சிறிலங்கா அதிபர் மகிந்த ராஜபக்சவுக்கு வொசிங்டன் டிசியில் உள்ள அமெரிக்க சமஷ்டி நீதிமன்றம் அழைப்பாணை பிறப்பித்துள்ளது.

ஹேக் உடன்பாட்டின் கீழ் வொசிங்டன் டிசி நீதிமன்றத்தில் தாக்கல் செய்யப்பட்ட மூன்று குடியியல் வழக்குகள் தொடர்பாகவே, சிறிலங்கா அதிபருக்கு அழைப்பாணை பிறப்பிக்கப்பட்டுள்ளது.

சட்டத்துக்குப் புறம்பான படுகொலைகள் தொடர்பாக நட்டஈடு கோரி சித்திரவதைகளினால் பாதிக்கப்படுவோரைப் பாதுகாக்கும் அமெரிக்கச் சட்டத்தின் கீழ் இந்த வழக்குகள் தாக்கல் செய்யப்பட்டுள்ளன.

சித்திரவதைகளினால் பாதிக்கப்படுவோரைப் பாதுகாக்கும் அமெரிக்கச் சட்டம் மீறப்பட்டுள்ளது தொடர்பான சிறிலங்கா அதிபர் மகிந்த மகிந்த ராஜபக்ச மீது ஆறு குற்றச்சாட்டுகள் முன்வைக்கப்பட்டுள்ளன.

இந்தக் குற்றச்செயல்களுக்காக, மூன்று வெவ்வேறு சம்பவங்களில் கொல்லப்பட்டவர்களின் உறவினர்கள் சிறிலங்கா அதிபரிடம் 30 மில்லியன் அமெரிக்க டொலர் நஷ்டஈடு கோரி, இந்த வழக்குகளைத் தாக்கல் செய்துள்ளனர்.

ஹேக் உடன்பாட்டில் அமெரிக்காவும் சிறிலங்காவும் கையெழுத்திட்டுள்ள நிலையில், இந்த உடன்பாட்டுக்கு அமைய, மகிந்த ராஜபக்சவுக்கான அழைப்பாணை சிறிலங்கா நீதியமைச்சின் செயலாளருக்கு அனுப்பப்பட்டுள்ளது.

மாணவர் ரஜிஹர் மனோகரன், பிரேமாஸ் ஆனந்தராஜா, ரி.தவராஜா ஆகியோரின் உறவினர்களே இந்த வழக்குகளைத் தாக்கல் செய்திருந்தனர்.

இந்த மூவரும் நீதிக்குப் புறம்பான வகையில் சிறிலங்காப் படையினரால் படுகொலை செய்யப்பட்டதாகவும், சிறிலங்காவின் முப்படைகளினதும் பிரதம தளபதி என்ற வகையில் மகிந்த ராஜபக்சவே இவற்றுக்குப் பொறுப்பேற்க வேண்டும் என்றும் உறவினர்கள் கூறியுள்ளனர்.

ரஜிஹர் மனோகரனின் தந்தை காசிப்பிள்ளை மனோகரன், பிரேமாஸ் ஆனந்தராஜாவின் மனைவி கலைச்செல்வி லவன், மற்றும் ரி.தேவராஜா குடும்பத்தினரின் உறவினரான ஜெயகுமார் ஐயாத்துரை ஆகியோர் இந்த வழக்குகளைத் தாக்கல் செய்துள்ளனர்.

ரஜிஹர் மனோகரன் என்ற மாணவன் திருகோணமலை நகரில் கடந்த 2006ம் ஆண்டு ஜனவரி மாதம் சிறிலங்காப் படையினரால் சுட்டுக்கொல்லப்பட்ட 5 மாணவர்களில் ஒருவராவார்.

ஆனந்தராஜா 2006 ஜூன் மாதம் மூதூரில் கொல்லப்பட்ட அக்சன் பெய்ம் உதவி நிறுவனத்தின் பணியாளர்கள் 17 பேரில் ஒருவராவார்.

ரி.தேவராஜா குடும்பத்தைச் சேர்ந்த நால்வர் இறுதிக்கட்டப் போரின் போது மோதல் தவிர்ப்பு வலயத்திலிருந்த பதுங்கு குழியொன்றில் வீழ்ந்த எறிகணையினால் கொல்லப்பட்டனர்.

