ஐ.நா. மனித உரிமைகள் மாநாட்டில் சிறிலங்கா அரசுக்கு எதிராக கண்டனத் தீர்மானம்.

தமிழ் மக்களுக்கு எதிராக சிறிலங்கா அரசு மேற்கொண்டு வரும் இராணுவத் தாக்குதல்கள், பொருளாதாரத் தடை மற்றும் பட்டினி அவலங்களைக் கண்டித்து ஜெனீவாவில் நடைபெறும் ஐ.நா. மனித உரிமைகள் மாநாட்டில் சிறிலங்காவுக்கு எதிராக கண்டன தீர்மானம் நிறைவேற்றப்பட்டுள்ளது.

இன்று புதன்கிழமை நடைபெற்ற இந்த மாநாட்டில் சிறிலங்கா அரசுக்கு எதிராக காரசாரமான விவாதங்கள் இடம்பெற்றன.

ஐப்பான், நியூசிலாந்து, சுவிற்சர்லாந்து ஆகிய நாடுகளின் பிரதிநிதிகள் சிறிலங்கா அரசு தமிழ் மக்கள் மீது புரிந்து வரும் மனித உரிமை மீறல்கள் குறித்த ஆதாரங்களை முன்வைத்தனர்.

தமிழ் மக்களின் கோரிக்கைகள் ஏற்றுக்கொள்ளப்பட வேண்டும். அவர்கள் உரிமைகளுடன் வாழ்வதற்கு சர்வதேச சமூகம் மதிப்பளிக்க வேண்டும் என்று தெரிவித்த அவர்கள், இரும்புச் சிறைக்குள் தமிழ் மக்களை சிறிலங்கா வைத்திருக்கின்றது எனக் குற்றம் சாட்டியுள்ளனர்.

இந்த மனித அவலத்திலிருந்து தமிழ் மக்களை மீட்க வேண்டும் என்று மாநாட்டில் அந்த நாடுகளின் பிரதிநிதிகள் கோரிக்கை விடுத்தனர்.

விவாதத்தின் போது பிரித்தானியாவும் இந்தியாவும் சிறிலங்கா அரசுக்கு சார்பாக வாதிட்டுப் பேசியிருந்தமை குறிப்பிடத்தக்கது.

விவாதத்தின் போது சிறிலங்கா அரசுக்கு சார்பாகப் பேசிய பிரித்தானிய நாட்டுப் பிரிதிநிதி, விடுதலைப் புலிகளுக்கு எதிரான கருத்தை முன்வைத்தார். அவரின் கருத்தை மறுத்துப் பேசிய சுவிற்சர்லாந்தின் ஐ.நா. பிரதிநிதி, தமது தரப்பு நியாயங்களை முன்வைத்தார். பின்னர் பிரித்தானியப் பிரதிநிதியின் கருத்து நிராகரிக்கப்பட்டு, சுவிற்சர்லாந்துப் பிரதிநிதியின் கருத்து ஏற்றுக்கொள்ளப்பட்டது.

அடுத்து பேசிய நியூசிலாந்து நாட்டுப் பிரதிநிதி, தமிழ் மக்கள் ஒடுக்கப்பட்ட இனமாக இருக்கின்ற போதும் அவர்கள் உறுதி குலையாதவர்களாக இருப்பதாகவும் அவர்களுக்கு மனித உரிமைகள் என்ற அடிப்படையில் அவர்களின் வாழ்வாதாரப் பிரச்சனைகளுக்கு சர்வதேச சமூகம் தீர்வை முன்வைக்க வேண்டும் என்ற கோரிக்கையை முன்வைத்தார்.

இதனையடுத்து ஜப்பானியப் பிரதிநிதி தமிழ் மக்களின் நியாயமான குரல்கள் ஏற்றுக் கொள்ளப்பட வேண்டும் என்றும் இதற்கான முழு உத்தரவாதத்தை சிறிலங்கா அரசு வழங்க வேண்டும் என்றும் வேண்டுகோள் விடுத்தார். இதனை ஏற்கா விட்டால் சிறிலங்கா அரசு மீது பாரிய பொருளாதாரத்தடையை ஜப்பான் கொண்டு வர நேரிடும் என்ற எச்சரிக்கையையும் ஜப்பானியப் பிரதிநிதி விடுத்தார்.

