Canada Condemns Judicial Interference by Sri Lankan Parliament, Urges Commonwealth Action

January 11, 2013 - Foreign Affairs Minister John Baird today issued the following statement:

 

“Canada is deeply concerned over the impeachment of Sri Lankan Chief Justice Shirani Bandaranayake.

“Her impeachment appears to be highly politicized, lacking basic transparency and respect for the guarantees of due process and fair trial.

 

“Judicial independence is fundamental to the rule of law and essential for any democratic and accountable government. Canada calls on the Government of Sri Lanka to change course immediately.

 

“Canada continues to have serious concerns about the human rights situation, the need for reconciliation and the democratic deficit in Sri Lanka. Canada will continue to raise these concerns forcefully, without equivocation.

“Canada has been among the world’s leading proponents of reform in Sri Lanka. In recent months, Ministers and other parliamentarians have visited to assess the situation on the ground first-hand.

 

“Canada has strongly supported resolutions at both the United Nations and the Commonwealth condemning the Sri Lankan government’s lack of action on reconciliation and the country’s disturbing slide in human rights. Canada is pushing for this latest troubling development to be addressed at the next meeting of the Commonwealth Ministerial Action Group (CMAG), of which Minister Baird is a member.”

STATEMENT BY NDP FOREIGN AFFAIRS CRITIC PAUL DEWAR ON THE IMPEACHMENT OF SRI LANKAN CHIEF JUSTICE SHIRANI BANDARANAYAKE

 

The Official Opposition unreservedly condemns the recent impeachment of Sri Lankan Chief Justice Shirani Bandaranayake as a politically motivated attack on judicial independance and human rights.


This indefensible act has unfortunately demonstrated that the Sri Lankan government is not committed to improving the respect and realization of human rights. We strongly urge the Canadian government to now state unequivocally that Canada will not attend this October’s Commonwealth Heads of Government Meeting (CHOGM).

 

The Sri Lankan government has consistently attempted to undermine judicial integrity and independence. Chief Justice Bandaranayke was impeached in a process that lacked basic transparency and is widely considered to be retribution for making decisions that displeased the government. New Democrats stand in solidarity with Chief Justice Bandaranayke and people of conscience around the world in calling on the Sri Lankan government to demonstrate a commitment to honour and uphold values of good governance and respect for human rights.


We urge Commonwealth members to step up action to condemn this attack on judicial independence. International diplomatic pressure must focus on the implementation of the recommendations of the Secretary-General’s Panel of Experts on Sri Lanka, which found credible allegations of war crimes and crimes against humanity.

DÉCLARATION DU PORTE-PAROLE EN MATIÈRE D’AFFAIRES ÉTRANGÈRES, PAUL DEWAR, CONCERNANT LA DESTITUTION DE LA JUGE EN CHEF SRI-LANKAISE, SHIRANI BANDARANAYAKE

 

L’opposition officielle condamne sans réserve la récente destitution de la juge en chef sri-lankaise, Shirani Bandaranayake, qui n’est rien de moins qu’une violation des droits de l’homme à motif politique.


Nous exhortons au gouvernement canadien à déclarer sans équivoque que le Canada ne participera pas à la réunion des chefs de gouvernement des pays du Commonwealth. Cet acte injustifiable démontre, malheureusement, que le gouvernement sri-lankais ne s'applique pas à l’amélioration des conditions nécessaires au respect et à la réalisation des droits de la personne.

 

Le gouvernement sri-lankais ne cesse de porter atteinte à l’indépendance et à l’intégrité de la justice. La destitution de la juge en chef Shirani Bandaranayake est le résultat d’un processus opaque et est largement considérée comme un châtiment pour avoir pris des décisions qui ne plaisaient pas au gouvernement.


Le NPD est solidaire avec la juge en chef Bandaranayke et avec les gens de conscience de partout au monde et il appelle le gouvernement du Sri Lanka à s’engager à honorer et à respecter les valeurs de bonne gouvernance et les droits de la personne.

 

Nous exhortons les membres du Commonwealth à se lever et à dénoncer cette attaque sur l’indépendance du système judiciaire. Les pressions diplomatiques internationales doivent être centrées sur la mise en œuvre des recommandations du panel d’experts du Secrétaire général sur le Sri Lanka, qui a révélé des allégations crédibles de crimes de guerre et de crimes contre l’humanité.
