CC: The Hon. Kevin Rudd MP

Minister for Foreign Affairs

Dear Right Hon. Prime Minister and Hon. Minister for Foreign Affairs;

Reconciliation in post-civil war Sri Lanka is impossible if the country's Government fails to adequately investigate allegations of war crimes committed by its army (SLA) in 2009. Only external pressure can bring a meaningful investigation.

I would like Canadian Prime Minsiter, "I will not as Prime Minister be attending that Commonwealth summit. And I hope that others will take a similar position, but I hope that this will pressure the Sri Lankan government to take the appropriate actions". The Canadian Prime Minister Stephen Harper is also set to boycott the 2013 Commonwealth summit in Sri Lanka if the island state's government does not improve human rights. He also reiterated his position on Sri Lanka's rights situation and supported for an independent investigation into the alleged war crimes committed in Sri Lanka and the UN Expert Panel’s report’s findings and recommendations.

I urge You to exercise diplomatic and other tools to force Sri Lanka to submit to the international investigation on ‘war crimes’ and in finding political solution addressing legitimate grievances of Tamils.

Thank you for once again for your stands on the Sri Lanka's human rights, humanitarian and war crimes issues.

Yours truly,

Subject: On visit to Sri Lanka bring core US values to the forefront

I understand that Congressman Heath Shuler, D-Waynesville, Congressman Jack Kingston, (R-Ga.) and Congressman Ben Chandler, (D-Ky) have gone to Sri Lanka that has been coordinated through the U.S. State Department Mutual Educational and Cultural Exchange Program.

The civil war had its genesis in long-standing Tamil grievances about land, language and political and economic marginalisation. None of these grievances has been addressed by the GOSL (Government of Sri Lanka) since the war and, in fact, in many cases, the problems have worsened significantly. And there is no hope for reconciliation if the GOSL does not agree, in the first instance, to an independent war crimes and human rights violations investigation.

A number of areas of Tamil concern in Sri Lanka's current political situation. These included:

- An on-going massive military presence in traditional Tamil lands in the north and east of Sri Lanka

- Allegations of on-going military violence and rape including the assault of Tamil MPs in June 2011

- The on-going presence of armed militias in the north and east

- Evidence of on-going restrictions on the activities of journalists and human rights defenders and intimidation of critics of the GOSL

- The acquisition of land for military facilities and housing for soldiers and their families.

I hope these important core values of freedom and democracy have been brought to the attention of Sri Lankan officials during the visit.

Subject: Canada Urges UN for an independent investigation in Sri Lanka

The Honorable John Baird,

Minister of Foreign Affairs.

November 02, 2011.

Dear Minister,

Guillermo E. Rishchynski, Canada's Ambassador and Permanent Representative of Canada to the United Nations, in a statement to the Third Committee on the promotion and protection of human rights at United Nations, on October 26, 2011, said, “Canada is also concerned that the underlying sources of conflict in Sri Lanka are not being addressed. As such, we encourage the Government of Sri Lanka to engage constructively on a process of political reconciliation and accountability.” “We also support calls for an independent investigation into credible allegations of violations of international humanitarian law and human rights committed by both parties to the conflict in Sri Lanka, as recommended by the UN Secretary General’s Panel of Experts on Accountability in Sri Lanka.” He further said.

I would like to thank Canada for this statement. But, as our Prime Minister said at the Commonwealth summit in Pert, Australia, "I think it's fair to say that the general tone of the president of Sri Lanka regarding these concerns was reassuring. However, I remain skeptical of some of the reassurances", we all remain suspicious of Sri Lanka. Neither a political solution nor reconciliation process has been presented well in the past two and a half years.

Dear Madam:

My sincere and whole hearted appreciation for Channel 4's News & Current Team for working to produce a follow-up film into Sri Lanka's Killing Fields, Jon Snow's critically-acclaimed investigation into the final weeks of the war between the government and Tamil Tigers in Sri Lanka.

The Sri Lankan government leaderships and military personals are responsible for genocide, torture, and rape of Tamil citizens of the country and crimes that have exceeded the normal parameters of war behavior must be dealt with credible independent international body before Sri Lanka can begin the peace building process of true reconciliation.

