Tamil, Muslim party leaders call for end to forced detention

Five Tamil and Muslim party leaders in a joint communique issued Wednesday stated that "the forcible detention of hundreds of thousands of Tamil citizens of Sri Lanka in camps for Internally Displaced Persons is illegal, without basis in the Constitution and in gross violation of international human rights norms," and called for immediate action to "end to military administration and restrictions placed on civilians, and we urge the restoration of full civilian administration to facilitate return to economic and social normality."

Let Our People Free!

The Tamil speaking peoples of Sri Lanka have suffered great hardships for many decades since Independence. They have faced discrimination and had to suffer ethnic riots, pogroms and ethnic cleansing; in the pogrom in 1983 sections of the state were involved. In the last thirty four years Sri Lanka was consumed by an ethnic civil war in which the Tamil and Muslim people and others in the North and East and elsewhere were victims. The Tamils in particular bore the brunt of the suffering. During the last stages of the war the people of the Vanni suffered traumatic pain which, despite the conclusive end of the war, has still not abated. While we are deeply concerned about the human rights violations everywhere in our island such as death threats, the killing of civilians, and the disappearance of journalists and others, we feel the need to prioritise in this communiqué such collective and unbearable pain of large numbers of our population as compels immediate intervention.

We the undersigned affirm the following and call for an immediate end to these intolerable conditions, and in particular:

We state that the forcible detention of hundreds of thousands of Tamil citizens of Sri Lanka in camps for Internally Displaced Persons is illegal, without basis in the Constitution and in gross violation of international human rights norms.

These people should be released immediately to return to their homes and permitted to resume without hindrance their traditional livelihood activities such as farming and fishing, or to take up residence with friends and relatives, or to exercise their lawful right to abode elsewhere at their discretion. Those likely to face criminal charges should be produced in a court of law without further delay.

We strongly urge that the camps, for so long as they exist, should be open to relatives, religious functionaries, parliamentarians, provincial councillors, civil society, UN agencies, journalists, and national and international aid and humanitarian organisations.

We urge that immediate arrangements be made to allow the Muslim people who were evicted from the North and have suffered acute hardships for nearly two decades to return to their homes and to resume their economic and social activities without hindrance.

Similar arrangements must be made to re-settle in their original homes all those in the East, who remain displaced and continue to suffer greatly.

The restrictions on movement in and out of the Northern Province and some locations in the East should be lifted and the need for permits to enter or leave should be rescinded forthwith. In particular, any form of quarantine of the Northern Province is a violation of basic rights and should be lifted.

The curfew and other restrictions on normality in many parts of the Northern Province and elsewhere are unjustified and we demand that normality be returned without delay. People in certain parts of the country live in fear, avoid even essential travel, and are inhibited in employment related and social activities.

We call for an end to military administration and restrictions placed on civilians, and we urge the restoration of full civilian administration to facilitate return to economic and social normality.

இலங்கை சுதந்திரமடைந்த நாளிலிருந்து தமிழ் பேசும் மக்கள் பல தசாப்தங்களாக கொடுந்துயரை அனுபவித்து வருகிறார்கள். அவர்கள் இனப்பாகுபாட்டையும் இனவன்முறையையும், இனச்சுத்திகரிப்பையும் எதிர்கொண்டு வருகிறார்கள். 1983 இனப்படுகொலையின் போது அரசாங்கத்தின் ஒரு பகுதியினரும் அதில் ஈடுபட்டிருந்தனர். இனப்படுகொலைகளாலும், கடந்த 34 வருடங்களாக இலங்கை இனரீதியான உள்நாட்டு யுத்தத்தால் வடக்கு கிழக்கில் வாழ்ந்த தமிழ் மற்றும் முஸ்லிம் மக்களும் ஏனையோரும் இன்னும் நாட்டின் ஏனைய பகுதி மக்களும்கூட பலி கொள்ளப்பட்டுள்ளனர். குறிப்பாகத் தமிழ் மக்கள் இத்தகைய துன்பத்தால் பெருமளவுக்குச் சலிப்படைந்துள்ளனர். போரின் இறுதிக்கட்டத்தில் வன்னி மக்கள் எல்லையற்ற துன்பத்தை அனுபவித்துள்ளார்கள். போர் முடிவடைந்துள்ள இந்த நிலையிலும் கூட அவர்களுடைய துன்பம் இன்னமும் தீரவில்லை.

நாட்டில் எங்கும் இடம்பெறும் மனித உரிமை மீறல்கள், மரண அச்சுறுத்தல்கள், பொதுமக்கள் படுகொலைகள், ஊடகவியலாளர்களும் மற்றையவர்களும் காணாமல் போதல் என்பவற்றுக்கு மத்தியில் நாம் இந்த இடம் பெயர்ந்து முகாம்களில் தடுத்து வைக்கப்பட்டுள் ளமக்கள் தொடர்பாக உடனடியாகவும் நாமனைவரும் கூட்டாகவும் முன்னுரிமை கொடுத்து செயற்பட வெண்டும் என்று கருதுகிறோம்.

இதன் கீழ் ஒப்பமிட்டுள்ள நாமனைவரும் சகித்துக்கொள்ளமுடியாத இந்நிலைமையினை உடனடியாக முடிவுக்குக் கொண்டு வர வேண்டும் என்று கேட்டுக் கொள்கிறோம்.

