இந்த வாரக் குமுதம் இதழில் ஏன் ‘ஓ’ பக்கங்கள் இல்லை என்று கேட்டு பல வாசகர்களிடமிருந்து எனக்குத் தொலைபேசி, மின்னஞ்சல்கள் வந்த வண்ணம் உள்ளன. இனி வரும் குமுதம் இதழ்களிலும் ‘ஓ’பக்கங்கள் வெளி வரா.காரணத்தை அறிய இந்த இரண்டு கடிதங்களைப் படியுங்கள்.

கடிதம் 1 :

அன்புக்குரிய டாக்டர் ஜவஹர் பழனியப்பன் அவர்களுக்கு

வணக்கம்.

சென்ற வாரம் குமுதம் ஆசிரியர் திரு ப்ரியா கல்யாணராமனுக்கு அனுப்பிய என்மின்னஞ்சல் கடிதத்தினைக் கீழே தருகிறேன். ஏற்கனவே அதை உங்கள் பார்வைக்கு வைக்கும்படி அவரிடம் சொல்லியிருந்தேன்.

இந்த வாரமும் நிலையில் மாற்றம் ஏதுமில்லை. இந்த வாரக் கட்டுரையில் சவுக்கு இணையதளம் பற்றிய சில பகுதிகளுக்கு நம்மிடம் ஆதாரம் இல்லாத நிலையில் அவற்றை வெளியிடஇயலாது என்று நீங்கள் கூறியதாக ஆசிரியர் குழுவிலிருந்து டாக்டர் திரு மணிகண்டன்இன்று மாலை என்னிடம் தொலைபேசியில் தெரிவித்தார். இது எனக்கு உடன்பாடானதல்ல.குமுதத்தில் வெளிவரும் எல்லாமே ( அரசியல், சினிமா கிசு கிசு செய்திகள் உட்பட)தங்கள் வசம் ஆதாரங்கள் இருப்பதால்தான் வெளிவருகின்றன என்று இப்போது அறிவதுஎனக்கு இன்ப அதிர்ச்சியாக இருக்கிறது.

என் கட்டுரையில் சவுக்கு இணையதளத்தில் சில முக்கியமானவர்களைப் பற்றிகுற்றச்சாட்டுகள் வைக்கப்பட்டுள்ளன என்றுதான் நான் எழுதியிருக்கிறேனே தவிர,அந்த காவல் அதிகாரிகள், பத்திரிகையாளர் யார் பெயரையும் நான் குறிப்பிடவில்லை.அந்த இணையதளம் ஒளிநகல்களை வெளியிட்டுள்ளது என்று குறிப்பிட்டபோதும் நான்பெயர்களைக் குறிப்பிடவில்லை. அந்த செய்திகள் எல்லாம் உண்மையாகஇருக்கும்பட்சத்தில் நம் கவலைக்குரியவை என்றே நான் எழுதியிருக்கிறேன். அந்தஇணையதளத்தின் மொழி நடை எனக்கு உடன்பாடானதல்ல என்றும் குறிப்பிட்டிருக்கிறேன்.இதை விடப் பொறுப்பாக ஒரு விமர்சகன் எழுத முடியாது.

இப்படிப்பட்ட சூழ்நிலையில் தொடர்ந்து நான் என் ‘ஓ’ பக்கங்களை குமுதம் இதழில்எழுத விரும்பவில்லை. எந்த முன் தணிக்கையும் இல்லாமல், என் கருத்துச்சுதந்திரத்துக்கு மதிப்பளித்து நான் எழுதியவற்றை நீக்காமல், மாற்றாமல்,முழுமையாக வெளியிடும் சூழலில் மட்டுமே என்னால் எழுத முடியும். தங்கள் இதழின்தேவைகளுக்காக என் 35 ஆண்டு கால வாழ்க்கை, தொழில் நெறிகளில் நான் சமரசம் செய்துகொள்ள இயலாது.

இப்போது தங்களிடம் இருக்கும் என் கட்டுரையை முழுமையாக வெளியிட இயலாதென்றால்,

அதில் எந்தப் பகுதியையும் வெளியிடவேண்டாம்.

