அனைத்துலக குற்றவியல் நீதி மன்றினை அங்கீகரிப்பது தொடர்பாக நா. த. அரசாங்க நாடாளுமன்றில் விவாதம்

அனைத்துலக குற்றவியல் நீதி மன்றினை அங்கீகரிப்பது பற்றிய மசோதாவினை நாடு கடந்த தமிழீழ அரசாங்க ( நா. த.அர) நாடாளுமன்றம் விவாதத்திற்கு எடுத்துக்கொண்டுள்ளது. அனைத்துலக குற்றவியல் நீதிமன்றினை நிறுவும் உரோம் சட்ட ஆணையினை அங்கீகரிப்பதற்கான இந்த மசோதாவினை சண் சுந்தர், ஜெய் ஜெயலிங்கம் எனும் இரு நா. த.அரச நாடாளுமன்ற உறுப்பினர்கள் அவையில் சமர்ப்பித்தனர்.

சரித்திர முக்கியத்துவம் வாய்ந்த இந்த உடன்படிக்கையினை அங்கீகரிப்பதன் மூலம் நாடு கடந்த தமிழீழ அரசாங்கம் ( நா. த.அர) தன்னை அனைத்துலக மட்டத்தில் நல்லதோர் பொறுப்பு வாய்ந்த அமைப்பாக வெளிக்கொணர்வதுடன், அனைத்துலக நீதி மன்றின் முக்கியத்தையும் வலியுறுத்தி நிற்கின்றது. சிறிலங்கா அரசானது இந்த உடன்படிக்கையினை அங்கீகரிக்கவில்லை என்பது இங்கு கவனிக்கத் தக்கது. சிறிலங்கா அரசினால் இழைக்கப்பட்ட போர்க் குற்றங்கள், இனஅழிப்பு, மானுடத்திற்கெதிரான குற்றங்கள் என்பவற்றின் அடிப்படையில் தமிழீழ மக்களைப் பொறுத்த வரையில் இந்த உடன்படிக்கையானது மிகவும் முக்கியம் வாய்ந்ததொன்றகும்.

இந்த உடன்படிக்கையினை அங்கீகரிப்பதன் மூலம் நாடு கடந்த தமிழீழ அரசாங்கம் ( நா. த.அர) தமிழீழத்தில் அனைத்துலக குற்றவியல் நீதிமன்றின் சட்ட ஆணையினை ஏற்றுக் கொள்ளுகின்றது என்பதனைத் தெரிவித்துக் கொள்ளுகின்றோம்.

தற்பொழுது நா. த. அரசாங்கமானது சிறிலங்காவின் அரசியல், இராணுவத் தலைவர்களை, அவர்கள் தமிழ் மக்களுக்கு எதிராக இழைத்த போர்க்குற்றங்கள், இனஅழிப்பு, மானுடத்துக்கு எதிரான குற்றங்கள் என்பவற்றுக்காக நீதியின் முன் நிறுத்துவதற்கான முன்னெடுப்பின் தொடர்பானதோர் செயற்பாடாக கையெழுத்துக்கள் சேகரிக்கின்ற முயற்சியில் ஈடுபட்டுள்ளது. அத்துடன், சிறிலங்கா அரசாங்கம் ஐநாவிற்கு எதிராக மேற் கொள்ளும் பரப்புரையினை முறியடிப்பதற்கான பல முன்னெடுப்புக்களையும் நா.க.த. அரசாங்கம் மேற் கொண்டுவருகின்றது.

சிறிலங்காவினை அனைத்துலக குற்றவியல் நீதி மன்ற வழக்குத் தொடுனர் மூலம் சர்வ தேச விசாரனைக்கு உட்படுத்தும் நடவடிக்கைகளை ஆரம்பிக்க வேண்டும் என ஐநா செயலாளர் நாயகத்தினையும் ஐநா பாதுகாப்புச் சபையினையும், மற்றும் உலகத் தலைவர்களையும் இத்தால் வேண்டுகின்றோம்.

