Sri Lankan born Kiwi girl takes GSK to court

SYDNEY: In a modern day David and Goliath story, two New Zealand science students have embarrassed one of the biggest pharmaceutical companies, GlaxoSmithKline (GSK), with just a school science project.

Anna Devathasan and Jenny Suo have proved that the black current drink, Ribena, which made claims of having 7mg of Vitamin C per 100ml, in fact had no detectable Vitamin C content. GSK, the maker of Ribena, has been fined AUD 2,17,500 after admitting it mislead customers about the vitamin C content of the blackcurrant drink. The company appeared in Auckland District Court in late March to face charges alleging 15 breaches of the Fair Trading Act.

Sri Lanka-born Devathasan and Suo decided in mid-2004 to test the vitamin C levels of some juices, including Ribena, Just Juice and Arano, for a school project. “We were playing around and just stumbled upon it,” Devathasan told ABC news. “We chose our topic by chance. We did everything by chance and suddenly it just came up.”

The syrup based fruit drink has been around in one form or another for 70 years, its nutritional and health claims unchallenged until now. TV advertisements for the drink claimed ‘the blackcurrants in Ribena have four times the vitamin C of oranges’. Their experiments showed that each 100ml of Ribena contained about 22mg of vitamin C, while competitive brands contained levels of about 72mg.

The girls first took their observations to GSK in a letter describing its advertising as ‘intentionally misleading and quite inappropriate’. “We sent them a letter and an email and they never replied. So a little while later we called,” Devathasan told ABC news. “They didn’t really answer our question,” recollects Suo. “They kind of didn’t take us very seriously, because we were 14 at the time. We were really little,”

The girls contacted the Advertising Standards Authority, but still got no satisfaction. But then the television consumer affairs show, Fair Go picked up the story and suggested the girls take their findings to the Commerce Commission. The commission said that although blackcurrants had more vitamin C than oranges, this was not true of Ribena. It also alleged that Ribena contained no detectable level of vitamin C.

Besides the fine, the court also ordered GSK to place half-page corrective advertisements in various newspapers. Anticipating action in Australia, GSK Australia reported itself to the Australian Competition and Consumer Commission, and agreed to correcting its labelling and cease making the Vitamin C claims.

“I love it. Every time I see the new Ribena ad, the one where they don’t mention any Vitamin C, I’m just, like, ‘Oh, yeah, that’s me’,” says Devathasan.
