authorities of conspiracy and immigration fraud by allowing Sangeeta Richard's family to move to America. Ms Richard's husband and two children flew out to the United States on December 10, just two days before the senior consular officer's arrest.
