Today’s report by HRW has reiterated the fact that Sri Lanka has long enjoyed impunity. Until we bring the accountability and justice, any meaningful peace would remain elusive in the island. While it is encouraging to see many nations continue to stress for an independent inquiry that meets international standards, Sri Lanka has largely avoided such calls. Many believe it is the UN that now should take concrete measures within its mandate to move this agenda forward with meaningful steps.

We owe this to many in Sri Lanka who continues to feel insecure as climate of fear persists. We simply cannot let this continue.

Subject: Pictures of burned surrendees, mediated by UN et all

Leading into May 2009, the world led by Norway assured that surrendering to the Sri Lankan armed forces will bring a 'peaceful end'. And Tamils were skeptical given the history and nature of the Sri Lankan government towards Tamils. Since May 2009 a large amount of evidence has been emerged that leaves no doubt that Sri Lanka committed war crimes and crimes against humanity. And in today, pictures of tortured and burned bodies of Mr.P.Nadesan and Mr.Pulithevan who are most familiar to Norway have emerged.

It does not make any sense Tamils to continue to trust the Sri Lankan government who are continuing to ride on chauvinism of 'Mahavamsa'.

The betrayal to Tamils in Sri Lanka can only be ended by letting Tamils to decide their own fate, Independence from Sri Lanka. Anything else can only be interpreted as blessing to continued genocide of Tamils.

Subject : “100 most influential Persons of 2011”

I am one of those who took part in the above mentioned poll. But, I am deeply disappointed to see that Mr. Rajabakse not only made the list, but did influence to rank in the first five. Like many other dictators, this democratically elected leader, Mr.Rajabakse too has taken all measures to revamp his tarnished image. He found this poll as a saviour.

There are mounting evidence against Mr. Rajabakse who could only be compared with Nazi regime. This was reaffirmed by a report released by the secretary general of UN where Rajabakse had been accused of committing crimes against humanity and war crimes. Simply a person with that resume should be only on one list, a list of war criminals!

There is no point in trying to hide facts about crimes committed against innocent Tamils by the Sri Lankan government. It is all been well documented by UN and all the opportunities to bring peace and justice to Tamils have been wasted. The sad saga of the UN Secretary General (UNSG) promptly passing on the Final Report to the Sri Lankan Government (SLG); the quick ‘leak’ of the Report to non- State media in Colombo and SLG denying responsibility for the leaks; and the manner in which ‘The Island’ media published selected portions pertinent for SLG’s counter offensive, all stand exposed.

The groundwork was laid with ‘The Island’ releasing Part 1 of its “Extracts from the Ban-Ki-moon panel report” series on April 17, 2011. On the very same day, The Island also published the exclusive and exhaustive President Rajapaksa interview: ‘Crushing of Tigers made Lanka safe for children – President’ ( http://www.island.lk/index.php?page_cat=article-details&page=article-details&code_title=23146 )

‘The Island’, when releasing the final Part 6 of its ‘Extracts from the Ban-Ki-moon panel report’ series draws the readers’ attention to what is more in store. (Note: The sections of the Moon panel report that we published from Monday until today, were the findings of the panel relating to four of the five allegations they have made against Sri Lanka. This subject is by no means closed. The discussion will continue next week as well. In the meantime, for further information regarding what has already been published, read POLITICAL WATCH in tomorrow’s Sunday Island.).

And today, surprise! we see in the ‘Sunday Island’s Political Column, filled with deceptive details, reports and arguments, propping SLG’s relentless attempts to sully the UNSG’s Experts Panel findings that implicate the Sri Lankan Government and its Armed Forces: ‘Serious flaws in Ban Ki-moon panel report’ (http://www.island.lk/index.php?page_cat=article-details&page=article-details&code_title=23740) and reiterating SLG stand against UN publishing the Panel Report, and echoed it with Foreign Minister G. L. Perris call in a piece titled: ‘GL to phone Ban to reiterate SL’s position - Strong support for SL from Russia and China” ( http://www.island.lk/index.php?page_cat=article-details&page=article-details&code_title=23750).

Let not UNSG, the UN and the West hold their breath. The Rajapakasa regime is flexing its muscle hoping to mesmerize all who mater and the unsuspecting local and international audience. What with the ‘Million Signature’ petition campaign, against the "biased, flawed” UN Panel Report, being collected at market places and by the Military men, and President Rajapakse personal call for “mass protests against a UN report” on May Day, deploying workers, peasants and captive displaced Tamils languishing in the North& East, none of whom would have foggiest idea of the UN, the panel. Or the Report is, against which SLG is waging the new war. More shows will of course follow from SLG, the Colombo media, agent campaigners et al to fool the UN and the International Community in the future as well.