”குமுதத்தின் எடிட்டோரியல் பாலிசியுடன் ஏற்பட்ட கருத்து வேறு பாட்டினால் ஞாநிஇனி குமுதத்தில் ‘ஓ’ பக்கங்களை எழுத இயலாது என்று தெரிவித்திருக்கிறார்.” என்றஅறிவிப்பை வெளியிடுமாறு கேட்டுக் கொள்கிறேன்.

கடந்த சுமார் மூன்று ஆண்டுகளாக என் பத்தியை வெளியிட்டு லட்சக் கணக்கானவாசகர்களிடம் என் கருத்துகளை கொண்டு சேர்த்தமைக்காக உங்களுக்கும் இதழின்

தொடர்ந்து கடந்த மூன்று மாதங்களாக என் ஓ பக்கங்கள் கட்டுரையில் தங்கள்அலுவலகத்தின் குறுக்கீடு என் கருத்துச் சுதந்திரத்தில் தலையிடுவதாகஅமைந்துள்ளது. தி.மு.க, ஆட்சி, அதன் தலைவர், அவரது குடும்பத்தினர் சார்ந்தபொது வாழ்க்கை விஷயங்கள் பற்றியெல்லாம் விமர்சனங்கள் செய்யவேண்டாம் என்றுவேண்டுகோள் தொடர்ந்து என்னிடம் வைக்கப்பட்டது.ஓரிரு வாரங்களில் நிலைமைசரியாகிவிடும் என்று சொல்லி என்னை சமாதானப்படுத்தி வந்தீர்கள். மூன்றுமாதங்களாகியும் நிலைமை அவ்வாறே உள்ளது.

இன்றும் என் கட்டுரையில் காமராஜர் நினைவிடத்தில் அணையாவிளக்கு வைப்பதாகமுதல்வர் அறிவித்தது பற்றி நான் எழுதிய விமர்சனம் நீக்கப்படுவதாக்தெரிவித்திருக்கிறீர்கள். இது எனக்கு உடன்பாடானதல்ல.

எனவே முழு சுதந்திரத்துடன் எழுதும் வாய்ப்பில்லையென்றால் நான் குமுதத்தில் ‘ஓ’பக்கங்களைத் தொடர்ந்து எழுத விரும்பவில்லை. இப்போது தங்களிடம் இருக்கும் என்கட்டுரையையும் முழுமையாக வெளியிட இயலாதென்றால், அதில் எந்தப் பகுதியையும்

வெளியிடவேண்டாம்.

a letter to sonia gandhi about nalini's release

i write this letter to you as one of the intellectuals and writers of tamilnadu who have been seeking on humanitarian grounds ,release of Ms.Nalini now serving life imprisonment for her role in the assassination of your husband Mr.Rajiv Gandhi

I am not a supporter or sympathiser of LTTE. While I support the cause of Eelam Tamils for equal rights in Srilanka, I do NOT support LTTE. I am one among the crores of tamils who gave up whatever little respect they had for LTTE when it assassinated your husband.

I am one of those who believe that capital punishment is not a solution for any crime. And therefore I strongly condemn the arguement of some people that Mr.rajiv gandhi was given death sentence by LTTE for his political mistakes. I also strongly oppose the death sentence awarded to assassins of Rajiv Gandhi by Indian courts. I believe that the highest punishment for any crime can only be a lengthy imprisonment.

Therefor my regard for you went up when you intervened to reduce the dedath sentence awarded to Nalini to life imprisonment. On knowing about your daugghter Ms.priyanka's meeting with Ms.Nalini in prison , my esteem for your family's civility went up.

In continuation of such commendable behaviour, I now seek your support for the demand to release Ms.Nalini who has spent 19 years in prison now.

The power to take such a decision solely rests under lw only with the Government of Tamilnadu. Despite this being beyond your jurisdiction. I make this demand since your intervention has become a critical necessity. By normal process I should have addressed this letter to your alliance partner DMK President and Tamilnadu Chief Minister Mr.karunanidhi.