Govt. says not ruffled by decision

A United States Federal Court has issued summons on President Mahinda Rajapaksa in connection with three civil cases filed under the Hague Convention claiming monetary damages under US Torture Victims Protection Act (TVPA) over alleged extra-judicial killings, the Justice Ministry sources said.

Sources said the government was not overly ruffled by this decision, and would not respond to it.

The civil cases against the Sri Lankan President were filed in Washington DC and the petitioners were seeking US$30 million as damages on six counts of violating the TVPA.

The summons on the President have been served on the Justice Ministry Secretary who is the Sri Lankan Central Authority in accordance with the provisions of The Hague Convention, to which the US and Sri Lanka are signatories.

The three cases were filed by the relatives of students Ragihar Manoharan, Premas Anandarajah, a humanitarian aid worker for Action against Hunger and T. Thavaraja. The petitioners claimed the students were victims of the extra judicial killings in Sri Lanka. They have cited President Mahinda Rajapaksa who is the Commander–in-Chief of Sri Lankan armed forces as the respondent.

The petitioners have alleged multiple violations of the TVPA under Sri Lankan President Rajapaksa’s command responsibility for the extrajudicial killing of plaintiff Dr. Kasippillai Manoharan’s son Ragihar, plaintiff Kalaiselvi Lavan’s husband Premas Anandarajah, and four members of the Thevarajah family, who were relatives of plaintiff Jeyakumar Aiyathurai.Ragihar was one of the five students allegedly killed in January 2006 while Anandarajah was one of the 17 Action Against Hunger (ACF) staff members who were killed during the war in the East in June 2006. Jeyakumar's relatives were allegedly killed by an exploding shell that landed inside the safety bunker -- situated around the No Fire Zone demarcated by the government during the last phases of the war -- where the family was hiding from the artillery attacks by the Sri Lankan Army.

Under International Law, cases can be filed on the offences under war crimes, genocide, crimes against humanity and waging war against countries without reasonable cause.

The petitioners will argue the cases on the basis that universal jurisdiction under international law should also be recognized in civil suits founded on the Torture Victims Protection Act outlining torture or extrajudicial killings.

Hague summons reaches Rajapakse for US Court case

Sri Lanka’s local media reported that the Sri Lanka Justice Department has received the summons filed in connection with the Monoharan et al v. Rajapaksa (Civil Action No. 11-235(CKK) under the Hague Convention. This notification and demonstrated failure of Mr Rajapakse to answer the complaint will allow the Court to proceed to the next step in proposing a last resort attempt at service by publication or to move to consider a default judgment, plaintiffs’ attorney Bruce Fein told TamilNet.

If the plaintiffs succeed in convincing the District Court of District of Columbia’s Judge Colleen Kollar−Kotelly the the Court has personal jurisdiction over Mahinda Rajapakse then that will clear the way for the Court to issue a default judgement Mr. Fein told TamilNet.

The default judgement would force Rajapakse to provide a monetary award closer to $30M.

“In terms of our own law, we don’t have to respond to such summons,” Justice Ministry Secretary Suhada Gamlath told the Sunday Times. He said the Sri Lankan statute -- the Mutual Assistance in Civil and Commercial Matters Act No 39 of 2000 -- had laid down that the country need not heed such summons, “if we consider that the execution of the request will be prejudicial to the sovereignty of Sri Lanka.”

Bruce Fein, a former deputy Associate Attorney General of the United States and now counsel for the Tamil lobby in the US, first filed a complaint in the District Court of the Southern District of Texas. This was when President Rajapaksa was on a private visit to Texas. Later the case was transferred to the District Court in the District of Columbia.

“We have informed the District Court of the Southern District of Columbia of our legal position,” Mr. Gamlath added. External Affairs Ministry officials said yesterday the Court action had been planned purely to embarrass President Rajapaksa and the Government of Sri Lanka. “There is an internationally accepted convention that the heads of state enjoy sovereign immunity. Therefore, any move to stop him from visiting the United States would be futile,” a senior official said.

President Rajapaksa is expected to visit New York in September this year for the United Nations General Assembly sessions.