Our message to SLG should remain the same, "Please cooperate with UN findings and bring justice to all".

2. Shelling of hospitals and humanitarian objects

(a) Common Article 3 of the Geneva Conventions: violation of the duty to "provide care for the sick and the wounded", as enunciated in Common Article 3.

(b) Requirement of special protection to medical and humanitarian personnel and objects : International humanitarian law requires parties to respect and protect all medical personnel, medical units, medical transports, humanitarian relief personnel and humanitarian relief objects (Rules 25, 28, 31 and 32, ICRC Study).

© Ban on attacks on civilians or civilian objects : The attacks on hospitals and humanitarian objects also constitute unlawful attack on civilian objects

(d) Denial of humanitarian assistance : With respect to the obligation to "provide care for the sick and the wounded", in the final stages of the war

(b) Requirements of special protection to medical and humanitarians personnel and objects : SLA shelling, in particular Convoy 11, the United Nations presence near Putumattalan

211. International humanitarian law prohibits starvation as a method of warfare (Rules 53 and 55, ICRC Study).

i) deliberated and publicly underestimated the number of civilians in the Vanni,

(ii) impeded humanitarian convoys and ships

(iii) knowingly shelled in the vicinity of humanitarian actors.

4. Human rights violations suffered by victims and survivors or the conflict international humanitarian law and international human rights law.

(a) Common Article 3 of the Geneva Conventions

With respect to the ban on "outrages upon personal dignity, in particular humiliating and degrading treatment"

(b) Ban on enforced disappearances

215. International humanitarian law prohibits enforced disappearances.

© Requirements of minimal level of treatment for those deprived of liberty provide those detained with adequate food, water, clothing, shelter and medical attention (Rule 118, ICRC Study).

(d) Requirements regarding the dead and the missing take all feasible measures to notify families of the missing of their fate (Rules 112, 113, 115, 116 and 117, ICRC Study).

218. Credible allegations point to a violation of these provisions insofar as they indicate that the Government has not undertaken all practicable efforts to search for dead civilians or combatants.

Dear Mr. Solheim,

Now that UN has released a shocking report in which our worst fears were confirmed, possible war crimes and genocide committed. Despite the assurance by Sri Lanka, when more than 360000 civilians were asked to reach areas under Sri Lanka's control in 2009, the fate of more than 100000 remains unknown. Norway was one of the countries who assured safety which was also betrayed by Sri Lankan authority.

While Sri Lanka continues to dismiss the validity and facts on the report that should not surprise anyone who knows well Sri Lankan leaders. Under these circumstances, Norway should lead a primary role as it did in the past, in brining justice to the victims from Sri Lankan authority. The following options should all be on the table:

- Norway refers this matter to International Criminal Court

- Norway works with others, including India, to bring to the UN Security Council

- Norway should be able to push for independent Tamil state for the safety and security of Tamil civilians

Since from the time, you, the Russian society fought the fascist, you have been our inspirations and moral supporters to lead the determined struggle against the fascist Singhal rulers of Srilanka. Thank you for bringing Sri Lanka to the discussing table of EU, after shocking finding by UN. The finding of reports recommends to seek accountability of those who are directly responsible for some the worst crimes committed in 21st century. These crimes include such as bombing hospitals and denying food and medicine to the dying civilians. The total death toll of all civilians could be at least 40,000!

Sri Lanka, a beneficiary of EU, has so far rejected the finding by UN. I beleieve only political and economic presserues will bring justice and peace with dignity.

Dear Madam,

As You may know, a three member UN panel has released its report where it urges the government to investigate alleged war crimes, committed at the last phases of war. UN has asked for Sri Lanka's cooperation on this matter which Sri Lanka has denied and continues to undermine the importance. During recent visit, Hon.R.Blake, US Assistant Secretary for Asia, has also urged for full cooperation.

Sri Lanka has a long history of appointing its own panels of investigations that have lacked international standards. And in this case, where it is believed at least 40000 civilians lives were killed in violation of international laws, the people deserve a credible investigation in full.

We believe that EU will continue to play a decisive role not only in bringing justice to those who were killed, but to those who left behind to live sans justice. And for the Sri Lankan government, its accountability is paramount in moving forward.

Dear Professor,

After reading your article, posted on Toronto Star (http://www.thestar.com/opinion/editorialopinion/article/992951--sri-lanka-needs-to-write-a-new-story#article), I was forced to write this letter to you.

