Two men charged with terrorism offences for allegedly supporting Sri Lanka's Tamil Tigers have been granted bail by a Melbourne judge.

Aruran Vinayagamoorthy, 33, of Mt Waverley and Sivarajah Yathavan, 36, of Vermont South, are accused of supporting the Liberation Tigers of Tamil Eelam, or Tamil Tigers.

It is alleged they used the Melbourne-based Tamil Coordination Committee to raise funds for the Tamil Tigers, who have fought a two-decade civil war for an independent state.

Both men are charged with being members of a terror organisation, providing support or resources to a terrorist organisation and making funds available to a terrorist organisation.

On Tuesday, Victorian Supreme Court Judge Justice Bernard Bongiorno granted the pair bail, finding exceptional circumstances existed in each case.

Vinayagamoorthy and Yathava are due to appear in the Melbourne Magistrates' Court on July 24.

Their co-accused Arumugam Rajeevan, 41, of Old Toongabbie, in Sydney's west, is due to apply for bail in Melbourne Magistrates Court later on Tuesday.

இவர்கள் இருவர் தொடர்பான பிணை மனுக்கள் இதற்கு முன்னர் நீதிமன்றத்தினால் நிராகரிக்கப்பட்டிருந்தது.

இதனிடையே சிட்னியில் கடந்த செவ்வாய்க்கிழமை (10.07.07) கைது செய்யப்பட்ட சிட்னி தமிழர் ஒருங்கிணைப்புக் குழுவைச் சேர்ந்த ஆறுமுகம் றஜீவன் தொடர்பான பிணை மனு மீதான விசாரணை தொடர்ந்து நடைபெற்றுக் கொண்டிருக்கின்றது.

இது தொடர்பிலான தீர்ப்பு சில மணி நேரங்களில் அறிவிக்கப்படும் என எதிர்பார்க்கப்படுகின்றது.

Alleged Tamil supporters granted bail

Three men accused of supplying funds to Sri Lanka's Tamil Tigers have been granted bail.

A Supreme Court judge in Melbourne on Tuesday gave bail to Aruran Vinayagamoorthy, 33, of Mt Waverley, and Sivarajah Yathavan, 36, of Vermont South, who are accused of supporting the Liberation Tigers of Tamil Eelam, or Tamil Tigers.

It is alleged they used the Melbourne-based Tamil Coordination Committee to raise funds for the Tamil Tigers, who fought a two-decade civil war for an independent state.

Both men are charged with being members of a terror organisation, providing support or resources to a terrorist organisation and making funds available to a terrorist organisation.

Granting the pair bail, Victorian Supreme Court Judge Justice Bernard Bongiorno found exceptional circumstances existed in each case.

He told the court the Tamil Tigers were not a declared terrorist group in Australia or Sri Lanka.

Justice Bongiorno also said the presumption of innocence should not be abandoned for political expediency.

"It must .. be kept in mind that they are entitled to the presumption of innocence," he said.

"If that principle is abandoned or even modified for political expediency that risks the whole foundation of our criminal justice system."

Vinayagamoorthy and Yathavan are due to appear in the Melbourne Magistrates' Court on July 24.

Their co-accused, Arumugam Rajeevan, 41, of Old Toongabbie in Sydney's west, was also granted bail by chief Melbourne magistrate Ian Gray.

Rajeevan was arrested earlier this month on similar charges to the other two men.

The three have each provided a surety of $100,000 and must report daily to police.

Outside the Melbourne Magistrates' Court, Rajeevan's lawyer Rob Stary told reporters justice had prevailed.

"I'm grateful that we've got an independent judiciary," he said.

"I would hope that the application of these very draconian and repressive laws would occur evenly throughout the community.

"This is the conundrum in the Tamil community. If you charge one person, you may as well charge 30,000 people.

"They all support the humanitarian relief effort and they all support ... the struggle in their homeland against the oppressive circumstances."

Melbourne Tamils bailed on terror charges

Two Melbourne men have been released on bail by a Victorian judge who today warned against political interference in the justice system.

In pointed remarks that follows yesterday's unprecedented move by the Howard Government to detain a Queensland doctor granted bail, Justice Bernard Bongiorno compared the presumption of innocence with political expediency.

Justice Bongiorno said the charges against Aruran Vinayagamoorthy, 33, and Sivarajah Yathavan, 36, were undoubtedly serious, which was why the law required them to show that exceptional circumstances existed to justify bail.

However, Justice Bongiorno added: "But it must also be kept in mind that they are entitled to the full benefit of the presumption of innocence.

