அவுஸ்திரேலிய அரசாங்கம் சில சாத்தியக்கூறுகள் குறித்து பரிசீலித்து வரும் அதேவேளை அதன் சர்வதேச கடப்பாடுகளை மீறும் விதத்தில் செயற்படாது என அறிக்கையில் தெரிவித்துள்ளது.

Sri Lankan asylum seekers denied access to Aust law: advocate

The Australian Refugee Association (ARA) says 83 Sri Lankans being held by immigration authorities do not have proper access to means of applying for asylum in Australia.

ARA spokesman Kevin Liston says their treatment will also be an indication of how the Australian Department of Immigration and Citizenship operates in the wake of the Palmer inquiry.

Mr Liston believes the Sri Lankans are already at a disadvantage should they try to claim asylum.

"Using Nauru and Christmas Island as bases in which to process those claims is terribly unfair on people," he said.

"It doesn't give them access the full range of Australian law, which they should have when they apply to Australia for asylum."

83 Lankans to return to their country via Indonesia

Melbourne A deal to return 83 Sri Lankans from Christmas Island, a small non-self governing territory of Australia, to Indonesia is on the verge of finalisation, according to an Indonesian official.

On the condition of anonymity, the Indonesian official informed a local radio channel today that under the deal the 83 Sri Lankans would only transit briefly through Indonesia on their way back to Sri Lanka.

Significantly, the official said that it was not intended that the United Nations High Commissioner for Refugees (UNHCR) would become involved, but rather arrangements would be made directly between the Governments of Australia, Indonesia and Sri Lanka.

Indonesia is not a signatory to the United Nations Refugee Convention.

Australian Foreign Minister Alexander Downer and Immigration and Citizenship Minister Kevin Andrews have said Australia has no intention of breaching its international obligations and said that the Sri Lankans would be able to claim asylum with the UNHCR in Indonesia if they are sent there.

A spokeswoman Kevin Andrews said Australia's discussions with Indonesia have been of a preliminary nature.

She said any suggestion Australia would agree to an arrangement which would see refugees returned to a country where they face persecution is wrong.

She added that it is yet to be determined whether or not the Sri Lankans are refugees. PTI

Asylum seekers talks reach stalemate

TALKS between Australia and Indonesia have failed to secure a breakthrough about what to do with 83 Sri Lankan asylum seekers being held on Christmas Island.

Discussions continued today as the Federal Government tried to convince Jakarta to accept the group and guarantee their claims would be heard by the United Nations High Commission for Refugees (UNHCR) in Indonesia.

The Sri Lankans, along with two Indonesians detained with them, are being held in the temporary detention facility built on Christmas Island in 2001, as the government's much-vaunted new centre is not yet up and running.

Among the detainees is a 17-year-old boy being accommodated with an adult in a housing unit outside the detention centre.

The 85 men were detained after their boat was intercepted by HMAS Success in international waters on February 20.

Immigration Minister Kevin Andrews today said he would like the Sri Lankans returned to Indonesia, from where they sailed to Australia, to have the UNHCR assess their claims, as this was a stronger deterrent to people smugglers than processing them on Christmas Island.

"How do we send the strongest message of deterrence? If they spent a lot of money getting to Australia and end up back in Indonesia, that's a pretty strong message of deterrence," Mr Andrews said.

Australia has said it would not send the men back to Indonesia if it meant they would then be returned to Sri Lanka, where they could face persecution.

"We won't send them to Indonesia if we don't get an assurance from Indonesia that the process of resettlement should occur in Indonesia under the UN protocols," Mr Andrews said.

"We want an assurance that that will happen in Indonesia and that they wouldn't be sent back to Sri Lanka. If we don't get that assurance then the Indonesian option's out."

While discussions with Indonesian officials are ongoing, Nauru has already indicated it is willing to accept the men.

Mr Andrews acknowledged the Sri Lankans may have genuine claims for refugee status, given the violence in their homeland which intensified today when three western diplomats were injured in a Tamil Tiger mortar attack.

