சித்திரவதை, போர்க்குற்றங்கள், மானிடத்துக்கு எதிரான குற்றங்கள் மற்றும் தமிழ் இனப்படுகொலை புரிந்த சிறீலங்காவின் ஆட்சித்தலைவர் மகிந்தா ராசபக்சே ஐக்கிய அமெரிக்காவுக்கு வருவதை அனுமதிக்கக் கூடாது என நாடுகடந்த தமிழீழ அரசாங்கம் ஐக்கிய அமெரிக்க அரசுக்கு வேண்டுகோள் விடுத்துள்ளது.

ஐக்கிய அமெரிக்க குடிவரவு மற்றும் தேசிய சட்டம் பிரிவு 212(ஏ)(3)(இ)(iii) (� 212(a)(3)(E)(ii) of the INA) "தனியொரு மனிதர் ஐக்கிய அமெரிக்காவுக்கு வெளியில் மனிதப்படுகொலைக்குக் கட்டளையிட்டார், தூண்டினார், துணைபோனார் அல்லது வேறுவிதத்தில் ஈடுபட்டார் எனில் அவர் ஐக்கிய அமெரிக்காவுக்குள் நுழையத் தகுதியற்றவர்" எனக் கூறுகிறது. மேலும் ஐக்கிய அமெரிக்க குடிவரவு மற்றும் தேசிய சட்டம் பிரிவு 212(ஏ)(3)(இ)(iii) (� 212(a)(3)(E)(iii) of the INA) "தனியொரு மனிதர் ஐக்கிய அமெரிக்காவுக்கு வெளியில் மனிதப்படுகொலைக்குக் கட்டளையிட்டார், தூண்டினார், துணைபோனார் அல்லது வேறுவிதத்தில் சித்திரவதையில் ஈடுபட்டார் எனில் அவர் ஐக்கிய அமெரிக்காவுக்குள் நுழையத் தகுதியற்றவர்" எனக் கூறுகிறது.

நாடு கடந்த தமிழீழ அரசாங்கத்தின் வேண்டுகோள் 1987 இல் இடம்பெற்ற ஒரு சம்பவத்தை மேற்கோள் காட்டுகிறது. நாசிகளால் மேற்கொள்ளப்பட்ட அடக்குமுறையில் பங்கேற்றார் என்ற குற்றச்சாட்டின் அடிப்படையில் கேட் வல்தெய்ம் (Kurt Waldheim ) ஐ. நா. நாடுகளின் அமர்வில் கலந்துகொள்ள வந்த போது அவருக்கு அனுமதி மறுக்கப்பட்டது. வல்தெய்ம் 1986 இல் அவுஸ்திரிய நாட்டின் ஆட்சித் தலைவராக தெரிவு செய்யப்பட்டார். அவர் தன்மீதான குற்றச்சாட்டை உறுதியுடன் மறுத்தார்.

இந்த வேண்டுகோள் நா.க.த.அ இன் இனப்படுகொலையை விசாரிக்கும் அமைச்சுக்குப் பொறுப்பான அமைச்சரினால் ஐக்கிய அமெரிக்காவின் தாயக பாதுகாப்புச் செயலர் யெனெட் நாபொலிதானோ (Janet Napolitano) க்கு அனுப்பிவைக்கப்பட்டுள்ள கடிதத்தில் விடப்பட்டுள்ளது.

இந்தக் கடிதம் ஆட்சித்தலைவர் மகிந்த ராசபக்சேயின் கட்டளையின் கீழ் இருக்கும் சிறீலங்கா பாதுகாப்புப் படையினர் இழைத்த முறைகேடுகளை ஆவணப்படுத்திய ஐக்கிய நாடுகளின் வல்லுநர் குழுவின் அறிக்கையில் காணப் பட்ட விபரங்களை கோடிட்டுக் காட்டியது. ஐ. நா. வின் அறிக்கை ஏறத்தாழ 40,000 மக்கள் கொல்லப்பட்டதாகவும் பெண்கள் பாலியல் வன்முறைக்கு உட்படுத்தப்பட்டதாகவும் 140,000 கும் மேற்பட்டோர் கணக்கில் காட்டப்படவில்லை எனக் குற்றம் சாட்டியுள்ளது. ஐ. நா. அறிக்கை இந்த முறைகேடுகள் போர்க்குற்றங்கள், மானிடத்துக்கு எதிரான குற்றங்கள் மற்றும் இனப்படுகொலை குற்றங்களை நிறுவுகிறது என குற்றம்சாட்டியுள்ளது.

