இலங்கையும் சீனாவும் தங்களின் நீண்ட கால நட்புறவிற்கு பாதிப்பு ஏற்படாத வகையில் அம்பாந்தோட்டை துறைமுக உடன்படிக்கை குறித்து மீண்டும் ஆராய்வதற்கு இணங்கியுள்ளன.

சீன ஜனாதிபதியின் விசேட பிரதிநிதியாக இலங்கைக்கு விஜயம் மேற்கொண்டுள்ள இலங்கைக்கான முன்னாள் தூதுவர் வு ஜியாங்காவோ பிரதமர் மகிந்த ராஜபக்சவை சந்தித்து பேச்சுவார்த்தைகளை மேற்கொண்டுள்ளார்.

இருவருக்கும் இடையிலான சந்திப்பின்போது அம்பாந்தோட்டை துறைமுகம் குறித்து ஆராயப்பட்டதாகவும்,இரு தரப்பும் இது குறித்து கருத்துபரிமாற்றத்தில் ஈடுபட்ட பின்னர் இலங்கைக்கும் சீனாவிற்கும் இடையிலான நீண்ட கால நட்புறவிற்கு பாதிப்பை ஏற்படுத்தாத வகையில் அம்பாந்தோட்டை துறைமுக உடன்படிக்கை குறித்து மீண்டும் பேச்சுவார்த்தைகளை மேற்கொள்வதற்கு இணங்கியதாகவும் தகவல்கள் வெளியாகியுள்ளன.

இலங்கை அரசாங்கம் நீண்ட கால நட்புறவை மேலும் வலுப்படுத்துவதன் அவசியம் குறித்து விருப்பம் வெளியிட்டுள்ளது.

இலங்கையுடனான சீனாவின் பொருளாதார ஒத்துழைப்புகளை அதிகாரிப்பது குறித்த சீனாவின் விருப்பத்தை விசேட பிரதிநிதி வெளியிட்டுள்ளார்.

இரு நாடுகளும் கைச்சாத்திட்ட ஆனால் முன்னைய அரசாங்கத்தின் காலத்தில் நடைமுறைப்படுத்தப்படாத திட்டங்களிற்கு புத்துயுர் கொடுப்பதற்கும் இரு தரப்பும் இணங்கியுள்ளன.

இந்த துறைமுகத்தை சீனா இலகுவில் கைவிடாது. அவர்களது பட்டு பாதை திடடத்தின் ஒரு முக்கியமான இடம்தான் இந்த துறைமுகம். இரு நாடுகளுக்கும் இடையில் செய்து கொள்ளும் உடன்படிக்கையானது இலகுவில் மற்றம் செய்ய முடியாது இரு நாடுகளின் ஒத்துழைப்பு இல்லாமல். இருந்தாலும் இலங்கையை சீனாவினால் பகைக்க முடியாது. எனவே நிச்சயமாக ஒரு மாற்றம் செய்யப்படும். இருந்தாலும் சீனாவின் பலம் அதில் மேலோங்கியே இருக்கும்.

SL, China to draw up ‘new blueprint’ for future cooperation

China and Sri Lanka yesterday agreed to speed up the implementation of large-scale projects and draw up a “new blueprint” for future cooperation following high-level meetings between President Gotabaya Rajapaksa and Chinese special envoy Wu Jianghao.   

The large-scale projects will also focus on the Colombo Port City project and the Hambantota Port venture.   

A Chinese delegation headed by former Chinese Ambassador to Sri Lanka, Wu Jianghao, as the representative of State Councillor and Foreign Minister Wang Yi, and other embassy officials called on President Rajapaksa. He also met with Prime Minister Mahinda Rajapaksa yesterday as well as Speaker Karu Jayasuriya, United National Party (UNP) Leader Ranil Wickremesinghe and Foreign Minister Dinesh Gunawardena. 

Following the meeting with President Rajapaksa, the Chinese embassy in a statement said that both parties agreed to further strengthen the “robust political trust between” both countries. 

Sri Lanka and China agreed to enhance their practical cooperation and “speed up the implementation of the big economic projects, including the Colombo Port City and the Hambantota Port according to existing consensus and, on that basis, draw up the new blueprint for future cooperation” the communique said.

Hot on the heels of President Rajapaksa’s win, China had extended an invitation to visit Beijing. Chinese Ambassador Cheng Xueyuan extended the invitation for him to visit China at “a mutually convenient and mature time” a spokesman for the embassy said.

