Sri Lanka: An unlawful settlement of Sinhalese in Tamils land

Dear Secretary General,

Some of the 500 Sinhalese who were brought to Jaffna town a few weeks ago have been settled yesterday in the town of Navatkulli with the full military assistance, supported by Colombo. This undemocratic act has created fear and uncertainty among the Tamils who live there.

I would also like to bring the following to your attention:

1. At least two women have been allegedly raped by the military in the past week

2. A portion of IDPs from the Menik Farm were forcefully moved to another camp

3. A visiting parliamentary delegation from Germany accused Colombo, despite the money, the facilities for IDPs are inadequate

4. Today, Colombo tightened the freedom of NGOs

All these and other continued recent developments should be a serious concern as Tamils have no one but the international community to safeguard them.

1. Introduction

The story of Ceylon

Sir Hugh Cleghorn wrote in his minutes to his majesty's government in 1796 that "Two different nations from a very ancient period have divided between them in possession of the island (Ceylon).

“ The Sinhalese, inhabiting the interior of the country in the Southern and Western parts while the Malabars (Tamils) who possess the Northern and Eastern Districts. These two nations differ entirely in their religion, language and manners...".

The Dutch and the Portuguese who were colonial rulers before the British did keep them as separate nations but the British amalgamated these different nations in 1833 for administrative purposes.

Ceylon got independence from United Kingdom in 1948.

Why the world need an independent inquiry

In 1985, the International Commission of Jurists (ICJ) pointed out that they saw a clear genocidal pattern of violence unleashed on Tamils during the several ethnic riots. In spite of their caution, the international organizations that have a sole mandate to protect the vulnerable showed an abysmal lack of oversight in averting the unimaginable tragedy on Tamils.

There is literally no change in Colombo's attitude towards its impunity for gross human rights abuses. With civilians still suffering and the government refusing to cooperate in the alleged war crimes, we owe to the people the truth.

Only a real inquiry into the Sri Lankan conflict can bring a closure the three decades of war that was blamed for the physical and cultural genocide of Tamil minority.

Sri Lanka’s legacy of abuse

History of Massacre of TAMILS in Ceylon (Sri Lanka) by Sinhalese governments ever since British left the Island in 1948 is astonishing by any means.

Sri Lanka's policy of complete dismissal was initially successful. But now the government seems to have discovered that ignoring the strongly held opinions of powerful Western partners has consequences that might not be in the long-term interest of the country or its ruling elite after all.

1.Slaughter of five Tamil students;

2.Massacre of seventeen Action Against Hunger aid workers in 2006;

3.Tamil disappearances into white vans without license plates every five hour;

4.Almost every member of the Sri Lankan security forces is Sinhalese;

5.Largely, no member of the security forces in the history of Sri Lanka has ever been prosecuted or punished for atrocities against Tamils, including torture or murder.

6.Indeed, in more than 62 years, only two prosecutions have been pursued for rape, murder, torture, or other crimes against Tamils, and that one isolated exception was for peculiar and political reasons.

2. Genocide by Sri Lanka over six decades

2.1 UN Definition

2.1.1 Objectives

This convention declares genocide a crime under international law. It defines what genocide is, and condemns this crime whether it's committed in peacetime or wartime.

2.1.2 Key provisions

The convention defines genocide as any act committed with the idea of destroying in whole or in part a national, ethnic, racial or religious group. This includes such acts as:

• Killing members of the group

• Causing serious bodily or mental harm to members of the group

• Deliberately inflicting conditions calculated to physically destroy the group (the whole group or even part of the group)

• Forcefully transferring children of the group to another group

The convention declares that there is no immunity from being prosecuted for committing genocide: those found guilty of genocide will be punished for their crime, regardless of whether they are or were legally constituted ruler, public officials, or private individuals.

2.2 Tamils in illegal camps

Concentration style illegal camps have been setup to lock Tamils for years. Many human rights organizations have raised their concerns regarding the concentration camps setup by Srilankan authorities to international community.

2.3 Rape as a weapon of war

There are hundreds of reported/unreported rape cases in the hands of Sri Lankan military and paramilitary forces.