இந்தக் கடிதம் இராசதந்திர விலக்களிப்பு என்பது போர்க் குற்றவாளிகள் மற்றும் இனப்படுகொலை மற்றும் மானிடத்துக்கு எதிரான குற்றங்களை இழைத்தவர்களுக்குப் பொருந்தாது என வாதிடுகிறது. தற்போது பதவியில் இருக்கும் சூடான் நாட்டு ஆட்சித்தலைவருக்கு எதிராக அனைத்துலக குற்றவியல் நீதிமன்றம் பிடியாணை விடுத்துள்ளதை எடுத்துக்காட்டாகக் குறிப்பிடுகிறது. இராசதந்திர விலக்களிப்பு இனப்படுகொலை இழைத்தவர்களுக்குப் பொருந்தாது என்பதை இத்தாலிய நீதிமன்றம் Ferrini v. Federal Republic of Germany, 11-03-2004 - Corte di Cassazione: Sentenza No. 5044 என்ற வழக்கில் தீர்ப்பளித்துள்ளது.

சிறீலங்கா தீவில் நீதியும் பொறுப்பும் தோன்றவேண்டும் என ஐக்கிய அமெரிக்கா எடுக்கும் முயற்சிகள் ஐக்கிய அமெரிக்காவுக்கு வருவது, குறிப்பாக . ஐ. நா. வல்லுநர் குழு அறிக்கை வெளியிடப்பட்டுள்ள வேளையில் வருவது, அந்த முயற்சிகளுக்கு ஊறுவிழைவிப்பதாக இருக்கும் என அக் கடிதம் கூறுகிறது.

US Urged to Deny Sri Lanka President Entry

Transnational Government of Tamil Eelam (TGTE) citing § 212(a)(3)(E)(ii) and § 212(a)(3)(E)(iii) of the US Immigration and Nationality Act appealed to the United States Government to not to allow Sri Lanka President Mahinda Rajapakse to visit the United States for committing torture, war crimes, crimes against humanity and genocide against the Tamil people.

The appeal also cites an earlier incident in 1987, when United States denied entry to Kurt Waldheim to attend the United Nations on the ground that he participated in Nazi sponsored persecution. Waldheim, who was elected president of Austria in 1986, had staunchly denied any wrong doing.

This appeal was made in a letter to US Secretary of Homeland Security Janet Napolitano by TGTE's Minister for the Investigation of Genocide, War Crimes and Crimes Against Humanity DeLuxon Morris.

That letter highlighted the details of the United Nations Panel report which documented abuses by the Sri Lanka Security forces, under the command of President Mahinda Rajapakse. UN Report alleged that around 40,000 people and women were sexually assaulted and more than140,000 people are unaccounted for. It further alleged that these abuses constitutes War Crimes, Crimes Against Humanity and Genocide.

The letter argues that the diplomatic immunity did not extend to covering war criminals and those committed genocide and crimes against humanity. It cites the International Criminal Court's arrest warrant issued against the sitting president of Sudan and the 2008 Italian court decision Ferrini v. Federal Republic of Germany, 11-03-2004 - Corte di Cassazione: Sentenza No. 5044 denying diplomatic immunity for perpetrators of genocide.

The letter states that Mr. Mahinda Rajapaksa's presence in the United States, especially after the publication of the U.N. Report, adversely affects the United States' efforts to see that justice and accountability emerge in the island of Sri Lanka. It concludes that his presence in the U.S. is an affront to the ideals and values on which this Nation stands.
