Investigate War Crimes in Sri Lanka

Although Sri Lanka�s civil war ended 18 months ago, justice and accountability have yet to be achieved. Sri Lanka has failed to investigate accusations of war crimes, for which abundant evidence exists. Unless the international community and the International Criminal Court seriously pursue investigating Sri Lanka�s war and post-war abuses, the culture of impunity will continue to prevail.

In June 2009, one month after the war�s end, President Mahinda Rajapaksa promised UN Secretary General Ban Ki-moon that the Sri Lankan government would investigate allegations of war crimes and human rights violations. However, it has not made a sincere attempt to do so. In fact, the ruling Rajapaksa dynasty continues to deny any civilian deaths during the war�s final stages, claiming that the 7,000 dead were all militants. Moreover, the recent elimination of term limits on Sri Lanka�s presidential terms formalized the president�s already excessive executive powers, thus furthering his ability to indefinitely postpone justice.

Sri Lanka�s Lessons Learnt and Reconciliation Commission fails to meet international standards of independence, impartiality, and adequacy. Now, the Tamil people�s only form of redress lies with the international community.

There is evidence of 12 counts of genocide against Sri Lanka�s indigenous Tamil population, as reported to the ICC by Tamils Against Genocide (TAG). US citizen Gotabaya Rajapaksa, Defense Secretary of Sri Lanka who is also the president�s brother, and US permanent resident Sarath Fonseka, former Commander of the Sri Lankan Army during the end of the civil war, have been charged with 12 counts of genocide and 106 counts of war crimes and torture under TAG�s model indictment.

The Sri Lankan government is concerned with preserving its political power, not investigating allegations of war crimes, crimes against humanity, and genocide. TAG�s model indictment provides hundreds of pages of evidence that is sufficient enough to warrant an inquiry into Sri Lanka�s crimes. Please initiate such an investigation and end impunity for Sri Lanka�s war criminals in order to ensure that accountability is upheld.
