எங்கயும் முட்டிக்க வேண்டாம் அசுரர்!  தேசபக்தி தேசமரியாதை என்ற போர்வையில் மனிதர்கள் துன்புறுத்தப் படுவதை மறைக்காமல் சட்டம் தன் வேலையைச் செய்ய விட்டாலே நன்மை நடக்கும், இந்தியாவின் மரியாதையும் தப்பும்! :D

அந்த அளவுக்கு இந்தியா கீழிறங்கும் எனில் இந்தியாவை விட கேவலமான நாடு உலகில் இருக்க முடியாது.

இப்ப தெற்காசிய வல்லரசு இலங்கைதான்..  :wub: இலங்கையை சமாதானப்படுத்த எந்த அளவுக்கும் இறங்கிப் போவார்கள்.. அவ்வளவு ஆதாரங்கள் அங்கே இருக்கு.. இப்படிப்பட்ட இந்திய அரசை நம்பி மேற்குலகம் அரசியல் செய்ய முடியாது. எல்லாமே நன்மைக்குத்தான்..

எந்த ஒரு விடயத்திலுமே சுறுசுறுப்பான நடவடிக்கை எடுக்காமல் காலத்தை இழுத்தடிக்கும் இந்திய அரசாங்கம் இந்த விடயத்தில் வீறுகொண்டு எழுந்ததில் இருந்து சந்தேகமா இருக்கு.. எல்லாம் திட்டமிட்டுத்தான் செய்கிறார்கள். :blink:

தேவயானி தனது வேலைக்காறியை நாள் குறுப்பு எழுதுவித்து வாங்கி சேகரித்து வைத்திருந்து அவளின் அனுமதி இல்லாமல் அதை இந்தியாவில் பிரசுரித்துமிருக்கிறா. இது வெல்லாம் வழக்கில் இழுபட போகிறது. அவளுக்கு தனிமை(நாள் குறிப்பு எழுத கூட) இருந்ததா என்ற கேள்வி வழக்கில் எழ் போகிறது?

 

இதை யெல்லாம் மனுசி நேரத்திற்கே போட்டுக்கொடுத்த்தால் மனிசியின் குடுமபத்தையே USA கொண்டுவந்துவிட்டு தேவயானியை கைது செய்திருக்கிறர்கள்.  தேவயானி பள்ளிக்கு போனாவா தெரியாது. வேலைக்காறமனிசிக்கு விசையம் புரிந்துதான் ஆத்தையை வடிவாக மாட்டியிருக்கிறது.

தேவ்யானிக்காக இவ்வளவு தூரம் போராடும் இந்தியா, அதேசமயம் இந்தியப் பிரஜையான அவரது வீட்டுப் பணிப்பெண் சங்கீதா ரிச்சர்ட்க்கு நடந்த அநீதி குறித்து ஏன் ஒன்றும் கூறவில்லை என குற்றம் சாட்டியுள்ளது அமெரிக்கா. மேலும், இந்தியத்துணைத் தூதர் கைது செய்யப்பட்டபோது நடந்தது என்ன என்பது குறித்து 3 பக்க விரிவான விளக்க அறிக்கையும் அது வெளியிட்டுள்ளது. நியூயார்க் நகரில் இந்திய தூதரகத்தில் துணை தூதராக பணியாற்றி வந்த தேவ்யானி கோப்ரகடே அமெரிக்க போலீசாரால் கைது செய்யப்பட்டார். விசா மோசடி உள்ளிட்ட குற்றச்சாட்டுளின் பேரில் அவர் கைது செய்யப்பட்டு நடத்தப்பட்ட விதம் கொந்தளிப்பை ஏற்படுத்தி உள்ளது. இந்தக் கைது விவகாரத்தில் ஆரம்பம் முதல் தனது கண்டனத்தைத் தேரிவித்து வரும் இந்திய அரசு, அவர் மீதான வழக்குகளை திரும்ப பெற வேண்டும் என அமெரிக்காவை வற்புறுத்தி வருகிறது. தேவ்யானிக்கு முழுமையான பாதுகாப்பு அளிக்கிறவகையில் அவரை ஐ.நா. சபைக்கான நிரந்தர இந்தியத்தூதராக நியமித்து மத்திய அரசு உத்தரவிட்டுள்ளது. இந்நிலையில், தேவ்யானி கைது குறித்து 3 பக்க விளக்கத்தை வெளியிட்டுள்ளார் அமெரிக்க அரசு வழக்கறிஞர் பிரித் பராரா. அதில் தெரிவிக்கப் பட்டுள்ளதாவது:-

தவறான தகவல்கள்.... தேவ்யானி கைது செய்யப்பட்டது தொடர்பான விவகாரத்தில் வெளியான தவறான தகவல்கள் குறித்து, நான் தெளிவுபடுத்த விரும்புகிறேன். தூதர்கள், தூதரக அதிகாரிகளின் வேலைக்காரர்களை பாதுகாக்க உருவாக்கப்பட்டுள்ள அமெரிக்க சட்டங்களை தேவயானி பின்பற்ற தவறி உள்ளார்.