அனைத்துலக குற்றவியல் நீதி மன்றமானது போர்க்குற்றங்கள், இனஅழிப்பு, மானுடத்துக்கு எதிரான குற்றங்கள் புரிந்தவர்களை நீதியின் முன் நிறுத்தி விசாரனைக்கு உட்படுத்துவதற்கான அனைத்துலக மட்டத்தில் இயங்கும் நிரந்தர நீதி மன்றமாகும். இந்த உடன்படிக்கையினை 2011 ஆம் ஆண்டு சித்திரை மாதம் வரையில் 114 நாடுகள் அங்கீகரித்துள்ளன. ஆயினும், சிறிலங்கா நாடு இதுவரையில் இந்த உடன்படிக்கையினை அங்கீகரிக்கவில்லை. அனைத்துல குற்றவியல் நீதி மன்றமானது உலகில் இதுவரையில் போர்க்குற்றங்கள், இனஅழிப்பு, மானுடத்துக்கு எதிரான குற்றங்கள் என்பன தொடர்பாக ஆறு நீதி விசாரணைகளை தொடங்கி நடாத்தி வருகின்றது.

இவற்றில், அரச தலைவர் ஒருவர் மீது, அதாவது சூடான் ஜனாதிபதி பசீர் மீது குற்றப் பத்திரிகை தாக்கல் செயப்பட்டுள்ளதுடன் கைதாணையும் பிறப்பிக்கப்படுள்ளது. சூடான் அதிபரைத் தொடர்ந்து, சிறிலங்கா அதிபர் மஹிந்த இராசபக்சவும் போர்க்குற்றங்கள்,

இனஅழிப்பு, மானுடத்துக்கு எதிரான குற்றங்கள் தொடர்பாக அனைத்துலக குற்றவியல் நீதி மன்றில் விசாரணைக்கு உட்படுத்தப்படும் சாத்தியம் உள்ளது.

TGTE Parliament Debates Ratification of International Criminal Court

The Parliament of the Transnational Government of Tamil Eelam (TGTE) started debating a Bill calling for the ratification of International Criminal Court (ICC). The Bill - Ratification of the Rome Statute establishing the International Criminal Court - was tabled by two TGTE Members of Parliament. Sri Lanka did not ratify this treaty. By ratifying this treaty TGTE is accepting ICC’s jurisdiction in Tamil Eelam.

The Parliament of the Transnational Government of Tamil Eelam (TGTE) started debating a Bill calling for the ratification of International Criminal Court (ICC), said the Speaker of TGTE, Mr. Pon Balarajan. The Bill - Ratification of the Rome Statute establishing the International Criminal Court - was tabled by two TGTE Members of Parliament Shan Sunder and Jey Jeyalingam, he continued.

By ratifying this treaty, TGTE is taking an important step of becoming a responsible member of the international community and is emphasizing the importance of ICC, said the Speaker. It should be noted that Sri Lanka did not ratify this treaty and this treaty is most relevant to Tamil Eelam citizens due to genocide, war crimes and crimes against humanity that were committed against them by the Sri Lankan state, he continued.

By ratifying this treaty TGTE is accepting ICC’s jurisdiction in Tamil Eelam, said the Speaker.

TGTE is reaching out to the United Nations Secretary General, UN Security Council members and several world leaders to refer Sri Lanka to ICC prosecutor and to initiate an international investigation on Sri Lanka, said the Speaker.

TGTE is currently involved in an international signature campaign to hold Sri Lanka’s political and military leaders to face charges for committing genocide, war crimes and crimes against humanity against Tamil civilians and it is taking steps to counter Sri Lankan Government's anti UN propaganda, said the Speaker.

The International Criminal Court (ICC) is a permanent international court to prosecute individuals who committed genocide, war crimes and crimes against humanity, and as of April 2011, 114 states have ratified this treaty, said the Speaker. Sri Lanka did not ratify this treaty and to date; the ICC has opened investigation in six cases around the world where war crimes, crimes against humanity or genocide have taken place, he continued.

One head of state, President Bashier of Sudan, have been at charged at the ICC and an *arrest warrant was issued, said the Speaker. Given the recent **UN report on Sri Lanka there is a possibility that Sri Lankan President Rajapakse will follow Sudan President’s foot steps in facing charges at the International Criminal Court for committing genocide, war crimes and Crimes against humanity against Tamil civilians, he continued.

Transnational Government of Tamil Eelam is a democratically elected government of the Tamil diaspora. It held elections in twelve countries and elected Members of Parliament (MPs). These MP's drafted and adopted a Constitution, elected a Prime Minister, Speaker and a ten member Cabinet.
