Breaking News: No Failed Tamil Asylum Seeker Can Be Removed

Scores of Sri Lankans, due to have been deported from the UK on a government charter flight on Thursday , have had their removal orders overturned by high court judges, a short while ago. 

High Court has held that no Tamil Asylum seeker can be removed by Charter flight tomorrow. Home Office is appealing the matter to Court of Appeal.

In a landmark ruling, the High Court have issued an order staying the removal of ALL Tamil failed asylum seekers, who are to be removed on a UKBA charter flight to Sri Lanka at 1600hrs tomorrow, pending the Upper Tribunal’s Country Guidance case concerning the risk on return to Sri Lanka.

Mr Justice Wilkie sitting with Judge Gleeson stated ” in my judgment the situation which is presented to the Court today, is virtually unique. It arises from the very particular circumstances of the timing of the decision to remove these Claimants by charter flight at the very time that the Upper Tribunal (Immigration and Asylum Chamber) [uTIAC] is actively seized with considering new country guidance at a time when it is clear from the agenda that the UTIAC is considering the matter virtually afresh and where it is accepted by the SSHD through the preliminary closing submissions that the existing country guidance case will have to change.That position is one which this court cannot simply blind itself to…”

Tamil deportations from UK blocked by London High Court

Protest by UK Tamils against the Sri Lankan government in June 2012 Tamils in the UK regularly demonstrate against the Sri Lankan government's rights record.

The High Court in London has blocked the deportation of a group of failed Tamil asylum seekers scheduled to be sent back to Sri Lanka on Thursday.

The ruling means they will be able to remain in the UK pending investigations into their contention that they will be tortured if they are made to return.

The UK Border Agency told the BBC that it was "disappointed" by the ruling, and that it would appeal.