கை விலங்கிடப் படவில்லை.... தேவ்யானி அவரது குழந்தைகள் முன்னிலையில் கைது செய்யப்பட்டதாக தவறாக தகவல்கள் வெளியாகி உள்ளன. அவரை மற்றவர்களைப்போல அல்லாமல், முடிந்த அளவு மிகுந்த முன் எச்சரிக்கை உணர்வுடன் கைது செய்துள்ளனர். அவருக்கு அப்போது கை விலங்கிடப்படவில்லை. கட்டுக்குள் வைக்கப்பட்டு விடவும் இல்லை.

செல்போனை பிடுங்கவில்லை.... உண்மையைச் சொல்வதானால், கைது செய்த அதிகாரிகள் வழக்கமாக மற்றவர்களிடம் இருந்து செல்போனை பறித்து விடுவதைக்கூட செய்யவில்லை. தனிப்பட்ட முறையில் அவர் எண்ணற்ற தொலைபேசி அழைப்புகளை செய்யவும் அனுமதி வழங்கப்பட்டது. குழந்தைகளை கவனித்துக்கொள்ள அவர் யாரையெல்லாம் தொடர்பு கொள்ள விரும்பினாரோ அதற்கெல்லாம் வாய்ப்பு அளிக்கப்பட்டது.

காபி கொடுக்கப் பட்டது... தேவ்யானி கைது தொடர்பான நடவடிக்கைகள் அனைத்தும் ஏறத்தாழ 2 மணி நேரத்தில் முடிந்து விட்டது. கடும் குளிர் காரணமாக அவரை தங்களது காரில் வைத்து போன் செய்யவும் அதிகாரிகள் அனுமதி அளித்துள்ளனர். அவருக்கு காபி கூட வரவழைத்து கொடுக்கப்பட்டது. அவருக்கு உணவு தரவும் முன்வந்தனர்.

வழக்கமான சோதனை தான்.... அவர் போலீசாரின் காவலுக்கு ஒப்படைக்கப்பட்டபோது, ஒரு பெண் போலீஸ் அதிகாரியை கொண்டு அந்தரங்கமாக முழுமையான சோதனைக்கு உட்படுத்தப்பட்டார். இது ஒவ்வொரு வழக்கிலும் குற்றம் சாட்டப்படுகிறவர்களுக்கு வழக்கமாக மேற்கொள்கிற சோதனைதான்.

பாதுகாப்பு கருதி சோதனை... அவர் பணக்காரராக இருந்தாலும், ஏழையாக இருந்தாலும், அமெரிக்கராக இருந்தாலும், இல்லாவிட்டாலும் தனிப்பட்ட முறையில் அவர்கள் யாரையும் பாதிப்புக்குள்ளாகிவிடும் விதத்தில் அல்லது தன்னைத்தானே எதுவும் செய்துவிடக்கூடாது என்பதற்காக அவர்கள் எதையும் வைத்துக் கொண்டிருக்கவில்லை என்பதை உறுதி செய்வதற்கு இந்த சோதனை செய்யப்படுகிறது.

தவறான தகவல்கள்.... கொழுந்து விட்டு எரியச்செய்கிற சூழலை உருவாக்கும் அளவுக்கு தேவ்யானி விவகாரத்தில் தவறான தகவல்கள் வெளியாகி இருக்கின்றன. இதை சரிசெய்ய வேண்டியது முக்கியமாகி உள்ளது. ஏனெனில் அவை மக்களை தவறாக வழி நடத்திவிடும்.

போலி ஆவணங்கள்... தேவ்யானி, சட்டத்திலிருந்து தப்பிக்க முயற்சித்ததோடு மட்டுமல்லாமல், அவர் பொய்யான ஆவணங்களை அளித்துள்ளார். அவர் பொய்யான தகவல்களையும் அமெரிக்க அரசிடம் அளித்துள்ளார்.

