Subject: India should not turn a blind eye on Sri Lanka's war crimes

Hi,

Many hoped for a true peace and reconciliation from the days in May 2009, but a triumphant Sri Lanka has largely ignored its promises.

Will the Sri Lankan government be able to shrug off the persistent allegations that war crimes were committed, in its successful assault on the Tamil Tigers (LTTE) in 2009? Many have assumed that the answer to that question was – probably Yes. But now they are beginning to wonder thanks to outstanding investigative journalism by Channel 4 of UK.

In the cold winter days of 2009, Tamils told the world, contrary to claims; safe zones are anything but safe. We told the world, contrary to claims, that Sri Lanka had no constitution to protect Tamils. We told the world, that Sri Lanka is a murderous, scurrilous state. We told the world, that the Sri Lankan invasion of Tamils’ homeland would not be the beginning of the end of war, but merely the beginning of end of Tamils in Sri Lanka.

Only NDP stood up against state sponsored violence and injustice against Tamils in Sri Lanka. And today, NDP has once again voiced its support for an inquiry that is critical for the humanity where it was revealed at least 40000 civilians had been killed.

I write to seek your support once again in helping spread this humanitarian cause among the population about the recently released Channel 4 video footage on the ended Sri Lankan war.

Please apologize me for taking the liberty to link the video footage at the bottom of this mail. The 'distressing images' of true events in the programme, described as the "most harrowing' some viewers had ever seen, from prolonged civilian starvation to the naked corpses of men, women and children being loaded onto military trucks by smiling soldiers.

The film, billed as 'one of the most shocking films ever screened by Channel 4" has an explicit message to the international community complementing the UN Expert Panel's findings of up to 40,000 civilian deaths within few days.

The documentary reveals the Sri Lankan government’s master plan to get rid of international witnesses. The documentary begins and ends with the pathetic and heartbreaking images of desperate Tamil civilians begging the UN workers not to leave.

UN staffer Benjamine Dix was choking with emotion when he shared his feelings with C4 about the UN leaving. “For me that was personally the worst moment of my life. It seemed like their greatest hour of need; there was an army sitting at their door step waiting to take the town and we drove out; that was a very difficult time for us, a real sense of abandonment of these people,” he said, pointing particularly to one girl in the crowd amidst waving hands.

On 15th Sept 2008 when news that the international staff were leaving spread, a crowd had gathered, “please don’t leave, they cried, pleading not to go, I ran my camera along the waving hands and there was one girl at the end she wasn’t shouting or chanting but there was real sadness in her face – I was quite emotional - her face captured the real emotion at that point. The Brahmin laid it on the line – we don’t care about our food, shelter and water, we’ll take care of ourselves we need international eyes on the ground to see what’s happening here. If you leave we will all die – the knife is at our throat.” Dix said.

The official UN spokesman at that time Gordon Weiss believes “the Sri Lankan Government’s motive was not the safety of UN Personnel,” when it asked the staff to leave Tiger controlled areas: “The government regarded the UN as impediments to their conquest of the Tamil Tigers. By removing those organizations there were no longer international witnesses to what was coming; their intention was to remove independent witnesses,” stating he personally thought “it was a mistake.”

The UN Special Rapporteur on extrajudicial, summary or arbitrary executions Christof Heynes verified the new video’s authenticity to the United Nations Human Rights Council, has called for an international investigation, after recognizing the video showed evidence of “serious international crimes”.

Further a lawyer with international human rights expertise, Prof William Schabas points out attacking hospitals is a serious violation. “A hospital is totally off limits” he says, and goes on to draw a clear distinction between legal and illegal acts in war.

I am hopeful that the disturbing scenes in this film will give you a better understanding of what the Tamil minority population in Sri Lanka has been going through at the hands of oppressive majoritarian for the past six decades since the Independence. I stepped down from the Cmte on the Human Rights of Parliamentarians of the IPU in April because my mandate expired. However as a member I frequently raised my concerns. As a Canadian citizen, Mr. Roy Manojkumar Samathanam deserves due justice ( story : http://news.nationalpost.com/2011/07/01/canadian-detainee-wants-probe-into-detention-and-alleged-torture-in-sri-lanka/ ).