2.4 Arrests, Abductions and Torture

There are the documented Disappearances/Abductions of Tamils in the past decades.

2.5 Forceful evacuation of Tamils and State sponsored Colonisation

Tamil villages were attacked by Srilankan Army and Sinhalese thugs to force them out of the villages to colonise with Sinhalese prisoners.

2.6 Intellectual genocide

Many Tamil students were denied entry into higher education even when they scored high compared to Sinhalese students as a result of a new system that favours Sinhalese (came into force in 1971).

Tamil Members of Parliament allegedly killed by Sri Lanka.

06 Mar 2008 : K Sivanesan MP was killed in a claymore attack by Srilankan Army deep penetration unit.

01 Jan 2008 : T Maheswaran MP assassinated in Kotehena Sivan Temple in Srilankan military High Security Zone (HSZ).

10 Nov 2006 : Ravirayj MP was assassinated in Colombo HSZ in daylight, 24 hours after protest outside the UNHCR office.

07 Apr 2006 : The assassination of V Vigneswaran took place just as Tamil National Alliance (a Tamil political party) was preparing to announce the appointment of V Vigneswaran to fill the position held by the Joseph Pararajasingham MP who had been slain in Baticaloa on X-Mas eve.

25 Dec 2005 : Joseph Pararajasingham MP assassinated by Srilankan Army while attending an X-Mas eve mass at St Mary’s church in Batticaloa. He was a well known human rights activist.

07 Feb 2005 : Ariyanayagam Chandranehru MP killed by Srilankan Army.

05 Jan 2000 : Kumar Ponnambalam MP assassinated a few days after his critical open letter to Srilankan President Chandrika Kumaratunga.

Journalists allegedly killed by Sri Lanka

19 Oct 2000 : Mr. Mylvaganam Nimalarajan; Contributed for BBC for over 6 years. Shot dead.

31 May 2004 : Mr. Aiyathurai Nadesan; A leading Tamil Journalist and political analyst. Shot dead on his way to work.

29 Apr 2005 : Mr. Dharmeratnam Sivaram; Killed due to his “uncompromising coverage of political and military situation” and support for the rights of Tamils.

28 May 2008 : Mr. Paranirupasingam Thevakumar. Jaffna correspondent of Sakthi TV station.

2.7 Economic Embargo to Tamil Areas

Depriving of Food and Medicine and other essential items to lead to a social destruction of the Tamil community in North & East was practiced during 1995-2009.

3. Liberation Tigers of Tamileelam

The Liberation Tigers of Tamil Eelam (LTTE) have their share of blood and perpetrated their own atrocities. But they are the product, not the cause, of an injustice and a war that long predates them. Neither is Sri Lanka’s civil strife as unfathomable as it is often presented: an ancient religious-ethnic rivalry between the Hindu Tamils and the Buddhist Sinhalese government.

The systematic elimination of 6 million Jews was genocide. The systematic killings of 800,000 Tutsi in Rwanda were genocide. The millions of Cambodians killed by Pol Pot's regime was genocide. What is happening to the Darfurian today is genocide.

The victims were considered defenseless in every case.

The preamble to the Universal Declaration of Human Rights reads:

"Whereas it is essential if man is not compelled as a last resort to rebellion against tyranny and oppression, that human rights should be protected by the rule of law."

And many international experts did not think Tamil Tigers were a defenseless group. They had military training, they had weapons, they had the means to combat the Sri Lankan government forces.

3.1 LTTE using civilians as human shield

Diaspora of Tamil origin who had kith and kin did vouch for the fact that the people in the "safe zones" were not being forced to stay but were doing so on their own accord and free will and this was supported with personal stories.

-- The people don’t want to leave the "safe zones" and enter what they believed "enemy" territory.

-- It’s against human rights to force people to leave when they don’t want to leave.

-- By asking civilians to leave the "safe zones" the international community took the full accountability, and yet civilians are still in "internment camps."

3.2 The declarations

On the BBC, on Feb. 2, defense secretary Rajapaksa declared that nothing should live or breathe outside the Orwellian “safe area.” Thus, one hospital outside the area has been bombed three times, including by cluster bombs. More than 1,000 Tamils were in detention camps, and reports of rape emerged.