சட்டத்தை மீறிய தேவ்யானி.... எந்த அரசாங்கமாவது, தனது நாட்டுக்குள் ஒருவரை அழைத்துக்கொண்டு வருவதற்கு ஒருவர் பொய்யான தகவல்களை அளித்தால் எந்த நடவடிக்கையும் எடுக்காமல் விட்டு விடுமா? சட்டத்தை மீறுகிற வகையில், பணிப்பெண்ணை சரிவர நடத்தாமல் இருந்தால் எந்த அரசாங்கமாவது நடவடிக்கை எடுக்காமல் விட்டு விடுமா?

இந்தியப் பணிப்பெண்.... இத்தகைய குற்றச்சாட்டுக்கு ஆளாகியுள்ள இந்திய பிரஜை நடத்தப்பட்டவிதம் குறித்து வரம்பு கடந்து நடந்துகொள்கிறார்களே, ஆனால் இந்திய பணிப்பெண்ணோ, அவரது கணவரோ மோசமாக நடத்தப்பட்டது குறித்து கொஞ்சமாவது கொந்தளித்தார்களா?

சம்பந்தப்பட்ட அமைப்புகள்... எங்கள் அலுவலகத்தை பொறுத்தமட்டில் அது, வழக்கினை நடத்துகிற அலுவலகத்தின் பொறுப்பை கொண்டுள்ளது. கைது செய்தல், காவலில் வைத்தல் தொடர்பானது அல்ல. எனவே அவர் கைது செய்யப்பட்ட விவகாரம் குறித்த தகவல்களை தொடர்புடைய அமைப்புகளிடம்தான் கேட்க வேண்டும்.

தேவ்யானி மீதே குற்றம்... இந்த விவகாரத்தில் தேவ்யானி நடந்துகொண்ட விதம், நியாயம் என கூறுகிற வகையில் இல்லை என்பது தெளிவு' என இவ்வாறு தெரிவித்துள்ளார்.

குற்றச்சாட்டு... தேவயானி, இந்தியாவில் இருந்து வீட்டு வேலை செய்வதற்காக அழைத்துச்சென்ற பணிப்பெண் சங்கீதா ரிச்சர்டுக்கு அமெரிக்க சட்ட விதிகள்படி மணிக்கு 9.75 டாலர் (சுமார் ரூ.620) தருவதாக அழைத்துச்சென்றதாகவும், ஆனால் மணிக்கு 3.11 டாலர் மட்டுமே (சுமார் ரூ.186) சம்பளம் தந்ததாகவும், தினமும் 19 மணி நேரம் வலுக்கட்டாயமாக வேலை வாங்கி கொடுமைப்படுத்தியதாகவும், இதற்கு உடன்படாத நிலையில் அந்தப்பெண், தேவயானியின் வீட்டில் இருந்து சென்று விட்டதாகவும் தேவ்யானி மீது குற்றம் சாட்டப் பட்டது குறிப்பிடத்தக்கது.

இந்தியத் துணைத் தூதர் கைது விவகாரத்தை அதிகாரிகளும், ஊடகங்களும் வேறு மாதிரியாக திசை திருப்பி விட்டன என குற்றம் சாட்டியுள்ளார் தேவ்யானியின் பணிப்பெண் சங்கீதா ரிச்சர்டு.

விசா மோசடி வழக்கில் இந்தியப் பெண் தூதர் தேவ்யானி அமெரிக்காவில் கைது செய்யப்பட்ட விவகாரத்தில் இந்தியா-அமெரிக்கா இடையே தொடர்ந்து கருத்து மோதல் நடைபெற்று வரும் நிலையில், இது குறித்து தனது வேதனையைத் தெரிவித்துள்ளார் அவரது பணிப்பெண் சங்கீதா ரிச்சர்டு.

உயர்பதவி வகித்துக்கொண்டு செய்யும் முல்லைமாரி தனத்துக்கு தகுந்த தண்டனை கொடுக்கப்பட வேண்டும். உடல் பரிசோதனை பெண் உத்தியோகத்தர்கள் செய்திருப்பார்கள் என நம்புகிறேன்.அமெரிக்க சட்டத்தை இந்தியர்களுக்காக மாற்ற முடியாது. மன்னிப்பும் கேட்க முடியாது.அமெரிக்காவில் இந்தியாவில் செய்யும் விளையாட்டுகளை செய்யும் போது அதற்கான தண்டனையையும் பெறத்தான் வேண்டும்.நிறைய இந்தியர்கள் பிலிப்பைன்ஸ் போன்ற நாட்டு பணிப்பெண்களை இப்படித்தான் செய்கிறார்கள்.இவர்களுக்கும் ஒரு படிப்பினையாக இருக்க வேண்டும்.இவ்வளவும் சாதாரண மக்களின் வாழ்க்கையும் அதற்கு சட்டம் என்ன செய்ய வேண்டும் என்பதுமாகும்.
 