Should Canada continues to remain silence on issues with Sri Lanka, we would be seen a weak government that is supporting 'all efforts' by Sri Lanka. Now the Liberal leader Hon. Bob Rae too was ill treated by Sri Lanka when he arrived the airport. Many Tamil Canadians do feel that despite their citizenship their rights will not be protected should things go wrong while visiting Sri Lanka. This is a national disgrace by any menas.

Their media release as follows;

1) The Sri-Lankan government’s statement about the completing of resettlement in the North and East was false and the government is failed to complete the resettlement programme as it announced to the international.

2) During the three decades of war 40,000 people were maimed and there are 90,000 widows in the North and East.

3) At least one person was killed or injured in the every family who are presently living in the war affected areas.

4) There are two major IDP camps under the control of Sri-Lankan Army.

5) Land is given to the families to build houses without any economic support.

6) Denied the basic amenities like housing, drinking water, electricity, toilet facilities, medical facilities and the transports.

7) Sinhalese settlements are taking place in Tamils’ land.

8) Destroy the Hindu Temples and build Buddhist Shrines and hoisting Buddhist religious flags all over the places.

9) There are hundreds of army camps in the densely populated areas of Tamils in Vavuniya, Mullaitivu, Kilinochchi Mannar, Trincomalee, Batticaloa and Jaffna. The people feel the uncertainty towards their future.

10) By saying we have won the terrorism, Mahindha Rajapaksa would like to throw the country into war, communalism and into division and this stimulating the Sinhala racist.

11) Tamils’ normal life is restored in their areas after the war is not true.

12) Sri Lankan government has not made any resettlement plan fully for the affected people. The people are complaining that the donations in the form of money and goods from India and other international assistance are not used for the affected people.

13) The government continues to build many army camps in North and East whereas it declared the war is over.

14) Restricted freedom of speech in the northeastern regions. Despite this, any one arranges any meeting or get together; they would be the missing persons.

15) Because of the war, they migrated many times and living as internal refugees.

16) In the war-affected families, the wives are searching their husbands and the children are wandering and looking for their parents.

17) The widows who have to look after their families never receive any assistance from the government.

18) There are 12,000 widows from the age of 17 to 28. They are facing sexual harrasment by the police, intelligent and the armed forces.

19) 6,000 young girls less than 18 years old are pregnant .

20) The disabled persons by the war are abandoned without any rehabilitations.

The mission’s recommendations as follows;

1) Political rights must be given to the Tamils.

2) Land and Police powers must be granted to the eastern and northern States.

3) Find a political solution to the ethnic problem in Sri Lanka.

4) Implement the 1987, 13th Amendment to provide autonomy to the Tamils.

5) Important political powers, the authority on the habitats of northeastern have to be offerd.

6) Amalgamated North East Provincial council should be given to the authority.

7) The Draconian Emergency Law, Military & Police must be removed from the North & East of Sri Lanka.

8) Any Investigation in to War Crimes must be conducted with the coordination of the affected Tamils in North & East.

9) The GOSL must issue a White Paper on the number of refugees in the Camps.

10) The GOSL must take the responsibility of providing work, cultivatable land, technical knowledge to the war widows and also to the womenwho lost their children.

11) Those who are in the detention campsmust be releasedimmediaely and the GOSL must guarantee rehabilitation to these people.

12) Those who are responsible for the rapes of women must be identified and punished. Most of these are committed by the military & Police.

13) Safety of all women in the camps must be guaranteed as long as they stay in the camps.

14) All the children male or female must be handed over to their parents or to their relatives immediately.