"We're not making a judgment on whether or not they've got a legitimate claim to refugee status. We're simply saying that in terms of protecting Australia's national security, then people who wish to claim refugee status and be resettled in Australia should go through the process in the proper way," he said.

Christmas Island shire president Gordon Thomson called for the men to be processed on the island or the Australian mainland, saying it was pointless to send them offshore.

Indonesia's director of immigration investigation and law enforcement, Syaiful Rachman, said yesterday that if the men were returned to Indonesia they would be sent immediately to Sri Lanka.

"It could change, but principally, they cannot stay here in Indonesia," he said.

Refugee group Project SafeCom said the men should not be sent to Indonesia, citing concerns that Sri Lanka's ambassador to Jakarta had faced allegations of human rights abuses and would be able to obtain the men's personal details, potentially endangering their families.

"Their names and details would be shared with Sri Lankan high commissioner Janaka Perera, who was under a cloud when he was the high commissioner designate to Australia some years ago," spokesman Jack Smit (Smit) said.

Opposition immigration spokesman Tony Burke said the two Indonesians on board the asylum seekers' fishing boat appeared to be smugglers, and they should be charged.

On February 24, the Refugee Council of Australia called on PM John Howard’s government to grant “full and fair hearing” in Australia to any claims for asylum by a group of 83 Sri Lankans rescued off Christmas Island by an Australian naval ship.The 83 Sri Lankan men and two Indonesian men, whose wooden-hulled boat sank on February 21, were being taken to the Christmas Island and classified as “offshore entry people” under the migration act, immigration minister Kevin Andrews announced on February 24.

He told journalists that the men would be accommodated temporarily on Christmas Island while health checks and information gathering processes continued, and that they would not be brought to the mainland.

The Fairfax press reported earlier that same day that “Sri Lanka’s ambassador to Indonesia, Janaka Perera, last night confirmed Australian and Indonesian officials had told him the 83 men would be returned to Jakarta, then sent home.” This would be a move in violation of international refugee conventions.

“Australia cannot, as suggested in press reports today, consider returning any asylum seekers to Indonesia and then to Sri Lanka without giving them a chance to put their case for protection”, Refugee Council president John Gibson told media.

Gibson said: “The 30-year conflict in Sri Lanka has rapidly worsened in the past year. In December, UNHCR appealed to governments around the world to give asylum claims from Sri Lankan citizens a fair hearing, in view of the bombings, terrorist attacks, extra-judicial killings, abductions, rapes, communal violence and other forms of persecution taking place in many parts of the country.

“In October, a research team from Melbourne’s Hotham Mission visited Sri Lanka and documented the widespread nature of the human rights abuses occurring within the country.

“The conflict between government forces, the Tamil Tigers and other factions has led to more than 500,000 Sri Lankans becoming internally displaced. Another 16,000 people have fled to India in the past year.”

83 Asylum seekers will face persecution – if returned to Sri Lanka,Australian Tamils fear

ABC’s correspondence Geoff Thompson revealed in his report filed today that, 83 Sri Lankans will transit through Indonesia and be sent back to Sri Lanka in a deal cut by Governments of Australia, Indonesia and Sri Lanka. Major Gen. K.J.C. Perera, Head of Sri Lankan Mission in Indonesia, is believed to the key man in striking this deal and who is alleged to be a war criminal, master minded the well documented massacre of hundreds of innocent minority Tamils. Australian Tamils fear that majority of asylum seekers would be minority tamils who flee the country due the escalating extra-judicial killings and abductions by Sri Lankan military forces and face persecution, if returned.

Hundreds of Jaffna residents said to have been tortured to death or deliberately killed in military custody and buried in mass graves in the Chemmani area by troops under General Janaka Perera's command during 1996.

In 1996 Amnesty International issued a statement over the weekend criticising Australia's decision to accept General Janaka Perera as Sri Lankan High Commissioner for Australia. "By making this appointment they are disregarding their international obligations as state parties to the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatement," Amnesty said, adding that several allegations against General Perera, who commanded the elite 53 Special Forces Division, were under investigation by commissions in Sri Lanka.