நாட்டினுள்ளே இடம் பெயர்ந்துள்ள இலட்சக்கணக்கான தமிழ் மக்கள் அரசமைப்புக்கு முரணாக சர்வதேச மனித உரிமை சட்டங்களை மீறி பலவந்தமாக தடுத்து வைக்கப்பட்டுள்ளமை சட்டவிரோதமானது என்று சுட்டிக்காட்ட விரும்புகிறோம்.

இம்மக்கள் உடனடியாக அம்முகாம்களிலிருந்து விடுவிக்கப்பட்டு அவர்களது வீடுகளுக்குச் செல்ல அனுமதிக்கப்பட வேண்டும். அத்தோடு அவர்கள் தங்களது பாரம்பரிய தொழில்களான விவசாயம் மற்றும் மீன்பிடி போன்றவற்றில் ஈடுபட எத்தகைய தடையுமின்றி அனுமதிக்கப்பட வேண்டும். அல்லது அவர்கள் தமது உறவினர் நண்பர்களது வீடுகளுக்குச் செல்ல அனுமதிக்கபடல் வேண்டும். அல்லது அவர்கள் தமது சட்டபூர்வமான உரிமையைப் பயன்படுத்தி தாங்கள் விரும்பிய இடத்திற்குச் செல்ல அனுமதிக்கப்படல் வேண்டும். இவர்களில் குற்றவியல் நடவடிக்கைகளில் ஈடுபட்டதான குற்றச்சாட்டை எதிர்நோக்குபவர்கள் எவ்விதத் தாமதமுமின்றி நீதிமன்றின் முன்னால் நிறுத்தப்பட வேண்டும்.

இடம் பெயர்ந்த மக்கள் நீண்ட நாட்களாகத் தடுத்து வைக்கப்பட்டிருக்கும் அம் முகாம்களுக்கு உறவினர்கள், மதகுருமார், நாடாளுமன்ற உறுப்பினர்கள், மாகாண உறுப்பினர்கள், சிவில்சமூகத்தினர், ஐநா நிறுவனங்கள், ஊடகவியலாளர்கள், உள்நாட்டு மற்றும் வெளிநாட்டு அரசசார்பற்ற நிறுவனங்கள் செல்வதற்கு அனுமதிக்கப்பட வேண்டும் என்று நாம் உறுதியாகக் கோருகிறோம்.

வடக்கிலிருந்து வெளியேற்றப்பட்டு கடந்த இரண்டு தசாப்தங்களாக கடும் துன்பங்கழைள எதிர்கொண்டு வரும் முஸ்லிம்மக்கள் அவர்களது சொந்த இடங்களுக்குத் திரும்பிச் செல்ல அனுமதிக்கப்படுவதோடு அங்கு அவர்கள் தமது பொருளாதார சமூகவாழ்வை எவ்வித இடையூறுமின்றி வாழ வழிசெய்யப்பட வேண்டும் என்று கேட்டுக் கொள்கிறோம்.

இதேபோன்ற நடவடிக்கை கிழக்கிலும் இடம் பெயர்ந்து கடுந்துயரை அனுபவித்த மக்களுக்கு மேற்கொள்ளப்படல் வேண்டும்.

வடக்கிற்கும் கிழக்கின் சில பகுதிகளுக்கும் நடைமுறைப்படுத்தப்படும் நடமாடும் சுதந்திரத்திற்கான கட்டப்பாடு தளர்த்தப்படல் வேண்டும். குறிப்பாக வட மாகாணத்தில் அடிப்படை உரிமை மீறல் நடவடிக்கைகள் விலக்கப்படல் வேண்டும்.

வடமாகாணத்தின் பல பகுதிகளில் ஊரடங்குச்சட்டமும் பல்வேறு கட்டுப்பாடுகளும் அமுல்படுத்தப்படுவது நியாயப்படுத்தப்பட முடியாதனவாகவுமிருப்பதால் அங்கு எவ்வித தாமதமுமின்றி உடனடியாக இயல்பு வாழ்க்கை ஏற்படுத்தப்படல் வேண்டும்.

நாட்டின் சில பகுதிகளில் வாழும் மக்கள் இன்னமும் அச்சத்துடனேயே வாழ்கிறார்கள். அவசரமான விடயங்களுக்குக் கூட அவர்கள் செல்வதில்லை. இதனால் சமூக செயல்பாடுகள் தொடர்பான பணிகள் கூட தடைப்பட்டுள்ளன.

இராணுவ நிர்வாகம் உடனடியாக முடிவுக்குக் கொண்டு வரப்படல் வேண்டும் மக்கள் மீது சுமத்தப்பட்டுள்ள கட்டுப்பாடுகள் தளர்த்தப்பட வேண்டும். சமூக பொருளாதார இயல்பு வாழ்வு மீளத்திரும்பும் வகையில் சிவில் நிர்வாகம் மீளமைக்கப்படல் வேண்டும்.

இதேவேளை ஏனைய தமிழ்க் கட்சிகளிடமும் இந்த அறிக்கையில் கையொப்பமிட முயற்சிகள் மேற்கொள்ளப்பட்ட போதிலும் அக்ட்சிகளின் முக்கியஸ்த்தர்கள் தயக்கத்துடன் கையொப்பமிடுவதனைத் தவிர்த்துக்கொண்டதாக தகவல்கள் வெளியாகி உள்ளன.