"If that principle's abandoned or modified for political expediency, we risk the legal foundation of our whole criminal justice system.

"These men are innocent of these crimes unless and until they are proved beyond reasonable doubt to be guilty."

Men had 'exceptional circumstances'

Defence lawyers Lex Lasry, QC, and Rob Stary argued their clients, who were first interviewed in 2005 but not charged until 18 months later, had shown exceptional circumstances.

They submitted the matters that supported bail included the delay between the first interview and being charged, a delay in finalising the case and ties both men had to Victoria.

Both men were bailed on their own undertaking with a $100,000 surety each and conditions that included not leaving Australia, daily reporting to police and living at permanent addresses.

They are charged with being members of a terror organisation, providing support or resources to a terrorist organisation and making funds available to a terrorist organisation.

Speaking outside court, Mr Stary, in a pointed reference to the Australian Wheat Board (AWB) scandal, posed the rhetorical question to The Age: "Whatever happened to the case in which $300 million was paid to a genocidal, tyrannical and murderous regime that might be regarded as a terrorist organisation... What happened to that prosecution."

The AWB was the subject of a government inquiry after it was revealed the company paid kickbacks to former Iraqi leader Saddam Hussein.

Asked about Justice Bongiorno's comments, Mr Stary said: "We ought to cherish the fact that we have got an independent judiciary that is not swayed by political interference."

Gold Coast doctor Mohamed Haneef was yesterday placed in immigration detention hours after a Brisbane magistrate released him on bail.

Haneef, 27, was arrested on July 2 and held for almost two weeks before being charged on Saturday with "recklessly" supporting a terrorism organisation.

The charge stems from the fact that he gave his mobile phone SIM card to a relative implicated in the British bomb plots before leaving the UK nearly a year ago. He is due to face court again on August 31.

But before he had time to raise the $10,000 surety, Immigration Minister Kevin Andrews had cancelled Haneef's working visa and ordered him into detention while he awaits trial.

Men believed to be Australian citizens

The Crown alleged that both men were connected to a fund-raising organisation in Melbourne called the Tamil Co-ordinating Committee.

Vinayagamoorthy had described himself as a member of the Liberation Tigers of Tamil Eelam (LTTE) when he applied for a protection visa on arriving in Australian in 1996. It is believed both men are now Australian citizens.

Police alleged he bought equipment in Australia similar to that used by the LTTE in Sri Lanka and that money had been moved from his account to Malaysia, en route to Sri Lanka.

The Crown conceded that this alleged money trail was proved by inference, not evidence.

Justice Bongiorno said prosecutor Mark Dean, SC, conceded that LTTE is not declared a terrorist organisation by the Australian Federal Government or in Sri Lanka.

Mr Dean had said the prosecution would call expert evidence from two political scientists on the status of the LTTE.

Justice Bongiorno noted that such evidence was "not without its difficulties" and that the Crown and defence agreed there were serious issues to be dealt with before any trial.

THREE terror suspects have been freed on bail after a Supreme Court judge warned against "political expediency" interfering in the criminal justice system.

And in a further blow to federal authorities, judge Bernard Bongiorno cast doubt on prosecutors being able to convince a jury that the Tamil Tigers was a terrorist organisation.

In what was interpreted by many in the Melbourne courtroom as a thinly veiled attack on the federal Government's decision to use immigration laws to detain Gold Coast doctor Mohamed Haneef after a Brisbane magistrate had freed him on bail, Justice Bongiorno warned that the presumption of innocence must not be abandoned in terrorism cases.

"If that principle is abandoned or even modified for political expediency we risk the whole foundation of our criminal justice system," Justice Bongiorno said in granting bail yesterday to two men alleged to be members of the Liberation Tigers of Tamil Eelam, otherwise known as the Tamil Tigers.

The judge highlighted problems in the Crown case, particularly that the LTTE was not a proscribed terrorist organisation in Australia, and it was no longer classified as such even in Sri Lanka after a truce was brokered in 2002 between the Tamil Tigers and the Government.

Though the Crown had indicated it would call two political scientists to testify at the trial that the LTTE was a terrorist organisation, the judge said such evidence might not be admitted to go before a jury.

It also emerged yesterday that one of three alleged LTTE members awaiting a committal hearing in Melbourne had openly admitted his membership of the separatist group to immigration authorities when applying for a protection visa in 1996.

Aruran Vinayagamoorthy, 33, "frankly declared that he was a member of the LTTE and that was why he had a legitimate fear of his return to Sri Lanka", the court heard.

No objection was raised by authorities on the grounds of character and Mr Vinayagamoorthy was granted bail, Justice Bongiorno said.