"Amnesty International understands that in relation to at least some of these cases, the commission has recommended further investigation with a view to prosecution," Amnesty said.

Returning Sri Lankan asylum seekers a threat to global refugee system - Senator Kerry Nettle

Greens Immigration and Multiculturalism Spokesperson, Senator Kerry Nettle, today warned the government that if they attempted to return the Sri Lankan asylum seekers on Christmas Island to Sri Lanka they would be threatening the integrity of the worldwide refugee protection system."The world is watching what Australia is doing on this issue," Senator Nettle said.

"If the government negotiates with the government of Sri Lanka and has these asylum seekers returned, they will send a message to the rest of the world that refugee conventions can be ignored.

"The government needs to reveal who it has been negotiating with about the fate of the asylum seekers.

"The current Sri Lankan Ambassador Janaka Perera is suspected of having committed war crimes against the Tamil community, and is reported as being in contact with Australia about the fate of these asylum seekers.

"Australia should not be seeking to return these men to Sri Lanka. Australian should not be discussing the details of Tamil asylum seekers with any Sri Lankan officials let alone those suspected of committing war crimes.

"Australia should take our responsibilities under the Refugee Convention seriously and bring them to Australia to live in the community whilst their claims for asylum are assessed."

Amnesty International is extremely concerned by reports that 83 Sri Lankan men may be returned to their country without having their claims for asylum assessed.

As a signatory to the 1951 Refugee Convention, Australia must allow these men to seek asylum and be processed in accordance with Australian law.

Current reports suggest that the Australian Government is making arrangements with Indonesian authorities to have the men returned to Indonesia and then on to Sri Lanka.

This is despite recent reports from the UNHCR highlighting the deteriorating human rights situation in Sri Lanka, and calls for governments not to send asylum seekers back at this time.

“Amnesty International is appalled by the prospect that the asylum seekers appear to be faced with a situation potentially worse than remote and indefinite detention,” says Refugee Coordinator Graham Thom.

The new Immigration Minister, Kevin Andrews has stated that the Australian Government will not breach its international obligations.

However, returning people to a place where they face potential human rights abuses is a clear breach of the 1951 Refugee Convention.

“Until the claims of each individual are properly heard it cannot be known whether or not the men would face human rights violations in Sri Lanka. A complete and fair process of assessment must be carried out before Australia can be sure that it not breaching its international obligations,” says Graham.

The Australian Government announced on Friday 23 February they had intercepted a boat carrying 83 Sri Lankan men traveling from Indonesia.

The refugees are currently being detained on Christmas Island. They do not have full access to Australian legal processes or representation, the Australian community, media or refugee advocates.

Amnesty International Australia calls for the asylum seekers to be given prompt access to a fair decision making process. This should include administrative and judicial review as well as access to independent advice and support.

சட்டவிரோத குடியேற்ற வாசிகள் விடயத்தில் கடும்போக்குக்கொண்ட ஆஸ்திரேலிய அரசு இந்த அகதிகள் 83 பேரையும் இந்தோனேஷியா வழியாக மீண்டும் இலங்கைக்கு அனுப்புவதற்கு நடவடிக்கை எடுத்து வருகிறது. இந்நிலையில், மீண்டும் திருப்பி அனுப்பப்பட்டால் அங்கு தாங்கள் கடத்தப்படவும், கொலை செய்யப்படவும் கூடும் என்று தஞ்சம் கோரும் இலங்கையர்கள் கூறியிருக்கின்றனர். பெரும்பாலும் இளவயதினரான இவர்கள் அனைவரும் இலங்கையின் வடக்கு கிழக்குப் பிரதேசத்தைச் சேர்ந்தவர்கள் என்பதும், மாணவர்கள் பலரும் கூட அவர்களுள் அடங்கியுள்ளனர் என்பதும் தெரியவந்துள்ளது.