The visit comes days after President Rajapaksa told an Indian journalist in an interview that he would renegotiate the Hambantota Port lease agreement, terming it a “mistake” and calling on the Chinese company to be open to the move.

In the interview, President Rajapaksa claimed that even though China was a good friend, he was not afraid to say the joint venture inked by the former Government was a mistake, pointing out that public sentiment was against the deal. President Rajapaksa opined that handing over control of a valuable asset of economic importance such as a port should not be done.  

Sri Lanka and China signed a $ 1.1 billion deal in 2017 which paved the way for a Chinese firm to lease the port for 99 years for commercial activity. The deal was signed between the Sri Lanka Ports Authority (SLPA) and China Merchants Port Holdings. Under the deal, the Chinese firm holds a 70% stake in a joint venture with SLPA to run the port for 99 years for commercial purposes. The Chinese firm invested an additional $ 600 million to make the port operational.

எனவே கோத்தா விரும்பினால் 99 வருட குத்தகையை 40 வருட குத்தகையாக மாற்ற மீள்பேச்சுவார்த்தை நடத்தலாம்.

இது சொறி சிங்களத்தின் கைகளில் இல்லை. அறிந்த மற்றும் புரிந்த வரையில்,
சிங்களம் பட்ட கடனை செலுத்தக் கூடிய நிலையில் இருப்பினும், இந்த பேரத்தை 
இரத்து செய்ய முடியாது, சீனா ஏற்றுக்கொள்ளாவிடின்.

அம்பாந்தோட்டை துறைமுக பேரம் ஓர் வர்த்தக பேரமாயினும், அதன்  தளம் இரு, சம, 
இறைமையுள்ள  அரசுகளுக்கிடையிலான ஒப்பந்தத்தின்  (treaty) அடிப்படையில்.

மற்றது, சொறி சிங்களம் பேரத்தை எந்த வேளையிலாவது மாற்ற எத்தனிக்கும் (அரசியல்) அபாயத்தை (risk), சீனா கண்ணும் கருத்துமாக கவனித்தே பேரத்தை வடிவமைத்துள்ளது. 

ஆயினும், இப்படி பிரச்சனைகள் வரும் போது, சீனாவின் அணுகுமுறை, சீனாவின் வார்த்தையில் win-win. ஆனால், சீனாவின் win வேறு, வெளியில் கதைப்பது மென்மையாக, சீனாவே சொல்லியவாறு 'நீண்ட கால' நட்புறவை பாதிக்காமல், மேலும் வளர்க்கும் வழியில் ஆராயப்படும். 

சீனாவும், அதன் அரச-தனியார் கம்பனிகளுமே , எதிலும் இறுதி முடிவு எடுக்கும் அதிகாரத்தில் இருக்கிறது.

பாதுகாப்பு ஏற்பாடுகளின் இறுதி முடிவும், கட்டுப்பாடும் , சீன மற்றும் அதன் கம்பனிகளின் கைகளில் (> 55%). சீனா சொறி சிங்களத்தை இப்பொது (வெளித்தோற்றத்திற்கு)  பாதுகாப்பிற்கு அமர்த்தி உள்ளது.

"What Does The Agreement Actually Look Like?

After months of delay, the tripartite Concession Agreement was finally signed on July 29 as a private public partnership (PPP) between the Ministry of Ports and Shipping, the Sri Lanka Ports Authority (SLPA), and China Merchants Port Holdings Company Ltd. The agreement saw two separate companies being set up to oversee commercial and security operations of the Port.

According to Government statements to the media, the Chinese state-owned company will have a 70% stake (the earlier 80% having been reportedly been renegotiated) of the Hambantota Port for a period of 99 years, along with 1,235 acres of land allocated adjacent to the Port for a proposed industrial zone. (The earlier reports of 15,000 acres of land that were to be acquired for an industrial development zone in Hambantota is for an unrelated initiative). The Government laid heavy emphasis on the fact that Sri Lanka retains the right for any military operations in and around the Port, with no foreign military presence allowed without prior approval from the Government of Sri Lanka—allaying fears the Port may end up being used by the Chinese military. Chinese participation will be strictly commercial, the Government insisted.

“We are giving the country a better deal without any implications on security,” the BBC quoted Prime Minister Ranil Wickremesinghe as saying.