விவாதத்தில் சிறிலங்கா அரச தரப்பினர் தமது தரப்பு வாதங்களை முன்வைத்த போதும் அவர்கள் தரப்பு வாதங்கள் கருத்தில் எடுத்துக்கொள்ளப்படவில்லை.

அடுத்த வருடம் ஐக்கிய நாடுகள் மனித உரிமைகள் பேரவையில் சிறீலங்கா அரசாங்கம் தமிழ்மக்கள் மீது மேற்கொள்ளும் மனிதஉரிமை மீறல்களுக்கு எதிராக, கொண்டுவரும் தீர்மானம் குறித்த முன்மொழிவுகள் மேற்கொள்ளப்பட்டன.

இன்று காலை 10.00 மணிக்கு ஐக்கிய நாடுகள் மனித உரிமைகள் பேரவையில் உயர் ஆணையாளர் லூயிஸ் ஆர்பர் தலைமையில் நேபாளம், வங்கதேசம், சிறீலங்கா, சூடான், ஈராக் ஆகிய நாடுகளில் நிகழும் உரிமை மீறல்கள் குறித்த விவாதங்கள் இடம்பெற்றன. இதன்போது ஐரோப்பிய ஒன்றியத்தின் தலைமைத்துவ நாடான பின்லாந்தின் நிரந்தர தூதுவரால் சிறீலங்கா அரசாங்கம் நிகழ்த்தும் மனித உரிமைமீறல்கள் குறித்து கண்டித்து உரை நிகழ்த்தப்பட்டது. இதேபோன்றே சுவிற்ஸர்லாந்து, ஐப்பான், நியூசிலாந்து ஆகிய நாடுகளும் சிறிலங்கா அரசின் அப்பட்டமான மனித உரிமை மீறல்கள் குறித்து நேரடியாக குற்றம் சுமத்தியுள்ளார்கள்.

இதனை ஆட்சேபித்து பிரித்தானிய - இந்திய தூதவர்கள் கருத்து வெளியிட்டதை அடுத்து கடுமையான கருத்து பரிமாற்றம் நிகழ்ந்ததாக அறியமுடிகிறது.

Human Rights Council on recent activities

Following is the statement delivered by Louise Arbour, United Nations High Commissioner for Human Rights, at the opening of the third session of the Human Rights Council:

"I am very pleased to offer you today an overview of the missions that I have undertaken since the second session of the Human Rights Council, as well as updates and thoughts on countries and themes that continue to engage our attention and our work.

In Sri Lanka, my Office has actively provided advice to the Government on the terms of reference for the Commission of Inquiry into killings and disappearances and on the role of the International Independent Group of Eminent Persons that will observe its investigations. I am pleased to note the fruitful cooperation between the Government and my Office with regard to this initiative and I welcome the incorporation of the majority of OHCHR's suggestions into the terms of reference. I hope that the Commission of Inquiry will prove effective in bringing the perpetrators of serious human rights violations to justice. I would also like to reiterate my Office's readiness to assist the Government of Sri Lanka in addressing the protection of human rights and in particular the protection of civilians, who have continued to be the primary victims of recent violence. VESA HIMANEN (Finland), speaking on behalf of the European Union, said that the European Union welcomed this interactive dialogue with the High Commissioner for Human Rights as it was meaningful to conduct a discussion on relevant human rights issues. The European Union welcomed the recent cease-fire adopted in the Middle East, but it continued to express concern over the human rights situation in the area. It called for an immediate cessation of hostilities and for the parties in the conflict to return to the negotiating table. The European Union appreciated the work of the High Commissioner in reporting and keeping the Council up-to-date on the situation in the Middle East. With reference to Darfur, the European Union asked the High Commissioner for her comments on how to bring to justice all those responsible for atrocities there. In addition, the European Union expressed deep concern over the human rights situation in Sri Lanka, and called for addressing the question of impunity promptly.

ICHIRO FUJISAKI (Japan) said Japan endorsed the message of the UN Secretary-General and the issues he had dealt with. With regard to the High Commissioner’s statement, in which she referred to the situation in the Occupied Palestinian Territories, Japan was concerned about the human rights situation in the Middle East. Japan supported a peaceful settlement of the conflict based on a two-State solution. Japan was also contributing to the peaceful settlement of the conflict in Darfur. In Sri Lanka, Japan had taken note that an inquiry commission was set up to investigate the killings and disappearances of persons, and that the Government was cooperating with the Office of the High Commissioner. In Nepal, as the High Commissioner stated, the situation had been positively evolving following the signing of the comprehensive peace agreement between the Government and the Maoist Movement.