இலங்கையில் தங்கள் உயிருக்குப் பாதுகாப்பு இல்லை என்று இவர்கள் கூறியிருப்பதை இலங்கை அரசு மறுத்திருக்கின்றது. பொருளாதார நலன் கருதி வெளிநாட்டில் தஞ்சம் கோர இவர்கள் முற்பட்டுள்ளனர் என்றும், இலங்கை நிலைமை தொடர்பாக இவர்கள் தெரிவித்திருக்கும் கூற்று ஆதாரமற்றது என்றும் இலங்கையின் சுகாதாரத்துறை அமைச்சர் நிமல் சிறிபால டி சில்வா தெரிவித்திருக்கிறார்.

அகதிகள் என்று கூறுவது உண்மையல்ல

""இவர்கள் தங்களை அகதிகள் என்று கூறுவதில் உண்மை இல்லை என்றே நான் நினைக்கிறேன். இவர்களுக்குப் பின்னால் விடுதலைப் புலிகள் செயற்படுகின்றனர் என்று சந்தேகிக்கிறோம். இவர்கள் உண்மையிலேயே அகதிகளாக இருந்தால் இலங்கைக்குக் கிட்டிய தொலைவிலுள்ள இந்தியாவுக்குச் சென்றிருப்பார்கள்.'' என்றும் நிமால் சிறிபால டி சில்வா கூறியிருக்கின்றார்.

83 இலங்கையர்களையும் திருப்பி அனுப்புவதற்கு அழுத்தம் கொடுப்பதற்காக நிமால் சிறிபால டி சில்வா தலைமையிலான இலங்கை நாடாளுமன்ற உறுப்பினர் குழு ஒன்று நேற்று ஆஸ்திரேலிய வெளிவிவகார அமைச்சர் அலக்ஸ்ஸாண்டர் டௌணரையும், அந்நாட்டின் சட்டமா அதிபரையும் சந்தித்துப் பேச இருந்தது.

தஞ்சம் கோரிய 83 பேரையும் இலங்கைக்கு திருப்பி அனுப்புவதற்கான முயற்சியில் முன்னாள் படை அதிகாரியும் இந்தோனேஷியாவுக்கான இலங்கையின் தூதருமாகிய மேஜர் ஜெனரல் ஜானக பெரேராவும் தீவிரமாக ஈடுபட்டிருக்கிறார் என செய்திகள் தெரிவிக்கின்றன.

""தாங்கள் தாயகத்துக்குத் திருப்பி அனுப்பப்படுவது குறித்து அகதிகள் அஞ்சவேண்டியதில்லை. அவர்களது பாதுகாப்பு உறுதி செய்யப்படும்'' என்று தூதர் ஜானக பெரேரா பி.பி.ஸிக்குத் தெரிவித்திருக்கிறார்.

சட்டவிரோத குடியேற்றவாசிகளை நாட்டினுள் அனுமதிப்பதில்லை என்ற தனது கொள்கையில் ஆஸ்திரேலிய அரசு உறுதியாக இருக்கிறது என்று அந்நாட்டின் குடிவரவுத் திணைக்கள அதிகாரி உறுதிபடத் தெரிவித்திருக்கிறார். அந்நாட்டுப் பிரதமர் ஜோன் ஹவார்ட்டும் இதனை உறுதிசெய்திருக்கிறார். எனினும் இலங்கைக்குத் திருப்பி அனுப்பப்படும் பட்சத்தில் இவர்களது பாதுகாப்பு நிலைமை எவ்வாறு இருக்கும் என்பதை சுயாதீன தரப்புகள் ஊடாக உறுதிபடுத்திய பின்னரே பெரும்பாலும் அகதிகளை ஆஸ்திரேலியா திருப்பி அனுப்பும் என்று கூறப்படுகிறது.

83 பேரும் இந்தோனேஷியாவுக்குத் திருப்பி அனுப்பப்பட்டாலும் சட்டவிரோத குடியேற்றவாசிகள் தொடர்பான சர்வதேச உடன்படிக்கைகளில் அந்நாடு சம்பந்தப் பட்டிருக்கவில்லை. எனவே இந்த அகதிகளை இலங்கைக்குத் திருப்பி அனுப்பவேண்டிய கட்டாயம் இந்தோனேஷிய அரசுக்கு கிடையாது.