இந்தியாவுக்கும் அமெரிக்காவுக்கும் உள்ள குளிர்ச்சண்டை(cold war) பற்றி யாரும் எழுதினால் வாசிக்க ஆவலாக உள்ளேன். ஏனெனில் உள்ளூர ஏதோ ஒரு புகைச்சல் இரு நாடுகளுக்கும் உள்ளது போலவும் அதற்காக இச்சம்பவம் பயன்படுத்தப்பட்டிருப்பது போலவும் உணர முடிகிறது.

நிச்சயம்.... மலையாளியாக இருப்பார், என நினைக்கின்றேன்.
அவர்களுக்குத் தான்.... இந்தியாவை, உலக அளவில் வம்பிலை மாட்டி விட்டு, தப்பிக்கப் பார்க்கும்... பொறுக்கித்தின்னி எண்ணங்கள் வரும்.

The female Indian diplomat who was strip-searched and charged with visa fraud after allegedly lying about paying her nanny $3.31 an hour should have all charges dropped, Indian government officials said Wednesday.

The case against Devyani Khobragade, who claims that she was being blackmailed by her maid who she kept in apparent servitude, has caused international furor with top officials in her home country who have taken her side.

'We need to remember the simple fact that there is only one victim in this case. That victim is Devyani Khobragade — a serving Indian diplomat on mission in the United States,' India's Minister of External Affairs Shri Salman Khurshid said to parliament on Wednesday.

The prosecuting attorney, who is Indian-American, defended the decision to strip search the 39-year-old mother- saying that it was standard protocol for anyone facing charges- and other officials said that she did not undergo a cavity search nor was she swabbed for a DNA sample.

The strip search was a bridge too far for her Indian supporters, however, who are now saying the entire debacle is the result of a conspiracy, effectively claiming that the maid knew what she was signing up for when she agreed to travel to America with the Indian deputy counsel general and tried to change their agreement after her arrival in New York.  

'It became clear at that point that this was a conspiracy by which some people had virtually trapped our official into a situation where she would have to do something illegal in order to help those people remain in the United States of America,' Mr Kurshid said.

'It is not the illegality she is accused of, it is the illegality she refused to subject herself to that brought about this unfortunate situation upon her.'

Dr Khobragade and her maid, Sangeeta Richard, have been having a legal battle for months over Richard's treatment and immigration status, but the flames hit the diplomatic kindling when it was revealed that Dr Khobragade was strip searched after being arrested.

Dr Khobragade claims that she was subject to a cavity search- which would have involved a DNA sample- when she was arrested but the Marshals service denied those allegations, saying she was actually given preferential treatment.

Those reassurances did little to tamper the backlash over the strip search, as Indian officials removed the concrete security barriers that had been protecting the US embassy in Delhi and said that they will refuse to give diplomatic privileges to American officers in India.

In a sign of the growing importance of the case, US attorney for the southern district of New York Preet Bharara spoke out publicly about her better than average treatment, saying she was even allowed to keep her mobile phone and was offered snacks while in custody.

India is attempting to ensure Devyani Khobragade has full diplomatic immunity from prosecution by transferring her to their Permanent Mission.

The move effectively affords her complete immunity from further legal action because the Mission is technically Indian soil and the U.S. have no authority on it.

As Deputy Consul General, Ms Khobragade enjoyed ‘consular immunity’ which is limited and related to her official duties. Under the 1963 Vienna Convention on Consular Relations, consular officials can still be arrested for acts committed outside on official job functions.

Her transfer to India’s Permanent Mission to the UN in New York – effective immediate – was intended to keep her ‘safe’ while her government seeks to bring her back to India.

If she were to be convicted of the crime she is accused of, Khobragade would face a maximum sentence of 10 years for visa fraud and five years for making a false declaration.

Diplomatic immunity is a policy held between governments that ensures that diplomats are given safe passage and are considered not susceptible to lawsuit or prosecution under the host country's laws, although they can still be extradited. 

It was developed to allow for the maintenance of government relations, including during periods of difficulties and even armed conflict.

Outlining the allegations made against Dr Khobragade, he also questioned the lack of concern for the alleged victim.

‘Ms. Khobragade was accorded courtesies well beyond what other defendants, most of whom are American citizens, are accorded,’ he said in a statement.

He explained that she was not handcuffed or restrained by police, and was offered food and coffee by officers.

Mr Bharara said she was arrested because it is alleged she ‘clearly tried to evade U.S. law designed to protect from exploitation the domestic employees of diplomats and consular officers’ and questioned why so little sympathy has been given to her nanny.