3.3 “Safe Zone” – Killings in Srebrenica

More than 7,000 Bosnian Muslim males in Srebrenica were killed in “safe zone” declared by Bosnian Serbs. It was later declared as genocide.

UN recognizes at least 6,000 Tamils were killed in the “safe zone”, in the last weeks leading into May 19, 2009.

3.4 “Safe Zone” – Killings in Vanni, Tamileelam

Sri Lankan government had been bombing and shelling of “safe zone”:

1. since January 21, 2009 to May 19, 2009

2. at least 350,000 Tamil civilians

3. killing and maiming the Tamils in the thousands

3.4 The final appeal

An Open Letter to the Members of the Security Council, the United Nations and the International Community:

You are our only hope.

On behalf of over 160,000 civilians still in the area, we are making this final appeal to the international community to stop the slaughter of Tamil civilians in the so-called “safe zone”.

As we write this appeal there is a build up of Sri Lanka Armed Forces in the areas surrounding the so-called “safe zone” and an offensive via land, sea, and air is only a few hours away.

On Sunday 26 April, the Sri Lanka Air Force bombed the Valiaganmadam village, the only village with sea access, 39 times and on Saturday 25 April there were at least 25 attacks which killed and injured hundreds.

Based on their previous experiences over the past three months TRO officials in the “safe zone” have predicted that if the expected offensive goes forward there will be more than 10,000 casualties as the area is densely populated and there is no cover from bombs, shells, and bullets.

The UN, US, India, EU, UK, Russia and China must all put pressure on the Government of Sri Lanka to immediately stop all military attacks and enter into an immediate, UN monitored cease fire.

4. Conclusion

Given the cruel history of mass massacre of Tamils by Sinhalese in Sri Lanka, now we would like to question the democratic civilized world whether there exists any room for Tamils who are different from Sinhalese in every respect (i.e,. Religion, language, culture, etc.) to live peacefully in Sri Lanka?

Will the suppression by Sinhalese ever stop unless Tamils get their right to Self-Determination?

We urge your Excellencies to view the Tamil Eelam struggle in Sri Lanka as analogous to:

1. Kosovo struggle in Serbia, where the interim administration of the UN(UNMIK) resulted in the independence of Kosovo

2. Eritrean struggle in Ethiopia where a UN sponsored referendum resulted in the independence of Eritrea

3. East Timorean struggle in Indonesia where a UN sponsored act of self determination resulted in the independence of Timor Leste and

4. The UN approved partition of Palestine into Israel and Palestine resulted in the creation of a new state of Israel.

And likewise sponsor the restoration of the sovereign state of the Tamil Nation to the Tamils-they having been trying for well over 62 years to live with peace and dignity with the Sinhalese Nation.

Dear High Commissioner for Human Rights,

I recently came to know about a news item leaked from Sri Lankan northern jungle next to a town called "Manalaaru" where about ex 800 Tamil Tiger female cadres are kept as workers for military settlements. The news further claims that around 200 of them are disabled people who were captured as injured. The female cadres seen lined up and taken into jungle in "Pannai " area where they are used to cut trees and build huge military base. It is quiet obvious when military is given such right then sexual abuse would be normal on these women.

The news once again shows the need for international community to act immediately to save remaining Tamils and bring justice.

Description: My cousin Xxxxxxxxx Xxxxxxxxxxxxxxxxx, his wife, and their two children lived in Akkarayan in the Kilinochchi District from 1990 to 2009. When the war closed in on Akkarayan, the family fled, along with thousands of other refugees, toward Mullivaikal sometime in January 2009. After the family surrendered to the Sri Lankan military, by the assurance of many, the head of the family Xxxxxxxxx Xxxxxxxxxxxxxxxxx was taken away and his wife and two children (ages: 11 and 07) were placed in an internally displaced persons camp.

Xxxxxxxxx Xxxxxxxxxxxxxxxxx’s wife and two children were released in November 2009, but they have been unable to locate him since then. Furthermore, the military claims they have no record of Xxxxxxxxx Xxxxxxxxxxxxxxxxx or his whereabouts.