இந்தப் பின்னணியிலேயே அகதிகளை மீண்டும் எப்படியாவது இலங்கைக்குத் திருப்பி அழைத்துவிட இலங்கை அரசு தீவிரமாக முயன்று வருகிறது என்று விடயமறிந்த வட்டாரங்கள் தெரிவித்துள்ளன

அரசியல் தஞ்சம்கோரி ஆஸ்திரேலியாவுக் குச் செல்வதற்காக மேலும் பல இலங்கைத் தமிழர்கள் இந்தோனேசியாவில் காத்தி ருக்கின்றனர் எனத் தகவல் வெளியாகி இருக்கின்றது.

சுமார் 150 இலங்கையர்கள் இவ்வாறு ஆஸ்திரேலியாவுக்கு கடத்தப்படுவதற்கா கக் காத்திருக்கின்றனர் என்று இந்தோனே சியாவின் உள்ளூர் பத்திரிகை ஒன்றில் தக வல் வெளியாகி இருக்கின்றது.

ஆனால், இந்தோனேசிய நாட்டு குடி வரவு அதிகாரி ஒருவர் இதனை மறுத்திருக்கின் றார். புதிதாக இலங்கை யர்கள் எவரும் ஆஸ்திரேலியாவுக்கு கடத்தப்படுவதற்குத் தயாராக உள்ளனர் என்பதை தாம் அறிய வில்லை என்று அந்த அதிகாரி தெரிவித் தார்.

""இந்தோனேசியாவினுள் சட்ட ரீதியா கவும், சட்ட விரோதமாகவும் இலங்கையர்கள் பலர் வருகின்றனர். அவர்கள் இங்கிருந்து வெளியே செல்ல பல வாயில்கள் உள்ளன. அவ்வாறு செல்வது சாத்தியமாகவும் உள் ளது. இதற்கு முன்னரும் இலங்கையர்கள் பலரை நாம் பிடித்திருக்கின்றோம். அவர் கள் மகசார் (ட்ச்டுச்ண்ண்ணூ) பகுதியில் தங்கவைக்கப்பட்டனர்.''

இவ்வாறு குடிவரவுத் திணைக்களப் பேச்சாளர் தெரிவித்தார்.

இலங்கையில் தாங்கள் கடத்தப்பட்டுக் கொல்லப் பட்டு விடுவார்கள் என அஞ்சி மேலும் பல தமிழர்கள் இந்தோனி சியா ஊடாக ஆஸ்திரேலியா செல்லக்காத்திருக் கின்றனர் என்று பத்திரிகைச் செய்திகள் கூறுகின்றன.

Tamils reject economic refugee claims

REPRESENTATIVES of the Tamil community have rejected claims by a Sri Lankan Government minister that 83 asylum seekers are economic refugees.

Health Care Minister Nimal Siripala de Silva admitted he knew little about the Sri Lankan men, but said: "If they are in fear of their life, they should have run to India, which is 16 or 20 kilometres from Sri Lanka, so how could they finance such a large venture?"

Speaking to the ABC in Canberra, he said the men should be sent home. He guaranteed they would not be persecuted.

Greens senator Kerry Nettle said one reason the students had not fled to India was that asylum seekers sailing for India were stopped and put in the Sri Lankan army.

Tamil separatists in the north of the country have been fighting for more autonomy from the majority Sinhalese population, and a recent ceasefire has been repeatedly breached.

Sources from Australia's Sri Lankan community said the students fled attacks by security forces.

In the most recent incident, Tamil student Krishnan Kamalathas, 24, was shot dead 10 days ago by the Sri Lankan army while on his way to a tutorial near Jaffna University.

Dr Noel Nadson, editor of the Sri Lankan community newspaper Uthayam, said the university had been closed for six months by security forces because of the number of Tamil students coming from areas controlled by the separatist Liberation Tigers of Tamil Eelam. Security forces considered them Tamil Tiger supporters.