The Channel 4 relentlessly working to bring justice to the long victimized Tamil civilians in Sri Lanka and pressing the international community not to offer the accused Sri Lankan government leaderships and military leaderships a chance for forgiveness but offer victims and their families the opportunity to confront those responsible for what happened to them, and hopefully to put the horrors of war behind them.

Your efforts will make the world a better place for all!

Dear Madam/Sir,

We all are anxiously wait SriLanka's Lessons Learnt and Reconciliation Commission (LLRC) report that will shed some light into what the Government's intentions are.

"A widow who gave evidence to the Lessons Learned and Reconciliation Commission (LLRC) is now rattled by the summon given by the Criminal Investigation Department (CID)" - http://www.bbc.co.uk...rcwitness.shtml

In the meantime, one of the widow who gave testimony to LLRC is facing potential threat from the secret forces. Victims protection is very basic and this is why human rights groups were concerned about when it comes to Sri Lanka LLRC. This is why Tamils hesitate and fear to testify with LLRC. This raises the question of legitimacy and credibility of the report.

Subject: Sri Lanka at 'critical point' post-LTTE, says politician

Dear Mr. N. Swamy,

Thanks for this article, and the inteview with Mr.Moragoda.

The rapid growth of China and its flexing military has many nations on the edge. But, no other nation is in direct threat than India as what many call, ‘pearl of strings’ placed around India. In Sri Lanka, China saw and sized the opportunity while India does not have a clear policy after LTTE.

As for the solution to Tamils in Sri Lanka, the Rajapaksa government has the strongest position of any Sri Lankan President ever, but lacks the will. While Mr.Moragoda may not talk about this, the undelying 'hate' towards Tamils is the core reasons for the issue remains unrsolved. Longer the ethnic issues drags, more dangerous the region become.

Re: Just give “peace” a chance in Sri Lanka, Letter Nov. 9

Sri Lanka High Commissioner Chitranganee Wagiswara tries to justify the war crimes by the government against Tamil civilians by asserting that Tamil Tigers were terrorists. She is by implication accepting that war crimes were committed by both Sri Lankan army and the Tamil Tigers. Terrorism by a rebel group cannot justify war crimes by Sri Lankan government on her civilians.

Ms Wagiswara’s description of the Sri Lankan communities as “peace loving” is a cruel joke. The Tamil majority areas of Sri Lanka (Eelam) are under a massive Sinhalese army of occupation, who are harassing and trampling on the rights of the Tamils after the surrender of the Tamil Tigers in May 2009.

Even the provincial governors of the two Tamil provinces are army generals accused of war crimes. Tamil government agents are being replaced by Sinhalese and the government is colonizing Tamil lands by bringing in Sinhalese from the south with army patronage.

Some 300,000 Tamils were forcibly kept like cattle in detention camps and many are still languishing in camps. Mahinda Rajapakse recently passed a law demanding title deeds from the one million Tamils who fled the country.

Foreign reporters are not allowed freely into Tamil provinces, to hide the facts, and only selected writers are allowed. The Sri Lankan government is spending large sums of money to convince the international community that everything is “peaceful” in Sri Lanka. Since independence in 1948, several laws have been enacted by the Sinhalese majority to deny the Tamils voting rights, citizenship rights, language rights, equal education and employment rights.

Sinhalese thugs, police and army organized the slaughter of Tamils and destruction, rape and plunder of Tamil properties all over the island, in 1956, 1958, 1971, 1977, culminating in 1983, forcing mass exodus of Tamils from Sinhalese areas and out of the country. The Tamil youth in desperation took up arms and one such group was LTTE (Tamil Tigers).

Absence of war is not peace for Tamils, who are kidnapped, tortured, humiliated and treated as third-class citizens. We Tamils thank our Prime Minister Stephen Harper for putting his foot down against human rights violations by the Rajapakse government. An injustice anywhere is injustice everywhere.

I have read your interview on Tamilnet ( http://www.tamilnet.com/art.html?catid=79&artid=34636) and would like to thank for enlightening on the subject that is closer to me.