Therefore, I would like submit that Xxxxxxxxx Xxxxxxxxxxxxxxxxx was killed after surrendering to the Sri Lankan military in May 2009.

I have also attached the photos of the family.

More evidence of war crimes in the form of summary executions has been uncovered and broadcast over British Channel.4 News during Sri Lanka president’s visit to the UK during this week.

To date, leading stalwarts on human rights and crimes against humanity have in no uncertain terms called for a UN sponsored international and independent investigations of these macabre acts violating

international laws and the guilty brought to book.

I need not stress or remind that conduct of wars either in an international level or as an internal armed conflict, are subject to UN jus in bello which Sri Lanka callously ignored. If the end justifies the means, spurious ends; such as the supremacy of the third Reich or destroying anyone who gets in the way, then we are relying on arguments that justifies every horror known to man. I am confident that your past experience and expertise would stand in good stead to draw conclusions and make recommendations to the UN Secretary General.

Emergency Message to the UN Panel of Experts Dec 15th deadline.

Dear Supporter,

As you know up to 40,000 innocent civilians were killed last year and a further 20,000 are now amputees as a result of the indiscriminate shelling and bombardment by the Sri Lankan armed forces. Recent reports from channel 4 also show there is clearly a need for a war crimes investigation.

However we need you to take urgent action to ensure a war crimes investigation takes place. We have attached 5 sample letters that we urge you to use to submit your letters to the U.N. Panel of Experts to pressure the UN for a war crimes investigation on Sri Lanka. We suggested you use one of the letters below (perhaps change the wording a bit) or your own.

You only have a few more days to submit a letter (15th December). You can still send one even if not directly affected by the conflict and crimes against humanity committed by Sri Lankan forces and its leaders.

Gordon Weiss a former UN official spokesman who worked in Sri Lanka during the final military operation by the Sri Lankan army against the Liberation Tigers of Tamil Eelam (LTTE) said close to 40,000 Tamil civilians were killed and over 50,000 were injured including many thousands of children at the end of the Sri Lanka's civil war in May 2009.

Tamils in Sri Lanka have gone through several rounds of communal violence tacitly supported by then Sinhalese lead governments since 1956 and continual killings of thousands of Tamils civilians in security operations since 1984. Torture, rape and random abductions and disappearances of young Tamils have been perpetrated by the military and pro-government paramilitaries, in the process.

The 1983 pogrom killed at least 3,000 Tamils in matter of few days and caused 150,000 Tamils to flee abroad. This became the watershed in a background where Sri Lanka has never punished or found out the reasons who lead the communal riots against Tamils, though the Government and its forces stand accused as culprits.

The international community has to be constantly reminded that they have an equally strong responsibility to see that Justice is served for our people, who have known nothing but suffering and the stripping of the few rights they had.

Recent reports from channel 4 clearly show war crimes were committed in the final months of the war. I hope you will hear my story. I have family and friends that were wounded or killed by the Sri Lankan military offensive during the first five months of 2009. For decades, stories of Tamil suffering have been silenced by Sri Lanka's state oppression and intimidation. Due to Sri Lanka's culture of impunity and the international community's indifference to the plight of the Tamils, the deaths of my loved ones remain unaccounted for. I am urging you to act on the behalf of those whose lives were lost. Please recommend the Secretary General immediately initiate a full investigation into Sri Lanka's war crimes. This investigation would finally penetrate the cloak of silence surrounding the deaths of my loved ones.

Since Sri Lanka's independence, Tamils have an extensive history of systematic discrimination and genocidal assault. From past disenfranchisement to anti-Tamil riots, Sri Lanka has built a foundation in which Tamils are prevented from participating in crucial aspects of society. More recent food and medical embargoes, assault on press freedom, and coercive and violence tactics against humanitarian aid workers have highlighted the genocidal intent of Sri Lanka's government. The final indiscriminate military offensive was the culmination of decades of communal violence and state-sponsored racism towards Tamils. A UN official estimated between 10,000-40,000 deaths during the final days of the war in May, 2009.