I earnesly request you to consider the above facts before you decide in choosing the venue for the forthcoming commonwealth Games and we are confident that you will give priority to Human rights. Also please urge the Government of Sri Lanka to fulfill all the recommendation submitted by the fact finding mission from India. Thank you

From UN to many world powers have requested Sri Lanka to investigate, but India has remained on sidelines. The world is also looking upon India to act. The Chief Minister of Tamilnadu has called for an economic embargo, so that Sri Lanka can move in the right direction sooner.

In addition to that please, everybody write a protest to Al-Arabia about this author’s non researched fictions appearing in the article. To prove those he cannot produce any documentation. For example, he is quoting from sources which he is appearing to be not ready to believe.

“If Indian intelligence is to be believed, LTTE financed its war with a multi-billion drug trade; it carried out contract killings of politicians and businessmen for big bucks.”

After all Indian intelligence did not produce a report like that. It is a well-known fact that the Indian intelligence produced LTTE with the money, arms and training.

For every Woolsey and Perle, there are unknowns who shoot to superstardom on the basis of their detailed knowledge of industries like shipping or terrorist groups like al-Qaeda. The latest entry to this elite club is Prof. Rohan Gunaratna.

Canada's The Globe and Mail reported “Tamil migrant held over possible ties to terror group”, citing Rohan Gunaratna, the migrant's vessel may have been used for gun running by the Tigers. Another Canadian media, CBC, went one step further and reported “Tamil Tigers look to regroup in Canada: expert”. "I cannot think of any other country that is more important for the Tamil Tigers as Canada, to regroup and continue their campaign against Sri Lanka," it reported according to Prof. Rohan Gunaratna.

But in a interview to the “The Nation” English weekly in Sri Lanka on May 24th Issue of 2010, to a question, Do you foresee any possibility for the LTTE to regroup?, he clearly said, “No, absolutely not”.

"He got it wrong" - CIA spokesman Bill Harlow following Gunaratna's testimony. In July 2003, Gunaratna sparked headlines when he appeared before the U.S. task force investigating the Sep. 11 attacks. He made the startling claim that Khalid Shaikh Mohammed, a senior al-Qaeda leader and one of Osama bin Laden's top lieutenants, was not only present but chaired a January 2000 summit meeting in Kuala Lumpur, Malaysia, where the Sep. 11 attacks on New York and Washington, D.C., were allegedly planned.

That meeting has been the source of considerable controversy in the United States because it was monitored by Malaysian intelligence on behalf of the CIA, which subsequently tracked the movements of two al-Qaeda attendees, Khalid Al-Mihdhar and Nawaf Al Hazmi, to Los Angeles. Those two men later took part in the Sep. 11 hijackings, and the CIA was chastised for not passing their names on to the Federal Bureau of Investigation.

Gunaratna's claims about the 2000 meeting were based on U.S. intelligence debriefings of Mohammed, who was captured in Pakistan earlier this year. But they were emphatically denied by the CIA. "He's totally incorrect," said CIA spokesman Bill Harlow following Gunaratna's testimony. "He got it wrong."

“Gunaratna is unreliable “ - Martin Bright, home affairs editor of the 'London Observer' - Gunaratna's apocalyptic talk is precisely what bothers many analysts. One sceptic is Martin Bright, home affairs editor of the 'London Observer', who has been writing for years about Islamic terrorist groups. He believes Gunaratna is unreliable and said in an e-mail interview that he is "not a great fan."

Bright noted that in an interview with BBC, Gunaratna attributed "without question" recent attacks on U.S. forces to al-Qaeda - and then went on to say "that the biggest problem the allies face in Iraq is lack of intelligence about the people carrying out these attacks''. "So how does he know who carried out these attacks when the massed ranks of the allied intelligence do not?" asked Bright. "I think he's a dangerous man who sells a specialist kind of 'expert' product dripping in panic and terror."