Sivarajah Yathavan, 36, was also granted bail by Justice Bongiorno. Later in the Melbourne Magistrates Court, Chief Magistrate Ian Gray granted bail to a third co-accused, Sydney financial planner Arumugam Rajeevan.

The three men are alleged to have been active in raising funds on behalf of the Tamil Co-ordinating Committee, allegedly channelling the money to northern Sri Lanka for terrorist activity.

Mr Vinayagamoorthy was alleged to have bought equipment similar to that used by the LTTE in Sri Lanka, the court heard.

Each of the men are charged with being members of a terrorist organisation, providing support or resources to a terrorist organisation and making funds available to a terrorist organisation.

Justice Bongiorno said yesterday that though the offences were "undoubtedly serious", "it must also be kept in mind that they are entitled to the full presumption of innocence".

"These men are innocent of these crimes unless and until they are proven guilty," Justice Bongiorno said.

Outside court yesterday, the solicitor for Mr Yathavan and Mr Rajeevan, Robert Stary, slammed Australia's "draconian and repressive" terror laws and said all Australian Tamils supported the Tamil Tigers' struggle against "oppressive circumstances" in Sri Lanka. "This is the conundrum in the Tamil community. If you charge one person you may as well charge 30,000 people," Mr Stary said.

The three accused men were released on $100,000 bail surety.

They are required to surrender their passports, report daily to police and appear in the Melbourne Magistrates Court for a committal mention on July 24.

Govt may appeal Tamil Tiger bail ruling

The federal government has taken steps to challenge the granting of bail to three men facing terror-related charges, as a judge warned against political interference in the justice system.

Attorney-General Philip Ruddock on Tuesday asked prosecutors to consider appealing the decision of a court in Melbourne to grant bail to two (two) men charged with supplying funds to Sri Lanka's Tamil Tigers.

Female supporters in the Victorian Supreme Court wept as Aruran Vinayagamoorthy, 33, of Mt Waverley, and Sivarajah Yathavan, 36, of Vermont South, were granted bail on Tuesday by Justice Bernard Bongiorno.

In another court, Victoria's chief magistrate Ian Gray bailed their co-accused Arumugam Rajeevan, 40, of Old Toongabbie in Sydney.

Justice Bongiorno stressed the accused men were entitled to the presumption of innocence.

"If that principle is abandoned or even modified for political expediency that risks the whole foundation of our criminal justice system," he said.

But Mr Ruddock said later while he respected the decisions of judges and the separation of powers, the Supreme Court's decision to grant bail to Vinayagamoorthy and Yathavan may be appealed.

"I have asked the Director of Public Prosecutions to examine whether the decision should be appealed," Mr Ruddock said.

Mr Ruddock's office could not immediately confirm whether an appeal was also being considered in Rajeevan's case.

The latest government move follows its decision on Monday to cancel the visa of Indian terror suspect Mohammed Haneef just hours after he was granted bail in Brisbane, which means he will stay behind bars in immigration detention.

Legal figures have accused the Howard government of undermining the independence of the court system in the Haneef case.

On Tuesday, Rajeevan's lawyer Rob Stary said he was grateful for an independent judiciary and attacked the terror laws under which the three men have been charged.

"I would hope that the application of these very draconian and repressive laws would occur evenly throughout the community," he told reporters outside court.

"This is the conundrum in the Tamil community. If you charge one person, you may as well charge 30,000 people.

"They all support the humanitarian relief effort and they all support ... the struggle in their homeland against the oppressive circumstances."

He said delay was a factor, and he considered a trial starting by the second half of next year to be an optimistic assessment.

There were issues with the crown case, including the admissibility of evidence from at least two political scientists relating to the LTTE, Justice Bongiorno said.

Vinayagamoorthy and Yathavan both had children, jobs and had been cooperative with police, Justice Bongiorno said.

In the Melbourne Magistrates' Court, Mr Gray said he would grant bail to Rajeevan.

Mr Stary told Mr Gray issues existed relating to the strength of evidence likely to be given by Sri Lankan government officials.

The three accused men each provided a $100,000 surety and must report to police daily and not leave Australia.

Vinayagamoorthy and Yathavan are due to face the Melbourne Magistrates' Court for a committal mention on July 24.

Rajeevan is also scheduled to face the same court for a committal mention on August 23.

Justice Bongiorno yesterday granted Aruran Vinayagamoorthy, 33, of Mt Waverley, and Sivarajah Yathavan, 36, of Vermont South, bail after their lawyers argued exceptional circumstances justified their release.