He said: 'One wonders why there is so much outrage about the alleged treatment of the Indian national accused of perpetrating these acts, but precious little outrage about the alleged treatment of the Indian victim and her spouse?'

He said her strip-search, which was conducted by a female Deputy Marshal in a private setting, was 'standard practice for every defendant, rich or poor, American or not'.

Mr Bharara explained that this was in the 'interests of everyone's safety' - in order to make sure a prisoner cannot harm anyone, including themselves.

Issuing the statement, he explained that he was keen to correct 'factual inaccuracy' surrounding the arrest, conscious of the 'inflammatory atmosphere' it had created.

He said that Dr Khobragade's arrest by the State Department did not take place in front of her children, as had been alleged.

‘The agents arrested her in the most discreet way possible, and unlike most defendants, she was not then handcuffed or restrained,’ he said.

Mr Bharara added that her phone was not taken and that she was given two hours ‘to make numerous calls to arrange personal matters and contact whomever she needed, including allowing her to arrange for child care’.

 

 

He said: ‘Because it was cold outside, the agents let her make those calls from their car and even brought her coffee and offered to get her food.’

Outlining the charges faced, he said it is alleged Dr Khobragade 'clearly tried to evade U.S. law designed to protect from exploitation the domestic employees of diplomats and consular officers'.

He added: 'Not only did she try to evade the law, but as further alleged, she caused the victim and her spouse to attest to false documents and be a part of her scheme to lie to U.S. government officials.

'So it is alleged not merely that she sought to evade the law, but that she affirmatively created false documents and went ahead with lying to the U.S. government about what she was doing.

'One wonders whether any government would not take action regarding false documents being submitted to it in order to bring immigrants into the country.


 

 

'One wonders even more pointedly whether any government would not take action regarding that alleged conduct where the purpose of the scheme was to unfairly treat a domestic worker in ways that violate the law.'

Meanwhile, it has emerged that Dr Khobragade filed a complaint to New York police five months ago, claiming that the housekeeper she now stands accused of keeping ‘a virtual slave’ was attempting to blackmail her.

The report, filed on July 5, alleged ‘aggravated harassment’ after Dr Khobragade said she had received a phone call from a woman claiming to be maid’s attorney, according to reports in India.

The woman allegedly had three demands of the Deputy Consul General: sign paperwork terminating Ms Richard’s employment, change her visa status from government to normal and compensate her for 19 hours work per day.

 

 

 

 


According to Dr Khobragade, Ms Richard disappeared from her job two weeks earlier, on 24 June, following a tiff between employer and employee.

Ms Richard wanted to take another part-time job but Dr Khobragade denied her request on the grounds that she would be in breach of her visa if she did so.

Dr Khobragade’s arrest at the gates of her daughter’s Upper East Side school last Thursday has sparked an international furor.

She stands accused of submitting false documents to obtain a work visa for her Manhattan housekeeper with prosecutors claiming the made received just $3.31 an hour – well under the minimum wage.

The Deputy Counsel General for Political, Economic, Commercial and Women’s affairs was held in a cell with sex workers and drug addicts before posting $250,000 bail.

She has now been transferred to India’s Permanent Mission to the UN in New York, a move effectively granting her complete diplomatic immunity and placing her on Indian soil – outside US jurisdiction.

But what has marked the beginning of a diplomatic incident that has exploded across continents is just the latest stage of a domestic dispute and clash of cultures which has escalated beyond all proportion.

Ms Richard arrived in the United States with Dr Khobragade in November 2012. MailOnline's sister paper in India, Mail Today, has detailed how she had been offered a job as housekeeper, maid and childminder after her husband, Philip, a driver with the Embassy of Mozambique in New Delhi, approached Dr Khobragade on his wife’s behalf.

 

He claimed that they needed the money to educate their children. Dr Khobragade, herself a mother of two with a special interest in education and women’s affairs, welcomed Ms Richard.

They flew courtesy of the Ministery of External affairs and Ms Richard was issued a visa under her status of India Based Domestic Assistant (IBDA)  -  a status which did not allow her to work outside.

Barely four months later she began asking to do just that, according to Dr Khobragade in a complaint filed in the Mehrauli police station on 2 July 2013.

Ms Richard was bored with her limited life and the relationship between Dr Khobragade and her maid seems quickly to have soured amid tit for tat legal complaints in both India and the States.

Dr Khobragade first tried to involve US authorities when Ms Richard went missing on June 24. To the diplomat it seems that this was a case of a servant absconding – local reports have described Richard in those terms - as much as an Indian national potentially using her employment in the States as a gateway to immigration.

Unable to file a missing person’s report as she was not a family member she wrote to the precinct and was interviewed by police in front of the Permanent Mission of India, the reports say.