“Self-proclaimed expert” - Brian Toohey, journalist and commentator on intelligence issues - In Australia, journalist and commentator on intelligence issues Brian Toohey is one of the few to have openly questioned Gunaratna’s credentials, describing him as a “self-proclaimed expert” and dismissing some of his claims as "plain silly". He uses as an example a warning by Gunaratna published in November 2001 that terrorist groups might try to influence Australian politicians by rallying “10,000 or 20,000 votes” in their electorates. Members of Australia’s intelligence community, and in particular ASIO, are known to be dismissive of many of Gunaratna’s more sensational statements, such as claims that alleged military chief of the Jemaah Islamiyah network and senior al-Qaeda member Hambali had regularly visited Australia.

"a title we do not have" – Alex Schmid, the senior crime prevention and criminal justice officer at the UN's terrorism prevention branch - Prof. Gunartna's former role as principal investigator has also been highlighted in appearances on the BBC, CNN, Australia's ABC radio, and at prestigious international conferences on terrorism. But Alex Schmid, the senior crime prevention and criminal justice officer at the UN's terrorism prevention branch, in Vienna, told The Sunday Age that Prof. Gunaratna had never worked as a principal investigator with the organisation. In fact, the position of principal investigator was "a title we do not have", Mr Schmid said. "Mr Gunaratna was, for a while, a consultant of the terrorism prevention branch," he said. "He was not a principal investigator. He also did some work for the UN University in Tokyo."

One more controversy - The biographical details in the book also state that Prof. Gunaratna "was called to address the United Nations, the US Congress and the Australian Parliament in the wake of 11 September, 2001". Addressing the Australian Parliament is a rare privilege, normally reserved for visiting heads of state. Checks with the parliamentary library and a comprehensive search of Hansard could find no record of him having done so. He did, however, speak at a parliamentary library seminar held on September 26, 2001, at which some members of Parliament would have been present. He also spoke at a Menzies Research Centre function at Parliament House in May.

Dear Secretary General,

A Sri Lanka Army (SLA) officer has given Channel 4 an account of how, following orders from Defence Secretary Gotabaya Rajapaksa, the commander of the 58 Division, Brigadier (now Major General) Shavendra Silva gathered his officers in the closing days of the war and ordered them to take no prisoners when capturing the remainder of the enclave in which thousands of Tamils civilians and fighters were surrounded.

Brig. Silva received the same orders that Mr. Gotabaya issued to all regiments, the officer who was then serving under Brig. Silva told Channel 4. Meanwhile, another Sri Lankan soldier with the 58 Division has given an eyewitness account of an orgy of mass murder, rape, torture and mutilation in the final days in which tens of thousands of Tamil civilians perished.

According to witnesses, tens of thousands of people, including large numbers of children, were killed by Sri Lankan troops, who also raped, tortured, and mutilated bodies, again including children.

From UN to many countries in the world have accused Sri Lanka for alleged war crimes. They have bloodied their hands with lives, including of Indians! The fact is that these MPs have direct and indirect knowledge of (continuing) genocide of Tamils! And they have killed more than 500 TamilNadu Fishermen.

Dear Honourable members of parliament, India.

Subject: India should not let Sri Lanka's peace slip away

In a recent speech former NSA advisor said, 'We have two enemies, Pakistan and China, who want to keep us embroiled in South Asia so that we don't look beyond". "What has happened to Sri Lanka. So much support was given to Sri Lanka when they were supppresing the LTTE, and now, they say it is none of your business. If we continue this way, nobody will bother about India," Mishra warned.

Since the end of civil war in May 2009, Sri Lanka has not only failed to deliver a political solution to Tamils, but has strengthened its relationship with China to alarming levels. The President makes a second visit to Beijing in leas a year.

UN and many western counties have also called for an independent inquiry on alleged war crimes where more than 40000 civilians feared killed. And people in TamilNadu have also been demanding to curb attacks on their fishermen where more than 500 have been killed.

India should help Tamils to decide a political solution that would also guarantee India's safety in the Southern tip. And the time may be now.