I am a refugee who once left my homeland due to civil war. And yet the war is over, peace has suffered a fatally in the island. The Brits left Sri Lanka under a unitary constitution in 1948 where the minority Tamils have faced genocide since then in the hands of majority Sinhalese. Despite ample evidence the international community has done little to stop and investigate into alleged war crimes and crimes against humanity, placing their commercial/political interests first.

We perhaps need an ‘Asia Spring’ to form real democracy in which all minorities can feel equal and nations can overcome corrupted leaders.

Please continue to raise your voice for justice and better world.

As someone who is concerned in Human Rights, I would like to thank for your comments to the MPs at the Commons foreign affairs committee where You reiterated that Sri Lanka needs to take accountability for serious allegations of war crimes committed during its 25-year civil war. More importantly Sri Lanka failed to show any meaningful attempt to resolve legitimate struggle of Tamils and the regime grows as authoritarian. And the current regime threatens the rights of all citizens, not just Tamils.

Once again thank you for firm stands on Sri Lanka's human rights issues, rule of law, accountability, international investigation on possible 'war crimes' in the last phase of the war in 2009 and pointing out the failure of meaningful attempt at reconciliation with the Tamil minority even after two years of war ended.

Dear Sir,

The world Tamil community joined with Tamil Canadians is very grateful and appreciates the Canadian Foreign Minister, Hon. John Baird’s courage and commitment that he is showing against gross human right violations and genocide being committed by the government of Sri Lanka against its minority Tamils.

We thank you from the bottom of our hearts for your bold statement regarding the LLRC report which is falls far short of human rights violations and crimes against the humanity committed by the Sri Lankan government. The LLRC report dismisses any notion of a ‘systematic’, ‘persecution’ of Tamil civilians by Sri Lanka’s armed forces and the ‘deliberate’ targeting of civilian establishments – key assertions made by the UN expert panel.

For the war crimes, the defence secretary, Gotabaya Rajapaksa, the then head of the army, General Sarath Fonseka, and the commander in chief – the president – Mahinda Rajapaksa are principally answerable. It’s fruitless to ask the war criminals to investigate their own war crimes.

What is needed urgently is an International Independent investigation into the gross human right violations and genocide being committed by the government of Sri Lanka till then Canada and other like minded democratic countries should impose sanctions as the one initiated by Canada against South African Apartheid Regime on December 20th, 1977.

We also earnestly request Canada to lobby for support to pass a resolution for an International Independent investigation in the next United Nations Human rights Council meeting which is schedule to take place on March 2012.

Thank you once again.

Dear Avaaz,

I am a supporter of a Human Rights campaigning group that focuses on Sri Lanka and is known as ACT NOW: Stop Human Rights abuses in Sri Lanka. It was formed in the latter part of 2008 by, amongst others, a number of NGO's that had worked and seen with their own eyes the treatment metered out to civilians by the armed forces. They were particularly concerned about the casualties that civilians were suffering in an increasingly bloody conflict between Tamil rebels and Government forces that had re-erupted in 2008.

This war in Sri Lanka continued to its' bitter end in May 2009 but eversince there have been allegations that War Crimes and Crimes against Humanity were committed against Tamil civilians. The calls for an Independent International investigation became so strong that last year the UN Secretary General Ban Ki Moon even commissioned a report from a special UN Advisory Panel. Their report concluded that there was plenty of evidence to suggest war crimes and crimes against humanity had taken place, but that an Independent Investigation was required to take matters forward (see http://www.un.org/Ne...Report_Full.pdf).

Dear Rt. Hon. Prime Minister Amama Mbabazi,

Sri Lanka's Minister of Foreign Affairs paid a last minute visit to secure support that would prolong the agony of Tamil minority that has suffered one of the brutal civil war. That particular war has claimed at least 40,000 innocent lives according UN. Thus, the international community had given Sri Lanka ample time to investigate within its legal frame work.

And yet according many reputable organizations, Sri Lanka has not only done to prosecute those who might have committed war crimes, but the continued impunity has diminished hopes for peace.

Countries like Uganda should send a clear and present message to those states including Sri Lanka that only true investigations can lead to peace and subsequently lead into prosperity for all of us.