The phone call purporting to be from Ms Richard’s attorney and making demands under the threat of taking legal action against Dr Khobragade came a few days later on 1 July.

Dr Kobragade filed her report with Mehrauli police station the very next day. She claimed that her maid’s life in New York was comfortable and that she was ‘at liberty to use and was in fact using the residential phone of the plaintiff to talk to her family in Delhi regularly.’

 

When her husband refused to co-operate with Ministry of External Affairs staff attempting to find his wife, a First Information Report (the police report necessary to start proceedings in India) was filed against both, accusing them of attempting to cheat their way into America by illegal means.

On July 8, Ms Richard agreed to meet Dr Khobragade.  The former housekeeper asked for $10,000, an ordinary visa and immigration relief to be permitted to stay in the US, according to the reports in India. Instead she had her passport revoked.

Ms Richard and her family have now been granted non-immigrant T Visas, created by Congress more than a decade ago to help law enforcement officers investigate and prosecute human trafficking.

A further slew of legal writs followed her failed attempt at settlement – Ms Richard’s husband Philip filed a petition against his wife’s employer and the Union of India in which he claimed his wife was in police custody in New York and had been held ‘a virtual slave’ by her diplomat boss.

Wherever the truth lies, the US State Department was concerned enough to want to meet Dr Khobragade in September to discuss the allegations being leveled at her by her maid – primarily that of payment below US minimum wage.

Bit by bit communications between the Indian and US authorities appear to have become more frayed and tense.

The Indian Embassy in Washington took exception to the tone of the letter sent by the State Department pointing out that this was a matter between the Indian government and its employee and not one subject to US regulation.

In November an arrest warrant for Ms Richard was issued in Delhi as the Indian government seeks to repatriate the employee described in local press as ‘an absconding maid.’

Two days before Dr Khobragade’s arrest Ms Richard’s husband and parents allegedly flew in to the States.

Amid confusion, claim and counter-claim the stage was set for the explosion that came with that arrest as two legal systems set in motion across two continents, and drawn from two very different cultures, finally collided.

US attorney Preet Bharara, who is the latest to be dubbed the 'Sheriff of Wall Street', oversees the investigation and litigation of all criminal and civil cases brought on behalf of the United States in the Southern District of New York, which encompasses New York, Bronx, Westchester, Dutchess, Orange, Putnam, Rockland and Sullivan counties.

He supervises an office of more than 220 Assistant US Attorneys, who handle a high volume of cases that include domestic and international terrorism, narcotics and arms trafficking, white collar crime, public corruption, gang violence, organized crime, and civil rights violations.

Since Mr. Bharara’s appointment as US Attorney, the office successfully extradited and prosecuted one of the most notorious arms traffickers in the world, Viktor Bout, who is now serving a 25-year sentence.

New Delhi: Devyani Khobragade, who is caught in the line of fire, is the daughter of a retired IAS officer of Maharashtra cadre Uttam Khobragade. Born and brought up in Mumbai, she went to Mount Carmel school. Later she did MBBS from Seth GS medical college and KEM hospital in Mumbai. But she did not pursue her career in medicine and opted for the Foreign Service. Her uncle Dr Ajay M Gondane is also an IFS officer of 1985 batch.

Beautiful and intelligent Devyani cleared the prestigious Indian Foreign Service (IFS) in 1999. She handled political division of Indian missions in Pakistan, Italy and Germany before moving to the much coveted Indian embassy in the United States of America (USA). She is currently posted as a deputy consul general of India in New York.

Bangalore: Indian diplomat Devyani Khobragade, who was strip-searched and had to undergo a body cavity search, was insulted and humiliated like a hardened drug addict or someone who was known to transport illegal drugs.

The more insulting procedure is called body cavity search. Here, the authorities conduct either a visual search or a manual internal inspection of body cavities for prohibited material (contraband), such as illegal drugs, money, jewelry, or weapons.  Devyani did nothing that invited such a demeaning procedure.

The body cavity search is far more invasive than the standard strip-search that is typically performed on individuals taken into custody, either upon police arrest or incarceration at a jail, prison, or psychiatric hospital. Often the procedure is repeated when the person leaves the institution.

Maid’s kin work for US; family got visa

In visual body cavity search, a flashlight is used to illuminate body orifices, including nostrils, ears, mouth, navel, penis (urethra and foreskin) or vagina, and rectum. Generally, the detainee is required to manipulate these body parts so that they can be examined.

During manual body cavity searches, body orifices are probed using fingers or the entire hand. The circumstance in which these inspections may be done is often restricted. For example, they are done on individuals refusing to offer to consent to a visual body cavity search or in situations where there is strong evidence to suspect the presence of contraband.

