It is very sad to hear that Marks and Spencer has assured Public Administration Minister Dr. Sarath Amunugama that, the company will take every possible effort to make sure Sri Lanka receives the GSP+ concession.

GSP Plus explicitly obliges Sri Lanka and other beneficiary countries to comply with 27 international agreements on human rights issues. The country last year refused to let an EU team investigate alleged abuses so the EU used independent consultants to examine whether Sri Lanka had violated the UN Convention against Torture, the UN Convention on the Rights of the Child, and the UN Covenant on Civil and Political Rights. They described a culture of “complete or virtually complete impunity in Sri Lanka”, citing police torture, abductions of journalists and uninvestigated disappearances. They also criticized the detention of almost 300,000 ethnic Tamils in internment camps.

It is your assurance to Sri Lankan cabinet ministers is raising many concerns including the corporate citizenship and responsibilities of M&S. The business ethics and corporate culture must not be bargained for short term achievements by a respected organization like M&S with long business history. The money M&S making from its Sri Lankan ties is “Blood Money”.

Many world reputable organizations such as the United States-Based the Human Rights Watch (HRW), London- Based Amnesty International (AI), Hong Kong-Based Asian Human Rights Organization (AHRC), Journalists Without Boarders (RSF) and many other rights groups documented that the Sri Lankan state committed serious rights abuses with impunity such as enforced mass abductions, mass disappearances, unlawful execution style summery killings, mass murders, tortures, rapes, destruction of personal, public and cultural properties, forceful displacements of Tamil minorities in Sri Lankan and got away with it.

EU's recent investigation on all violations of international human rights law and international humanitarian law by the Government of Sri Lanka armed forces concluded that Sri Lankan armed forces are to blame for abundant abductions and extrajudicial killings.

Please understand the bad agony Tamils are going through in the hands of Sri Lanka state terror. I respect your intention of helping third world families who are living in poverty and starvation. However, your investment in Sri Lanka would only end up in the government to displace Tamils by using heavy weapons, bomb hospitals 22 times, run an internment camp with 300 000 people. If the history registers these war crimes of Sri Lanka, would M&S wish to share its contribution for this modern “Genocide”?

Please let the law do its work. If EU wants to discontinue GSP+, let it be that. 80 Million Tamils are watching this issue very closely. It’s up to M&S to respect the human rights or balancing the book with “Blood Money”.