Some of those deaths belong to family and friends of mine. Please ensure that their deaths do not remain ignored. Retribution and justice is crucial to securing peace for the Tamil population. Human rights organizations and democratic nations have called for an independent investigation into war crimes and crimes against humanity. Please join us in our search for peace and justice.

Dear Madam/Sir,

Personal links of Hon. Fox should not undermine the facts that Sri Lankan political leaders are being alleged for committing war crimes and crimes against humanity. The recent revelations of videos and pictures reveal the gruesome murders and rapes of unarmed civilians and former members of Tamil Tigers. According to UN, at least 7000 people were killed, but independent observers estimate as high as 40,000.

Human Rights Watch, the International Crisis Group, and Amnesty International have all demanded accountability for war crimes.

Until there is an independent panel is established to inquire the truth, until justice is served with dignity, I urge the defence secretary to cancel visit to Sri Lanka.

Subject: The oppression continues against Tamils as 2011 dawns

2011 begins with three major initiatives to exercise the right to self-determination: a referendum on independence in South Sudan, a resumed drive for self-rule by Iraq's Kurds and the Palestinians' moves for a unilateral declaration of independence. While each ethnic case is unique, they all come after equally prolonged intransigence and belligerence from the state concerned. Further, in all these instances, oppression has been ongoing for generations, undeterred by international appeals in recent years. In each case, the persecution has been pursued over decades not only through political and economic marginalization, but also annihilatory state violence.

Sri Lanka is no different. For six decades, the Sinhalese have consolidated their dominance of the state through electoral majority and state power. The demand for Tamil Eelam only emerged in the seventies - a full two decades after independence from Britain - after protracted, peaceful, and ultimately futile campaigns by Tamil leaders for an equitable place in the country's governance.

Today nothing has changed. Having defeated the Liberation Tigers' armed struggle, the Sinhala-dominated state is today following Serbia and Sudan, amongst others, and seeking to entrench a radicalized hierarchy of rule, justifying the project through the proven fragile doctrine of state sovereignty. The state's murderous policies of violence, humanitarian deprivation, demographic change and economic starvation will sustain, more forcefully than any theoretical exposition, the Tamil demand for self-determination.

We kindly urge the free world led by US must do all in its power to safeguard Tamils in Sri Lanka.

Dear High Commissioner for Human Rights,

On 25th of January 2011, while addressing the Human Rights Council, United Nations Secretary-General Ban Ki-moon declared that for the Council to fulfill its mandate it had to be seen as impartial and fair and it could not be seen as being ruled by special interests.

According to UN's own estimate, at least 7000 civilians were killed in the war leading to May 19, 2009. Last 2010, UN has also appointed a three member advisory panel requesting more evidence from the families of the victims. And despite many promises made by the Sri Lankan government who continues to seek avenues to hide facts and drag time on this very important issues for Sri Lanka going forward. Sri Lanka’s own investigations fail to examine the legality of decisions taken by senior military and political leaders who designed, planned and implemented the attacks.

The families of the victims sincerely hope that UN will hold its accountability in seeking justice by establishing fair and impartial inquiry. They also hope the remarks of Secretary-General, mentioned above, will be upheld in the upcoming 2nd session of the open-ended intergovernmental working group when Sri Lanka is called upon from the agenda, later this month.

Re: - Libyan Oil is thicker than Tamils’ Blood.

We don’t oppose the operation by the UN and its Security Council to liberate the Libyan people from the tyrant Col. Muhammad Qaddafi. The Tamil Canadian Elders For the Human Rights fully backing the UN and the Security Council.

The civil unrest in Libya just started last week and Qaddafi killed few hundred of his own people but Ban Ki-moon already demanding War Crimes Inquiry. UN Security Council imposes sanctions on Libya, slams Gaddafi with travel ban and asset freeze. Because, Libyans’ oil is thicker than Tamils’ blood.

But what happened to the cries of the dying Tamils in the bunkers, starring the skies waiting for the American rescue planes at the crucial hours on May, 2009. Not a single country came to the rescue. The UN and the Security Council let them to bury alive in the bunkers by the chain blocks.