Some human rights activists argue that body cavity searches are often done to harass and humiliate detainees rather than check the flow of contraband.  Because these searches are highly invasive and greatly compromise an individual’s right of privacy, the legality of visual and manual body cavity searches is frequently contested.

In Bell v. Wolfish, a landmark judgment in the United States, the court established a standard of reasonable grounds for performing cavity searches. Devyani does not fall in this category. Among these are security concerns at prisons.

A strip-search, on the other hand,  is a practice of searching a person for weapons or other contraband suspected of being hidden on their body or inside their clothing, and not found by performing a frisk search, by requiring the person to remove some or all of his or her clothing. The search may involve an official performing an Intimate Person Search and inspecting their personal effects.

A strip-search is more intrusive than a frisk and requires legal authority. Regulations covering strip-searches vary considerably, and may be mandatory in some situations or discretionary in others.

New Delhi (AFP) - India angrily brushed aside fresh efforts by the United States Friday to defuse a row over the arrest and strip-search of one of its diplomats, warning Washington that "times have changed".

Diplomatic sources said Nancy Powell, the US ambassador to New Delhi, was holding talks with senior foreign ministry officials as part of efforts to resolve the crisis sparked by the December 12 arrest of Devyani Khobragade, India's deputy consul general at its mission in New York.

Powell's olive branch comes after top State Department officials called their Indian counterparts for the third time in two days to try to draw a line under the controversy over accusations that Khobragade underpaid her maid in New York.

Subsequent revelations that Khobragade was stripped by US Marshals and subjected to an invasive body search have caused outrage in India, whose government wants Washington to drop the case and offer an apology.

US Secretary of State John Kerry has expressed "regret" and stressed the issue should not be allowed to derail a "vital relationship" -- a message amplified in a phone call Thursday by State Department number three Wendy Sherman to Indian Foreign Secretary Sujatha Singh.

"What we're focused on now ... is working to move the relationship forward," State Department deputy spokeswoman Marie Harf told reporters.

But there was no sign Friday that the calls had placated the government in India which sees itself as an emerging power that should be treated with respect by an ally such as the US.

"They should tender a clear apology. We will not accept this conduct against India under any circumstances," Parliamentary Affairs Minister Kamal Nath told reporters.

"The US has to understand that the world has changed, times have changed and India has changed.

"The conduct and attitude that the US has shown regarding the Devyani issue is a matter of concern not only for India but also for all countries and everyone should raise their voice."

Foreign Minister Salman Khurshid said he expected to talk with Kerry later in the day in what is likely to be a tense phone call.

"The only question is what do you do when something happens that is irksome, that is hurtful and that is unacceptable," Khurshid told reporters after talks with Venezuela's visiting foreign minister.

"You've got to find a solution, and we hope we will find a solution."

Keen to project a muscular image ahead of a general election due in May, the ruling Congress party has taken a strikingly hard line in the dispute.

The vice president of the Hindu nationalist opposition Bharatiya Janata Party, which is expected to win the election, also warned that India expected a full apology rather than expressions of regret.

"The US will have to apologise," Mukhtar Abbas Naqvi was quoted as saying by the Press Trust of India news agency.

"This is an extraordinary event and not about the US and India alone."

The 39-year-old, who is now free on bail, was detained over allegations that she paid the domestic worker a small fraction of New York's minimum wage and lied about the employee's salary in a visa application.

US federal prosecutor Preet Bharara has insisted Khobragade was arrested in the "most discreet" way possible and that his sole motivation was to uphold the rule of law, protect victims and hold accountable anyone who breaks the law "no matter how powerful, rich or connected they are".

India is trying secure full diplomatic immunity for Khobragade by shifting her to its UN mission in New York, although such a move needs State Department approval.

A spokeswoman for the State Department made clear in a briefing Thursday that the United States could not simply drop the case, as "the judicial process is independent" of the government.

The dispute is the second diplomatic flare-up between India and a major Western nation this year.

India reacted furiously in March when Italy reneged on a promise to fly two marines back to New Delhi to face trial over a fatal shooting.

The marines did eventually return after India ordered immigration authorities to prevent Italy's ambassador from leaving the country.

சுண்டல் உணர்ச்சிவசப்படவேண்டாம்.. இருக்கின்ற தரவுகளின் அடிப்படையில் பேசலாமே.. ஒட்டுக்கேட்ட ஆதாரங்கள் இருந்தால் அந்த ஆதாரங்களைக் கொண்டு அந்தந்த நாடுகள் நடவடிக்கைகளை தொடங்கலாம்..