The Government has also said that Sri Lanka retains the option to amend the agreement should any aspect of it prove to be not in her interest, adding that the Chinese have agreed to this, though critics worry that there is no guarantee that China will honour this.

HIPS Don’t Lie?

The two companies set up as part of the Concession Agreement are the Hambantota International Port Group (Pvt) Ltd (HIPG), which will oversee commercial operations of the port, and the Hambantota International Port Services (Pvt) Ltd (HIPS), which will oversee Common User Facilities, or CUF, including security operations.

China Merchants Port, or CMPort, will hold a majority stake of 85% of HIPG, with SLPA holding the remaining 15%. Though there were reports earlier to the effect that the Government of Sri Lanka will hold a majority stake of HIPS, as per the July 29 agreement (as pointed out by the Sunday Times), it will be shared thus: 42% held by the SLPA, and 58% held by HIPG—meaning, contrary to earlier claims, the SLPA will, in fact, be a minority shareholder in both companies.

Earlier reports indicated that SLPA will hold 50.7% of HIPS, with China sharing the remaining 49.3%, giving Sri Lanka majority stake of the USD 606 million company. The Sunday Times, however, quoting unnamed corporate analysts, noted that SLPA’s 50.7% stake is comprised of 8.7% in HIPS shares, which is not direct, but rather represented through HIPG in a “convoluted share structure.” According to the weekly newspaper, the document signed on July 29 does not mention the SLPA’s 8.7% stake to be held separate in HIPS."

“The Agreement, which is a legally binding document, states that ‘initial equity share capital to be comprised of 42% to be held by the SLPA and 58% to be held by the HIPG operator.’ The document signed yesterday (July 29) does not mention SLPA’s 8.7% stake to be held separately in HIPS. வேடிக்கை, நிலம் மற்றும் கடல் உரிமம் கம்பனிகளுக்கு, கம்பனிகள் மொத்தமாகவும் (71.5%), தனித்தனியாகவும் (85%, 58%)  சீனாவின் கையில். குத்தகை முடிவில், கம்பனிகள் pepper corn rate (99 வருடத்தில் இருக்கும்) இல் குத்தகையை  நீடிக்க சம்மதிக்க எவரின்  அனுமதி வேண்டும்?  சீனாவின். 

சீனாவுக்கு அம்பாந்தோட்டை உரிமம் நிரந்தரம்.

இதனால் தான், US, கிந்தியா குய்யோ மையோ என்று குத்தி முறிக்கின்றன.

இங்கு வரும் கப்பல்களின் கட்டுப்படுத்தும் அதிகாரம் இலங்கையிடம் இருக்கிறபடியினால் இதில் எந்த மாற்றமும் தேவை இல்லை என்று சீன அறிவித்துள்ளது.

சிங்களம் தன்னிச்சையாக இந்த பேரத்தின் ஒப்பந்தத்தை இரத்து  செய்வதற்கு வழிகள் இல்லை, எந்த பெரு விலையை சிங்களம் கொடுக்க கூடிய நிலையில் இருந்தாலும். 

இதை, ஏற்கனவே பேரத்தின் முக்கிய தரவுகள் சுட்டுகின்றன.

ஏலவே சொன்னது போன்று, சிங்களம் இதை செய்யக் கூடிய (தன்னிச்சையாக இரத்து) அபாயங்களை கூர்ந்து நோக்காமல் சீன இந்த இணக்கப்பாட்றிற்கு வந்திருக்கும் என்று எண்ணுவதே பிழையான திசையில் சிந்தனை.

கோத்தபாய The Hindu க்கு வழங்கிய செவ்வியில் இவ்வாறு கூறியிருந்தார்.

With our control they can do anything, but these 99-year lease agreements [that the previous government signed] will have an impact on our future.”

சீனா அதை வைத்தே காரணம் கூறி விட்டது போல.

நான் முன்னர் reuteurs இல் வாசிக்கும் போது 85% சீனா, 15% இலங்கை, 50.7% இலங்கை, 49.3% சீனா என்று தான் வாசித்தேன்.

அதன்படி 70% சீனா, 30% இலங்கை என. (அண்ணளவாக).

இதில் இவ்வாறு உள்ளது.

இன்னொரு ஊடகத்தில் வாசித்தேன், 10 வருடங்களின் பின் இலங்கை கைக்கு இன்னும் 20% வரும் என.