Both men were arrested in May and charged with being members of a terror organisation, providing support or resources to a terrorist organisation and making funds available to a terrorist organisation for their alleged connections to the Liberation Tigers of Tamil Eelam, also known as the Tamil Tigers.

Sitting in the Victorian Supreme Court, Justice Bongiorno said the charges against the men were undoubtedly serious, which was why the law required them to show that exceptional circumstances existed to justify bail.

However, Justice Bongiorno added: "But it must also be kept in mind that they are entitled to the full benefit of the presumption of innocence. If that principle's abandoned or modified for political expediency, we risk the legal foundation of our whole criminal justice system."

"These men are innocent of these crimes unless and until they are proved beyond reasonable doubt to be guilty."

Police allege the men raised money, with a colleague who died earlier this year, for the Tigers through the Tamil Co-ordination Committee and bought equipment similar to that used by the group in military actions in Sri Lanka. Defence lawyers Lex Lasry, QC, and Rob Stary argued that their clients had shown exceptional circumstances, which included the delay between the first interview and being charged, the time delay in finalising the case and ties both men had to Victoria.

Justice Bongiorno said there were serious issues to be dealt with before the trial and that the Crown case was "not without its problems".

His decision later led Chief Magistrate Ian Gray to bail Arumugam Rajeevan — a Sydney accountant arrested last week and accused of funnelling $600,000 to the Tigers. Mr Gray said that in light of Justice Bongiorno's decision, and with the prosecution's consent, he believed Rajeevan had demonstrated exceptional circumstances.

"It's obviously appropriate that I release this man on bail on the same basis as the other two," he told the Melbourne Magistrates Court.

All three men were bailed on their own undertaking with a $100,000 surety each and conditions that included not leaving Australia, daily reporting to police and living at permanent addresses.

Rajeevan, 41, of Old Toongabbie, in Sydney's west, was extradited to Melbourne last week and charged with being a member of a terrorist organisation and financing and providing assets to a terrorist organisation between 2002 and May this year.

It was unclear last night if Mr Ruddock's office was seeking to appeal Mr Gray's decision to release Rajeevan on bail.

Speaking outside court, Mr Stary said that while justice had prevailed for his clients, the charges against them remained a frightening development for the Tamil community. "This is the conundrum in the Tamil community. If you charge one person, you may as well charge 30,000 people," he said.

"They all support the humanitarian relief effort and they all support … the struggle in their homeland against the oppressive circumstances."

ஒரு நல்ல செய்தி. அவுஸ்ரேலியாவில் நீதி இறக்கவில்லை என்பதற்கு இதை விட வேறென்ன சான்று வேண்டும்.

      அந்த 2001 பொங்கலின் மறுநாள் அவனது குரல்வழி வந்த அந்தச் செய்தி. என் உயிர் நாடிகளை இப்போதும் வலிக்கச் செய்கிறது. அது அவனுக்கும் அவனது அவர்களுக்கும் புதிதில்லைத்தான். அது அவர்களின் இலட்சியத்துக்கு இன்னும் வலுச்சேர்க்கும். ஆனால் என்னால் அழாமல் , அதைப்பற்றி எண்ணாமல் , இனிவரும் வருடங்களில் எந்தப் பொங்கலையும் கொண்டாட முடியாதபடி எனக்குள் அவனது குரலும் அவன் தந்த செய்திகளும் ஒலித்துக் கொண்டேயிருக்கும்.

      காதலர் தினத்தை வழக்கமான தமது அரசியல் நிலைபாடுகளை பொறுத்து அணுகும் செயலை பல்வேறு தரப்பினரும் உற்சாகமாக செய்து வருகின்றனர்.கிரீட்டிங் கார்டுகளையும், சாக்லடுகளையும் விற்க அமெரிக்க கம்பனிகள் சதி செய்வதாக கூறி காம்ரேடுகள் இதை எதிர்த்து வருகின்றனர்.அமெரிக்க கலாச்சாரத்தை திணிக்க முயற்சி நடப்பதாக கூறி சிவசேனாவினரும் இதை முழுமூச்சில் எதிர்க்கின்றனர். தமிழ்நாட்டில் பாமக ராமதாஸ் இதை கண்டித்து அறிக்கை விட்டுள்ளார். பாகிஸ்தானிலும், அரபுநாடுகளிலும் இதை எதிர்த்து பத்வாக்கள் பிறப்பிக்கப்பட்டு அதை மீறி இளைஞர்கள் இதை கொண்டாடியதாக செய்திகள் வந்துள்ளன.