A United Nations report on Sri Lanka released last month estimates that between 40,000 to 75,000 civilians were killed during the 2009 conflict. The report concluded that although both sides committed violations, the Sri Lankan Armed Forces committed the majority of war crimes and crimes against humanity. The report accused government forces of repeatedly shelling dozens of hospitals, bombing UN food distribution lines, and preventing Red Cross ships from evacuating the wounded.

This marriage of convenience never worked, thanks to Sinhala polity and its core belief in Mahavamsa. Even the educated elite never stood for the rights and justice. In contrary, many try to justify the crimes and that is a real shame!

Despite the war was over two years ago, Tamils are being treated as slaves:

- more than 117888 still need to settled ( http://dailymirror.lk/news/11461-117888-refugees-awaiting-permanent-resettlement-un.html )

- high security zones are in existence with a 40,000 soldiers in Jaffna peninsula alone

- many wives and children do not know whether their loved are alive or not

Today, Canada is fighting against a war criminal to safeguard the civilians in Libya which we both perhaps support. And we as Canadians should demand the same justice in Sri Lanka! Let us join AI, HRW and other organization is seeking justice first.

Sri Lanka has been also keeping a close relationship with Israel.

Title: Ban Sri Lanka's cricket team

Currently, the Sri Lankan cricket team is touring England. While we welcome any country, Sri Lanka is not an ordinary country. The government of Sri Lanka has been accused of committing war crimes and crimes against humanity 2 years ago against its citizens, in the thousands. This has been confirmed by UN who is demanding further investigation whie Sri Lanka has been refusing.

We are a nation of Human Rights defenders and have the Queen as the head of the Commonwealth. Should we allow a cricket team, from a country which kills journalists and NGO's, to play cricket freely without any restrictions? What would that tell others about us?

South Africa was banned for 2 decades for apartheid policy. Previous culture Secretary Andy Burnham managed to prevent Zimbabwe cricket team touring England. I hope we do the right thing again!

We live an era where people, mainly Arabs in Middle East, are making a new revolution to be free. People of Tunisia and Egypt have shown that with will, freedom will come. And your organization has stood with those around the world who seek freedom and justice.

Unfortunately a motion against Sri Lanks for alleged war crimes was blocked by countries like Pakistan and Malaysia despite clear evidence of continued denial of freedom to Tamils. Just like Palestinians, Tamils have long sought for freedom. And note that Sri Lanka today received support from Israel and has given forum to shoot movie based on a story by Salman Rushdie. These are just two examples of how Sri Lanka hoodwinks the Islamic world.

It is never too late to bring justice, justice to Palestinians and Tamils.

When Desmond Tutu gave the Cowdrey lecture in 2008 he said the finest demonstration of the spirit of cricket was England's boycott of South Africa after the D'Oliveira affair. Tutu said that politics impinges on sport as much as on any other aspect of life.

40,000 people have died in Sri Lanka. Morally it is not right to be playing in Sri Lanka and it seems oxymoronic that a Sri Lanka player will now be giving that same lecture. Tutu has also spoken out for the Tamils, describing the "ongoing persecution" as "truly terrifying".

Please say no to Sri Lanka's cricket in UK!

Subject : Rights in Sri Lanka and Germany standing with the people

Sri Lanka has a long record of rights violations despite its record on democracy for well over 60 years. And in recent months peoples' rights, labour rights in particular has been worsening. The labour rights in Sri Lanka have witnessed another set back. The rightful protesters have faced live ammunitions; one life has also been taken away. Very little justice has been done to the victim and more importantly people’s rights have been threatened.

We have to strike the right balance in between commerce and people's rights, so that at the end of the day people's life can be better. And we thank Germany for just doing that.

Supreme Commander of the Allied Forces, General Dwight Eisenhower, found the victims of the death camps and he ordered all possible photographs to be taken, and for the German people from surrounding villages to be ushered through the camps and even made to bury the dead.

He said: "Get it all on record now — get the films — get the witnesses — because somewhere down the road of history some bastard will get up and say that “this never happened.”

Channel 4’s film — Sri Lanka's Killing Fields — goes a long way in meeting his statement. This is now a matter of Sri Lanka’s history. No bastard can deny it. And to that end it should be included in Sri Lanka's school curriculum for all children to read so the cycle of violence crippled that country for decades will not be repeated. In addition, Ratko of Sri Lanka — Rajapakse, should be brought to justice so the reconciliation can begin.