ஒரு நாட்டில் ஒரு அரசு கைச்சாத்திட்ட ஒப்பந்தத்தை அந்த நாட்டின் அடுத்த அரசு மதிக்கும் பொழுதுதான் அந்த நாட்டில் வர்த்த ரீதியாக நம்பிக்கை வளரும். 

ஆனால், சீனாவும் சரி சிங்களமும் சரி அவ்வாறு மதித்து நடப்பதில்லை. 

இராசபக்சே சகோக்கள் தென் கிழக்கு ஆசியாவில் அரசியல் பலம் மட்டுமல்ல பொருளாதார வலிமையும் கொண்டவர்கள். இவர்களின் மொத்த சொத்து 16 பில்லியன்கள் அமெரிக்க டாலர்கள் வரை உள்ளது என கூறுபவர்களும் உள்ளார்கள். எனவே, சீன அரசு 'சம்திங்' கொடுத்து  இராசபக்சே சகோக்களை சமாளித்துவிடும்.

போர்த்துக்கேயர், ஒல்லாந்தர் ஆயுத முனையில் கைப்பற்றினார்கள். சீனா பொருளாதாரத்தை பயன்படுத்தி கைப்பற்றுகிறது.

முதலாவது தடுக்க முடியாதது. இரண்டாவது தவிர்க்க கூடியது, ஆனால் இலங்கை தவிர்க்கவில்லை.

இலங்கையின் பிரச்சினை சீனாவிடம் பெறும் கடனல்ல. இலங்கையின் 55 பில்லியன் டொலர் கடனில் சீனாவினது 6 பில்லியன் டொலர்.

ஏனைய இடங்களிலிருந்து பெறும் கடன்களை இலங்கை மீள செலுத்துவதில் கடினப்படுவதால், சீன கடனையாவது குத்தகைக்கு கொடுத்து செலுத்த நினைக்கிறது அல்லது சீனாவுக்கு குத்தகைக்கு வழங்கி அதன் மூலம் கிடைக்கும் பணத்தை வைத்து ஏனைய கடனை செலுத்துகிறது.

கடனை செலுத்துவதற்காகவே கடன் வாங்கும் நிலையில் இலங்கை உள்ள போது வேறு எதை எதிர்பார்க்க முடியும்?

அம்பாந்தோட்டையில், சொறி லங்கா கடற்படை நியமிக்கப்பட்டுள்ளதாகவே HIPS பகிரங்கமாக சொல்கிறது.

Security

The port is well secured with our own security personnel who are augmented by personnel from the Sri Lanka Navy and the Sri Lanka Police. The port is ISPS compliant and the Designated Authority is the Sri Lanka Navy.

Seaward security is entirely handled by the Sri Lanka Navy with regular Sea patrols being carried out. Regular Audits of the Port Security is carried out by the Sri Lanka Navy to ensure the Port security is adequate and up to date.

சிங்களம் உண்மையான சுட்டிகளை சொல்லலாம்,  அது யதார்த்தத்தில் எவ்வாறு நடைமுறைப்படுத்தப்படும் என்பதில் தங்கி உள்ளது.

ஆனால், அம்பாந்தோட்டையில், சிங்களம் உண்மையான சுட்டிகளை வெளியிடவில்லை. மற்றும், ஒப்பந்தத்தில் இருக்கும் வேறு சரத்துக்கள் சிங்களத்தின் பிடியை இன்னும் குறைக்கலாம்.

இந்த நிலைமையே கடனிலும், அதாவது headline figures சரியாக இருக்கிறது. ஆனால் அவை அனைத்தும் booked loans இற்கான headline figures.

இதுவும் ஓர் கரணம், சிங்களம் இறைமையுள்ள சர்வதேச பிணைமுறியினால் பணம் ஈட்ட முடியாமல் இருப்பதற்கு. அதாவது நம்பிக்கை இல்லை.

முன்னர் இன்னொரு திரியிலும் எழுதியிருந்தேன், தம்மிடம் பாதுகாப்பு உள்ளது என காட்ட காலியிலிருந்த கடற்படைத்தளத்தை அம்பாந்தோட்டைக்கு மாற்றியிருந்தார்கள் என.

ஏற்கனவே அமெரிக்க போர்க்கப்பல் அம்பாந்தோட்டை துறைமுகத்துக்கு வந்து இலங்கை கடற்படைக்கு பயிற்சியும் வழங்கியிருந்தது.