அண்மையில் தூத்துக்குடி கடலில் அமெரிக்க கப்பலை பிடித்து கைது செய்தார்கள்.. அதுக்காக அமெரிக்காவில் இந்திய தூதரகங்களின் பாதுகாப்பை குறைத்தர்களா அல்லது செனட்டில் துள்ளிக்குதித்தார்களா??

இந்திய ஆளும்வர்க்கம் ஒட்டுமொத்த இந்திய மானத்தையும் கப்பலேற்றுகிறது என்பதுதான் இங்கு விடயம்.

NEW DELHI (Reuters) - Indian protesters ransacked a Dominos Pizza outlet in a Mumbai suburb on Friday, demanding a ban on U.S. goods as officials from the two countries tried to defuse a dispute over the arrest of an Indian diplomat in New York.

Police and the Indian franchise of the U.S. chain said no one was hurt in the attack, which came amid unrelenting rage in India over the arrest and subsequent strip-search of Devyani Khobragade for visa fraud and under-payment of her housekeeper.

India has demanded that the charges be dropped against the diplomat. Her father threatened to begin a fast if U.S. authorities press ahead with the case.

Police in Mumbai said they were stepping up patrolling of major U.S. outlets including McDonald's after workers of the small Republican Party of India attacked the Dominos store. The group sent pictures to media organizations showing a broken glass door.

"The fact is that (the) American authorities have behaved atrociously with an Indian diplomat. And obviously, America has to make good for its actions," said Manish Tiwari, India's minister for information and broadcasting.

"So therefore, I think it is a legitimate expectation, that if they have erred, and they have erred grievously in this matter, they should come forth and apologize."

In a possible sign of a way out of the crisis, the United Nations said it received an official request from India to accredit Khobragade as a member of that country's permanent U.N. mission in what appeared to be a move to give her a stronger form of diplomatic immunity.

U.S. State Department spokeswoman Jen Psaki, however, said any change in the diplomat's accreditation status would not provide a "clean slate from past charges."

Asked whether diplomatic immunity could prevent Khobragade from being arrested again or enable her to leave the United States - a possible solution to the matter - Psaki said, "I don't want to speculate on that."

She side-stepped a question as to whether the United States would apologize to India over the matter but underscored the importance of U.S.-Indian relations.

"We certainly fully agree that it's important to preserve and protect our partnership. It's not just about diplomatic ties," Psaki told reporters, citing more than $90 billion in bilateral trade, close counterterrorism cooperation and engagement on a range of topics including Afghanistan.

"And we want to move beyond this, and I think we all recognize the importance of our long-term relationship," Psaki added.

U.S. Secretary of State John Kerry expressed regret over the case in a phone call to India's national security adviser this week, but U.S. prosecutors have defended the investigation against Khobragade and her treatment.

DIPLOMATIC IMMUNITY

Khobragade was arrested last week and released on $250,000 bail after giving up her passport and pleading not guilty to charges of visa fraud and making false statements about how much she paid her housekeeper. She faces a maximum of 15 years in prison if convicted on both counts.

The U.S. Justice Department confirmed that Khobragade was strip-searched after her arrest. A senior Indian government source has said the interrogation also included a cavity search, although U.S. officials have denied this.

"I want these false and fabricated charges to be dropped," said Uttam Khobragade, the diplomat's father, adding that he would go on a hunger strike if his demands aren't met. "That will be my last option."

Protesters also gathered at the U.S. consulate in Hyderabad for a second day on Friday, shouting slogans, local media said.

Furious that one of its foreign service officers had been handcuffed and treated like "a common criminal", India on Tuesday removed security barriers outside the U.S. embassy in New Delhi and withdrew some privileges from U.S. diplomats.

But the reaction in India was even more intense because none of the political parties preparing for next year's general election wanted to be seen as weak against a superpower.

Politicians, including the leaders of the two main parties, refused to meet a delegation of visiting U.S. lawmakers.

"Because of the election, they will try to outdo each other," said Neerja Chowdhury, a political analyst and a former political editor of Indian Express newspaper.

"They don't want to be seen as weak on the issue when the mood in the country is one of huge anger about this."

The party that runs India's most populous state, Uttar Pradesh, urged Khobragade to stand for parliament, highlighting how public outrage has turned the case into a battleground for votes.

மேற்கு நாடுகளில் வாழும் இந்தியர்கள் இந்தியாவின் செயல்களைக் கண்டித்து போராட்டத்தில் ஈடுபடவேண்டும்.. :rolleyes: இதன்மூலம் எல்லா இந்தியர்களும் இதுபோல இல்லை என்பதை எடுத்துக்காட்டலாம்..