The parallels between the crimes against humanity in Serbia and Sri Lanka are far greater than the differences. In both cases, the evidence abundantly demonstrates that a small clique of extremists planned and organized the bureaucratized elimination of a group planned at various meetings and based on a well-developed, pseudo-ethnic ideology.

It was to be expected in Sri Lanka, of course, where denial and geopolitics diverted attention from the well documented involvement of Sri Lankan government and the military in the ethnic cleansing of Tamils. To be consistent with human history, as usual hereto are deniers of atrocities and this one is no exception.

Tamils told the world, contrary to claims; safe zones are anything but safe. We told the world, contrary to claims, that Sri Lanka had no constitution to protect Tamils. We told the world, that Sri Lanka is a murderous, scurrilous state. We told the world, that the Sri Lankan invasion of Tamils’ homeland would not be the beginning of the end of war, but merely the beginning of end of Tamils in Sri Lanka.

Western governments should not feign surprise when Sri Lankan dictatorial regime that they have tacitly supported committed such reprehensible acts on Tamils and take some blame for Sri Lanka’s unrefined, brutish and phobic behaviour. Mistakenly, the West thought that perhaps Sri Lankan extremism would just go away after the elimination of Tamil Tigers — small-minded bullies like Rajapakse would tire, but the truth is there are not going anywhere.

Unless the West forcefully stands up against state sponsored violence and injustice against Tamils in Sri Lanka, the provocateurs who like to play with matches in the tinderbox of racial and ethnic confrontation will roam free.

But Tamils must not blindly hope that this film will yield justice. Road to justice will be long and an arduous one. Anytime now, with clockwork predictability the useful idiots of Sri Lankan terror apparatus around the globe with overwhelming confidence will deny such a thing ever took place.

The truth is the very opposite. Deniers have no case whatsoever, as all the evidence makes incontrovertibly clear. Channel 4’s documented stories reveal horrifying tales of killings, torture and abuse; of innocent Tamils. Even if it were ever to be proved that it was done to eliminate terrorism — which has never been the case — the fact of war crimes and crimes against humanity remains indisputable.

We know the kind of people who deny the Holocaust. What interest anyone has in denying the suffering of Tamils remains to be discovered.

Sri Lankan state, its proxy killers and apologists cannot explain away Sri Lankan atrocities. Everywhere we turn; there are reminders of the demons that have been unleashed by Sri Lanka in the name of fighting terrorism.

This revolting display has since become a major reference point for many — especially Tamils around the globe. Channel 4 film has shined the light on Sri Lanka’s institutionalized intolerance at its most absurd and most dangerous. Revealing Sri Lanka’s hate and racial feelings against Tamils and presenting the view of sick minds at work.

West must speak up against Sri Lankan savagery and bring the perpetrators to justice. It is the only position that is consistent with its own democratic ideals. Sri Lanka can’t move forward as a democracy unless it addresses its past wrongdoings.

The war turned innocent Tamils into numbers. Now, it is for the West to turn the numbers back into people. If the West can’t do that, then the Sri Lankan tyrants have shaped not only the Tamils’ view of the world, but their humanity itself.

Diaspora Tamils also need to make hard choices and take a symbolic stand against Sri Lanka. We must stop buying Sri Lankan products. We can’t expect much from the world when are wearing Sri Lankan made garments while our stomachs are full of Rajapakse's groceries, tea, and planning a vacation to Sri Lanka — sometimes even on Sri Lankan Airlines. It’s unconscionable. We must put an end to such hypocrisy.

The vibrant, dedicated, resourceful and capable Tamil Diaspora should never forget that Sri Lanka has killed many thousands of our children, and most of them died before they even knew that they were Tamils.

At the moment, for the survivors of the Sri Lankan savagery, it seems there can be no closure, no dignity, and no respect.

Now, we should demand our Nuremberg trials.

Subject : We must not turn away from graphic documentary

Dear Journalist,

Thanks for writing about 'seeking justice' in the aftermath of ground breaking journalism by Channel 4 in the UK. Canada who supported Sri Lanka in the war against Tamil Tigers should work with our allies like the UK in bringing justice where as high as 100000 civilians might have been killed in a matter of a few months.

Further, despite the promises, Sri Lanka has been not only avoiding all the promises it made about a respectful political solution to Tamil minority but continues a rule with an iron fist. That includes denial of basic rights to Tamils and land grabbing. And just yesterday some fifty political party members were beaten denying democratic means.

Like the Channel 4, one would hope one of the Canadian TV network will obtain a copy and telecast the elements of Tamil genocide.