Hambantota port deal signed; minority stake for SLPA in both new companies

The Concession Agreement for the controversial Rs. 193 billion Hambantota Port, the legally binding document for what is being promoted as a public-private partnership, was signed yesterday.

The event at the Ports and Shipping Ministry was telecast live over the UNP-controlled state run Independent Television Network (ITN). Ministry Secretary L.P. Jayampathy and Sri Lanka Ports Authority (SLPA) Chairman Parakrama Dissanayake signed on behalf of the Government while Vice Chairman Bai Jingtao signed for China Merchants Port Holdings Company Ltd.

The highlight of the Agreement is the setting up of two separate companies – HIPG (Hambantota International Port Group (Pvt.) Ltd.),  which will oversee commercial operations and HIPS (Hambantota International Port Services (Pvt.) Ltd) to oversee Common User Facilities (CUF), including security operations.

In the port operator company HIPG, CMPort (the Chinese company) will have a majority stake (85%) and the SLPA will have a minority stake (15%). The CUF Company – HIPS, the SLPA will have 42% and the HIPG 58% of the stake. Thus, the SLPA is a minority shareholder in both these companies.

After last Tuesday’s Cabinet meeting where Minister Samarasinghe’s memorandum was approved, a news release was issued on Wednesday. Both the Minister’s memorandum and the news release create the understanding that the SLPA has the majority stakes in HIPS. It states the SLPA will have 50.7 percent of the shares and CMPort 49.3 percent.

Corporate Analysts, however, pointed out, that the SLPA’s 50.7 per cent is made up of 8.7 percent stake in HIPS shares is not direct, but is represented through HIPG in a convoluted share-structure. The Agreement, which is a legally binding document, states that “initial equity share capital to be comprised of 42% to be held by the SLPA and 58% to be held by the HIPG operator.” The document signed yesterday does not mention SLPA’s 8.7 percent stake to be held separately in HIPS. Instead, it says the HIPG would hold 58% stake in HIPS.

Analysts point out to the widely regarded commercial practice, in a corporate set up, that a majority shareholder decides the policies as well as controls the day-to-day decision making. The CMPort has a controlling stake in the HIPG, so all decisions of HIPG would be the decisions of the CMPort. The minority shareholding becomes irrelevant since they can be voted out.

Among the ministers who attended yesterday’s ceremony were Malik Samarawickrema, Sarath Amunugama, Mangala Samaraweera and Mahinda Samarasinghe. China’s envoy Yi Xianliang was also present.

Minister Samarasinghe claimed that further changes in the Agreement could be made even after yesterday’s signing. He said the document would now go before the Cabinet for endorsement and would be tabled in Parliament thereafter. Earlier, President Maithripala Sirisena had said that the Concession Agreement would be signed only after Parliament debated the deal.

According to the news release issued by the Ministry of Ports and Shipping, the Hambantota Port which began commercial operations in November 2011 has an accumulated loss of Rs. 46.7 billion and that in from January this year it has handled only 10 ships if the car carriers which were forced to unload at the port instead of the Colombo Port are taken off.

The land area that will be gazetted to be leased out to companies wanting to invest around the Hambantota Port will be 1,115 hectares (and not 1,574 hectares), adds the release. The release also states, “The sole responsibility and authority in relation to National Security is with the Government of Sri Lanka).

The agreement would see the setting up of two Sri Lankan companies to carry out operations of the port. They are the Hambantota International Port Services Co. (Pvt) Ltd (HIPS) and Hambantota International Port Group (Pvt) Ltd (HIPG). The SLPA will hold a share of 50.7% and CMHC 49.3% in HIPS while the share allocation of HIPG would be 85% to CMHC and 15% to SLPA. Accordingly all immovable and movable properties will be transferred to these companies. 

The agreed investment value of the deal is USD 1.12 billion. 

Under the new agreement, the sole responsibility and authority in terms of national security will be with the Sri Lankan Government,"

நான் யாழுக்கு இனி வர மாட்டேன். இப்பதிவை பார்த்ததால் இதற்கு மட்டும் பதிலளித்து விட்டு செல்கிறேன்.

2016 இல் சீனா 80% இலங்கை 20% என கூறப்பட்டு 2017 இல் சீனா 70% இலங்கை 30% என மாற்றியிருந்தார்கள்.