BLAISE GODET (Switzerland) said Switzerland remained very concerned over the human rights situation in Sudan, and called upon all parties involved in the conflict to abide by international law, in particular humanitarian law. It also called for the protection of humanitarian personnel, and for the conduct of peaceful negotiations. Switzerland called on all parties to restart negotiations, and find a political solution to the conflict there. Switzerland asked the United Nations High Commissioner for Human Rights on how she considered strengthening her monitoring of the human rights situation in Darfur.

With reference to Sri Lanka, Switzerland called for transparency in the work of the Commission of Inquiry recently established. It asked the United Nations High Commissioner how she thought this Commission would cooperate with the work of the High Commissioner. Switzerland also expressed concern over the situation of child soldiers in Sri Lanka and asked the High Commissioner whether she would undertake some actions on this matter before the issuing of the report of the Special Rapporteur on this issue.

PAUL MEYER (Canada) said Canada was alarmed by continued human rights violations in Darfur and called for an end to these practices. The culture of impunity should be halted. The civilian population in Darfur had been suffering from the conflict. The Council should be guided by the Secretary-General views of the situation in Darfur. The ongoing recruitment of children in Sri Lanka was also a concern to Canada. The Government of Sri Lanka should ensure the protection of civilians and unhindered access by intenternational humanitarian organizations. The establishment of the inquiry commission was a good sign. In Haiti, Canada expressed concern about the continued human rights violations. In order to uphold human rights and the establishment of the rule of law, Canada had accorded financial assistance to Haiti. With regard to Israel and the occupied Palestinian territories, Canada believed that Israel had the right to defend itself from the rockets that were being launched by the Palestinians. The rights of the Palestinians should also be respected by Israel. Canada was in favour of a peaceful settlement of the situation.

NICHOLAS THORNE (United Kingdom) said the United Kingdom remained deeply concerned over the situation of human rights in Sri Lanka. It noted with satisfaction the establishment of the Commission of Inquiry that would investigate alleged violations of human rights. With reference to the situation in the Middle East, the United Kingdom welcomed the cease-fire between Israel and Palestine. It hoped the ceasefire would provide the opportunity to resume negotiations and attain a two-state solution.

SARALA FERNANDO (Sri Lanka) said that like other Member States, Sri Lanka had faced the brunt of terrorism since many years and had always been committed to the protection of human rights while combating terrorism. It was in this context that Sri Lanka informed the Human Rights Council of progress made in the establishment of the Commission of inquiry on 3 November by the President of Sri Lanka to inquire and investigate into a number of alleged serious violations of human rights which had occurred since 1 August 2005.

On issues of humanitarian access, Sri Lanka continued to provide essential supplies by its own efforts to all people affected by the conflict. A Consultative Committee on Humanitarian Assistance had been established where the Government and all stakeholders, including the United Nations and the ICRC, met regularly to address any outstanding issues. Sri Lanka had also recently proposed the creation of safe heavens for internally displaced persons in Vakarai to prevent sad incidents such as at Kathiraveli, which arose when the LTTE used innocent civilians as human shields.

புலம் பெயர்ந்த நாம், வெருமனே இங்கு கறுத்துக்களை கூராது முடிந்தளவு எமக்காக குரல்கொடுத்த யாவருக்கும் நன்றிசொல்லி மேலும் அவர்கள் தடர்ந்தும் எமக்காக செயல்பட உற்சாகமளிக்க வேண்டும். அத்துடம் எமக்கு விரோதமாக செயற்படாவர்களுக்கு நாம் எமது கடும் கண்டனத்தையும் தெரிவித்துக்கொள்ள வேண்டும். இங்கு இந்தக் கறுத்துக் களத்தில் நாம் ஒருவிதமாக செயட்பட்டாலும். கண்டனங்களை தெரிவித்துக் கொள்ளும் போது -மிகவும் நாகரீகமாகவும் நடந்து கொள்ள வேண்டும். அபபடி இல்லாவிட்டால் அந்த கண்டனங்கள் செயற்படமாட்டாது.