The chairman of the Australasian Federation of Tamil Associations, Ana Pararajasingham, said yesterday it was not just students but the Tamil intelligentsia who were under threat.

Australians for Human Rights of the Voiceless wrote to Immigration Minister Kevin Andrews yesterday, saying: "Many other persons, in desperation, are escaping to India and other countries due to human rights violations and abductions taking place in Sri Lanka."

Jakarta refuses to take Sri Lankans

Australia'S plan to send 83 Sri Lankan asylum seekers to Indonesia appears certain to collapse, with Jakarta rejecting calls that it should allow them to make asylum claims.

The men will be sent to detention on Nauru unless the Howard Government does an about-face and allows them to be processed on Christmas Island - where they have been held since their boat was intercepted last week.

Immigration Minister Kevin Andrews has said transferring the Sri Lankans back to Indonesia - where they sailed from - was "not an option" if they were not allowed to make claims there through the UN High Commissioner for Refugees.

Mr Andrews' comments caused confusion in Jakarta.

Last Friday, Australian officials proposed the 83 be sent to Jakarta, then quickly repatriated to Sri Lanka to avoid asylum claims being lodged. The Sri Lankan Government was also told and endorsed the plan.

Yesterday, Indonesian Foreign Ministry spokesman Desra Percaya said Indonesia was only willing to receive the asylum seekers "in transit" to Sri Lanka.

"We are not ready to process or screen the asylum seekers," Mr Percaya said.

Indonesia could not assess the men or allow access to the UNHCR as it was not a party the UN refugees convention, he said.

The UNHCR official responsible for asylum cases in Indonesia, Shinji Kubo, said "it's getting extremely unlikely Australia would send these people back to Indonesia". Simply sending the men back to Sri Lanka without considering their claims was not acceptable or appropriate, Mr Kubo said.

Australia is continuing to discuss repatriating the 83 with Sri Lankan officials.

The head of Indonesia's Foreign Ministry, Imron Cotan, said Indonesia wanted to help Australia but was not prepared to allow more asylum seekers to remain in Indonesia.

The Sri Lankans would only be allowed to stay for a short period.

"We don't want them in Indonesia for years and years," he said.

Hundreds of asylum seekers were already staying in Indonesia while they were being processed or attempting to find a country to resettle them, and were "already causing problems", Mr Cotan said.

Indonesia was awaiting Australia's decision, but Mr Cotan said he understood talks were also taking place with the Government of Nauru.

இலங்கையில் சிறுபான்மைத் தமிழர்களுக்கு எதிராக மிக மோசமான மனித உரிமை மீறல் சம்பவங்கள் (15 மாதத்தில் 4,000 பேர் கொலை) இடம்பெற்று வருகின்றன.

காணாமல்போதல் (எட்டு மணித்தியாலயத்திற்கு ஒருவர்), துணை இராணுவக் குழுக்களினால் மேற்கொள்ளப்படும் சிறுவர்களைப் படைகளுக்குச் சேர்த்தல் என்பவற்றால் 4 இலட்சம் பேர் உள்நாட்டில் இடம்பெயர்ந்துள்ளதுடன் 40,000 பேர் அகதிகளாக இந்தியாவுக்குச் சென்றுள்ளனர்.

இதன் ஒரு கட்டமாகவே 85 தமிழர்கள் அவுஸ்திரேலியாவுக்கும் வந்துள்ளனர். இவர்களை அவுஸ்திரேலியாவில் தங்க அனுமதிக்க வேண்டும்.

இவர்களை இந்தோனேசியாவுக்கான இலங்கைத் தூதரும் போர்க்குற்றவாளியுமான மேஜர் ஜெனரல் ஜானக பெரேரா அல்லது இலங்கை அரசிடம் கையளித்தால் இவர்கள் மிக மோசமான ஆபத்துகளை எதிர்கொள்ள வேண்டியிருக்கும்.