Thanks or your continued solidarity with the plight of Tamils in Sri Lanka and respect to the will of people of Tamilnadu.

On 2 July 2011 when conscience struck Prime Minister Manmohan Singh met editors of five newspapers in New Delhi said that the Tamils “have legitimate grievances.” This brought a sigh of relieve among the eighty million Tamils worldwide for they thought that at last the Indians had come to their senses. He went on to say: "You have a situation in Sri Lanka. The decimation of the LTTE was something which is good. But the Tamil problem does not disappear with the defeat of the LTTE. The Tamil population has legitimate grievances. They feel they have been reduced over the years to second-class citizens."

"And our emphasis has been to persuade the Sri Lankan government that we must move towards a new system of institutional reforms, where the Tamil people will have a feeling that they are equal citizens of Sri Lanka, and they can lead and live a life of dignity and self-respect. It is not easy because within Sri Lanka's population, there are hotheads, Sinhala chauvinism is a reality," the Indian Prime Minister said.

Today the Tamils in Eelam are humiliated and tortured because no one there to protect them.

What happens in Sri Lanka also impacts India. In September last year India’s National Security Advisor Shiv Shankar

Menon dismissed the view that China planned to encircle India through military bases in the Indian Ocean. "There are no Chinese bases in the Indian Ocean today, despite talk of the 'string of pearls, which by the way is a pretty ineffective murder

weapon as any 'clue' aficionado will tell you," Menon said during a lecture organised by the National Maritime Foundation in Delhi,debunking the anxieties expressed by many foreign military observers. This is the same man who failed to anticipate the Bombay bombings this year in spite of the first bombing in 2008. But, making a blunder with China may even cause sovereignty of India.

Only by making Tamils in Eelam as equal citizens can make India secure and peaceful in the decades to come.

The war has ended with a colossal death and destruction by its own government, but peace remains dream. In the recent days the scarce of ‘grease devils’ has once again reminded people continue to live in fear. Only a negotiated devolution of power sharing can bring peace to this island.

Lifting emergency may not change much in Sri Lanka as it continues to enjoy excessive power under the Prevention of Terrorism Act (PTA). Further, Colombo has not commented on the status of those being held under emergency regulations. Although this welcome step should alleviate some of the hardships people face on their daily lives, many remain skeptical given the mindset of the current administration. People want removal of PTA and removal military from daily life.

US must help to protect the right and freedom of minorities that has been long denied. So they can live in their own traditional homeland without fear and prosecution as suffering must be stopped.

Good luck with your upcoming visit to Sri Lanka.

Subject: Sri Lanka: Another mass grave unearthed in Jaffna

Dear Secretary General,

Skulls, skeletons and bones belonging to eight human beings have been found in an island off Jaffna. The human remains were found near the office of the Assistant Government Agent (AGA) in Neduntivy in Delft island by a group of workers when they dug the earth to put up a foundation for a generator room. The naked human remains were found only about one and half feet beneath the ground level.

While the human remains are about ten years old, all the victims seem to be young people.

If Delft which is far away from where the final battles took place has a mass grave then there are many more mass graves in the Tamil areas.This reiterates the need for an independent inquiry into crimes against humanity by all parties.

Dear Secretary General,

The issue of unknown and unmarked graves involves the living as much as the dead- this statement reflects how big an impact could the recent findings in Sri Lanka. UN and others have suggested at least 7000 had been killed in the days leading May 19, 2009 and as much as 1000 children remain unknown.

All hopes of ones who are still living and looking for their dear ones have been belied since the end of war. Asides, the Sri Lankan government has stop torture and other inhuman treatments. Further, disappearance too continues.

Only an international intervention can bring justice.

Only because of the ECCHR determined works which produced the detailed dossier to the German Federal Foreign Office, and then jointly with the Society for Threatened Peoples and TRIAL to the Swiss Federal Department of Foreign Affairs and to the Vatican the Sri Lankan Army commander, Jagath Dias's diplomatic status has been withdrawn.