The world tested all its weapons on Tamils through Sri Lankan government, 6000 times air strike – more than the explosive used in Hiroshima, cluster bombs, chemical weapons, 5000-6000 shelled daily etc. within the safe zone. More than 50,000 Tamils butchered and more than 50,000 maimed within 3 months. Killed top LTTE political leaders surrendered with white flags. 300,000 Tamils made refugees in their homeland and kept in concentration camps and Mannar Bishop claimed 146,679 people are missing.

What make things worse in Sri Lanka are not just the atrocities carried out by the fascist forces but the compromise made by some international elements, who have decided to support the criminals but turned a blind eye to the victims. They danced when the war criminals sang, and hid their faces in the sand when thousands of innocents were murdered in cold blood. UN, who is supposed to be a guardian for the oppressed and vulnerable in the world, had in fact assisted Sri Lanka in mass murdering innocent Tamils, simply by ignoring the cries of the dying at the final hours of the war.

UN did not hold Security Council meeting. UN kept its silence and still keeping its silence. Ban Ki Moon or the Security Council didn’t pass any resolution or impose any sanction on Sri Lanka or slams Mahindha Rajapaksa with travel ban and asset freeze. Sri Lankan Tragedy is also about an “unfair world” that is letting the murderers and rapists to walk on red carpets and let them to deliver lectures on the international stages but ignoring the plight of the innocents that are languishing in torture camps and prisons.

The Tamil Canadian Elders for the Human Rights joined with the American Senators and the Assistant Secretary of State, Mr. Robert Blake; the Australian Parliamentarians, the Prime Minister of England and the British Parliamentarians; the International Crisis Group, Amnesty International, Human Rights Watch and the Elders Organization to call for an Independent International investigation in to the War Crimes , Crimes against Humanity and the Genocide committed by the Sri Lankan President Mahindha Rajapaksa and his armed forces.

The continued tragedy in Libya where people are being massacred is a real concern. And security council, along with members, has taken meaningful steps to halt this agony. Namely, referring to the International Criminal Court is indeed a welcome step.

Tamils of Sri Lanka too faced with similar crimes by their government in months leading into May 2009. And we hope that justice there too will follow suit.

I am a Tamil from Sri Lanka who have been witnessing a difficult courageous struggle of Libyan people against tyranny. We Tamils all well know about the brutality in the hands of dictators. As Sri Lankan government stands behind Libyan President Muammar Al-Qadhafi’s regime who has also been accused of war crimes. In recent days, the regime in Sri Lanka has also staged demonstrations against whose who support the aspirations of Libyan people, including UN. Sri Lanka does not stand with the people of Libya.

We Tamils wish Libyan people a speedy liberation.

Subject : UN investigates mass killings in Ivory Coast

Dear Secretary General,

It is profoundly sad to witness another mass killings, this time in Ivory Coast. It reminds all of us the promise we made after Rwanda, "never again". And yet, we have let down since, notably in Sri Lanka where more than 40000 civilians were massacred by the state. And continued impunity from states like Sri Lanka may has also contributed to the killings in Ivory Coast.

And therefore, we must bring those to justice who orchestrates mass killings, so "never again" can be met. Further, UN and international community must also place effective mechanisms in place to prevent future massacres in potential countries.

Subject: Tamils in Sri Lanka Attacked for Celebrating India's Cricket Victory

There have been attacks by the Sri Lankan security forces on Tamils in the island of Sri Lanka, who were celebrating the victory of the Indian cricket team. It is reported that Tamil's lit firecrackers to celebrate India's cricket victory and to express their joy. Sri Lankan security forces went around in motor bicycles and attacked those celebrating. Sri Lankan security forces are almost exclusively from the Sinhalese community and are stationed in Tamil areas in the island of Sri Lanka.

These brutal attacks should not only be condemned, but the we should demand explanations from the authority with strings attached, including of banning the Sri Lankan team.

Thanks for this quick action by ICC on Ivory Coast, hoping this would help to bring those to justice and prevent further killings.

The same actions, be it tardy, would still help to save Tamils in Sri Lanka where it is feared more than 7000 civilians were killed, according to UN. UN is also about to release its fact findings. Continued injustice could spark another wave of genocide against Tamil minority.