But he has made it very clear to the people through his continuous actions that he does not want to release Ms.Nalini. Her various applications were met with inordinate delay in disposal, actions by the government demanded by the courts were also deliberately delayed . And through such delaying tactics, he has been denying justice to Ms.Nalini all along. Why has he been doing so ?

The Constitution of India has bestowed the powers on the state government to decide whether a life convict could be released after serving 14 years in prison based on the good conduct of the convict. Ms.Nalini has appealed for release under this provision.

Ms.Leelavathi, a municopal councillor of the Marxist party who fought for provision of drinking water to poor people was murdered by members of Mr.karunanidhi's party. The assassins were convicted by the court. But they have all been released from prison during the centenary celebrations of Anna, even before they completed even ten years of imprisonment. More than a thousand life convicts who did not complete ten years of imprisonment have been released. But Mr.karunanidhi is refusing to release Ms.Nalini who has spent 19 years in prison.

The reasons for refusal stated by his government in the court are rather strange.

1. The Tamilnadu Government said Nalini's offence was grave and severe. Are not all murders grave and severe offences ? The murders by the thousands of convictfs released within ten years of imprisonment also must have been grave and severe.

2. Nalini could not be said to have changed her attitude simply because she has spent her time in prison studying a post graduate degree and diploma,the government has said.

A prisoner tryingto qualify herself as a spost graduate and a diploma holder while in prison must be seen as a sign of her trying to restructure her life henceforth. She should be appreciated for foucssing her energies on education while in prison.

3. She has not expressed regret for her actions, the government has argued.

Did the thousands of life convicts released by the karunanidhi government express regret for their actions ?

4. the government has further stated that if released Ms.naini would live with her mother, earlier released in this case, in her house in Royapettah in Chennai. Since Royapettah is an area where several VIPs live besides housing US consulate, the government has expressed apprehension that Nalini living there would create a law and order problem.

It is obvious that there is no law and order issue involved since Nalini's mother has been living there all along and no law and order issue has happened because of her so far. If necessary, the government could stipulate a condition that Nalini should live elsewhere and not take part in public political activities by joing any party.

The government has also argued that the psychiatrist has cleared Nalini after examining her but there are no sufficient grounds to release her on that basis.

It must be noted that the other thousands of prisoners released by the karunanidhi government have not been examined by Psychiatrists. In Nalini's case, there is nothing in the psychiatrist's report to deny her release either.

And yet, karuanidhi's government refuses to release Nalini.

And you are said to be the reason for such refusal.

Several tamil magazines have written that Karunanidhi feels you may not like the release of Nalini and if he ordered release it may weaken his alliance with your party. So far karunanidhi has not denied such reports. I do not know if you are even aware of scuh reports.

The statement by karunanidhi's government before the court of law gives credence to the speculation that he fears your wrath in this issue.

His government's advocate has told the court that the state government had every right under section161 of the constitution to decide the release. But the government imposed certain self restrictions in this case on its own. The state government decided not to act in this issue without consulting the central government, the advocate said.

I have addressed this letter to you soleley for this reason.

Did the tamilnadu government c onsult the centre ? What did the centre say ? Did they consult you ?

These issues must be clarified before the court of law. Thye must also be made public to clarify the doubts in the minds of the people.

And you must be able to throw light on this. Because scores of people in Tamilnadu think Nalini after having spent 19 years in prison should now be allwoed to come out and lead a peaceful personal life with her daughter.

And all Karunanidhi government's actions so far in this issue have created an opinion that you are the obstacle to such a possibility for Nalini.

I however believe that you who had intervened to reduce the death sentence to life imprisonment for her will not be an obstacle to her lawful release now.

I therefore have only one request to you.

If you have no objection to Nalini's release, please send a letter to karunanidhi with just only one sentence - I have no objection if Tamilnadu government decides to set Nalini free.

You may agree that principles of natural justice and human compassion demand Nalini be released having spent 19 years in prison. I fervently wish you agree.
