Featured Replies

‘LTTE ban just to gag Eelam supporters’

CHENNAI: The ban on LTTE was aimed at silencing those who criticised the injustice done to Tamils in Sri Lanka, argued those in favour of lifting the ban in the city on Tuesday.

The comment was made at a public hearing organised by the one-man Unlawful Activities (Prevention) Tribunal at the Tamil Nadu State Judicial Academy. The situation here was tense as advocates, Q-branch police and leaders of organisations supporting the Eelam cause gathered in large numbers. Justice Vikramajit Sen held the hearing.

Counsels representing the government as well LTTE supporters argued their cases referring to legal tomes, while the overcautious Q-branch police initially prevented journalists from attending the hearing. Only after journalists pointed out that it was a ‘public hearing’ and Justice Sen gave permission, the media was allowed inside the hall.

Among those present at the hearing were Tamil Nationalist Movement (TNM) leader P Nedumaran and MDMK leader Vaiko. N Chandrasekaran, representing TNM, pleaded that the organisation be treated as an aggrieved party, as its members had suffered because of their support to the LTTE. He also pointed out that the Tamil Nadu government had banned the TNM on the same ground.

Contesting Chandrasekaran’s argument, Additional Solicitor General A S Chandiyok, representing the Central government, said the TNM should seek justice in the Madras High Court, where the matter is sub-judice, instead of seeking justice from the tribunal.

However, Chandrasekaran justified his claim saying, “The government is using the ban to silence the supporters of LTTE. We can seek removal of the ban on the Tamil Nationalist Movement in the High Court only if the ban on the LTTE is removed.”

Tamil Nadu People’s Rights Forum counsel M Radhakrishnan questioned the very conception of the Centre’s ban on the LTTE. He argued against the extension of the ban on the LTTE, saying that no remnants of LTTE activity remained in Tamil Nadu.

He added that the government had played with the word ‘Tamils’ in its notification of the ban. He claimed the government had tried to portray the LTTE as fighting for a separate homeland for all Tamils. He pointed out that in fact, the LTTE was fighting for a homeland only for Sri Lankan Tamils.

When Chandiyok wondered how a human rights organisation could support a ‘terrorist outfit’, Radhakrishnan rebutted it, saying that the very notion of ‘terrorist’ was arguable and added that the forum had only been supporting the cause of Eelam Tamils.

When MDMK chief Vaiko requested the tribunal to allow him to represent his case, Justice Sen said he would observe Vaiko’s arguments once the evidence had been collected and the proceedings done with.

After hearing the arguments, Justice Sen reserved the orders. Another round of public hearings will be held in Ooty on October 20.

Vaiko later told reporters that while the Central and State governments were trying to prevent supporters of the Eelam cause from exposing the government injustice done to them, he hoped the tribunal would play a positive role in lifting the ban and thereby allowing members of civil society to express their views on the issue.
