அமெரிக்காவில் ராஜபக்சேக்கு எதிராக வழக்கு பதிவு!

இனப்படுகொலைக்கு எதிரான தமிழர்களின் அமைப்பு (Tamil Against Genocide ) அமெரிக்காவில் ராஜபக்சேக்கு எதிராக வழக்கு பதிவு செய்யப் போவதாக இன்று அறிவித்துள்ளனர். இந்த வழக்கு குற்றவியல் வழக்காக அல்லாமல் சிவில் வழக்காக அமையும் என அறிவித்துள்ளார்கள். பாதிக்கப்பட்டவர்களின் உறவினர்களான மூன்று மனுதாரர்கள் இந்தவழக்கை பதிவு செய்யவுள்ளதாக அவர்கள் வெளியிட்ட ஊடக அறிக்கை தெரிவிக்கின்றது .

இந்த வழக்கு வெற்றி அடையும் பொருட்டு உலகில் வாழும் அனைத்து தமிழ்மக்களின் ஆதரவையும் அவ் வறிக்கை கோரியுள்ளது. Genocide அக்ட (18 USC 1091 ), Warcrimes Act (18 USC2441 ) மற்றும் Torture Act (௧௮ USC 2340A0 ஆகியவற்றின் கீழ் மகிந்தா ராஜபக்சவை கைது செய்யக் கோரி மனுக்களை அனுப்பியும் , தொலைபேசி அழைப்புக்களை மேற்கொண்டும் செயல்படுமாறு மேலும் கேட்கப்பட்டுள்ளது .

அமெரிக்க நீதி திணைக்கள தொலைபேசி இலக்க 2025142000 எனவும் மின்னஞ்ச்சல் தொடர்பு முகவரி askdoj @usdoj .gov எனவும் மேலும் தெரிவிக்கப்பட்டுள்ளது . மேலும் போர்க்குற்றம் தொடர்பான திணைக்களத்தில் 2026475072 என்ற இலக்கத்துடன் தொடர்பு கொண்டு இது தொடர்பான அதிகாரி ஸ்டீபன் இப்ப் இடம் முறையிடுமாறும் கோரப்பட்டுள்ளது .

இந்த நடவடிக்கை வெற்றி பெற்றால் பதவியில் உள்ள அரசு தலைவர்களுக்கான சட்ட பாதுகாப்பு என்பதை மீறி அரசு தலைவர் கைது செய்யப்பட்டார் என சர்வதேச சட்ட முன் உதாரணம் ஏற்படுத்தலாம் என இந்த முயற்சியில் ஈடுபடுவோர் நம்புகின்றனர் . மேலும், 10 நாட்கள் அமெரிக்காவில் தங்க உள்ள ராஜபக்சேயை கைது செய்யக் கோரி உலகெங்கும் உள்ள தமிழர்கள் அமெரிக்கத் தூதுவராலயம் முன் வெகுஜன நடவடிக்கைகளை எடுக்குமாறும் கோரப்பட்டுள்ளது. அமெரிக்கத் தமிழர்கள் வெகுஜன நடவடிக்கை ஒன்றை திங்களன்று ஏற்பாடு செய்வதாகவும் மேலும் அவ்வறிக்கையில் தெரிவிக்கப்பட்டுள்ளது.

Sri Lanka’s President Mahinda Rajapakse is on a private visit to the United States, and is reported to be staying with his brother Dudley Rajapakse in Houston.

TAG is filing a civil action on behalf of three plaintiffs in the Southern District Court of Texas charging Mahinda Rajapakse as liable under the doctrine of command responsibility for

• the Trincomalee killing of 5 students (all nearly 20 years old awaiting University admissions),

• extrajudicial killing of 17 ACF workers, and

• the massacre of 40,000 Tamils in Vanni in 2009,

and asking monetary damages for the plaintiffs, the only possible redress available in a civil action.

This legal action will continue even if Mr Rajapakse finds a quick exit from the U.S. While the civil suit works through the Courts, TAG requests Tamils worldwide to mobilize and jointly bring pressure to the U.S. Justice Department to arrest Rajapakse and file criminal charges under the Genocide Act (18 USC 1091), War Crimes Act (18 USC 2441), and the Torture Act (18 USC 2340A).

Please contact the United States Department of Justice by calling 202 514 2000, ask for Department of Justice, and record your comments urging the Attorney General Eric Holder to investigate Mahinda Rajapaksa. You can also email the request to: askdoj@usdoj.gov.

Please also call the State Department’s Office of War Crimes issues at 202 647 5072 and leave a message for Ambassador-at-Large Stephen Rapp, urging him to take steps to investigate the Sri Lankan President while he is on the US soil.

Organize world-wide protests in front of US embassies pointing out that US is obliged to apprehend, investigate and prosecute Rajapaksas for violating Geneva Convention and Genocide convention.

Talking Points:

- US Ambassador in Colombo, Ambassador Butenis, has acknowledged that Mahinda Rajapakse and his brothers are allegedly responsible for war-crimes.

- Congress enacted Genocide Act to prevent Genocidaires such as Rajapakse to seek safe refuge in the U.S.

Tamils in the U.S. led by the youth groups are organizing a protest in front of the White House on Monday between 11:30 a.m. and 3:00 p.m. Please attend this rally and show your support.
