Sri Lanka and war crimes

Will the Sri Lankan government be able to shrug off the persistent allegations that war crimes were committed, in its successful assault on the Tamil Tigers (LTTE) in 2009? I have always assumed that the answer to that question was – probably Yes. But now I’m beginning to wonder.

Finally, Sri Lanka is a small country. If India, its own vast neighbour was prepared to turn a blind eye to accusations of human-rights abuses, the West would probably follow the Indian lead.

Ac­cord­ing to a re­cent re­port by the Unit­ed Na­tions, ap­prox­i­mate­ly 40.000 civilians died ac­cord­ing dur­ing this phase of the con­flict. Since Septem­ber 2009, Dias has been an ac­credit­ed di­plo­mat in the Sri Lankan em­bassy in Ber­lin for Ger­many, Switz­er­land and Vat­i­can.

In Sri Lanka, Libya, Bahrain and elsewhere, human rights abuses are being recorded and the evidence is on the internet

But the documentary appeared to provide compelling evidence that Sri Lankan government forces massacred prisoners, that civilian hospitals were shelled and that female Tamil fighters were sexually assaulted before being killed.

The shaky video captured on mobile phones represents a modern-day version of Goya's Disasters of War prints, which recorded in harrowing detail Spain's bloody battle with Napoleonic France and which were considered so shocking they remained unpublished for more than three decades after the artist's death. David Cameron spoke for many who saw the documentary when he called for the UN to launch an investigation.

So far, the allegations of war crimes committed in the name of the Sri Lankan government have not received the international attention they deserve. Sri Lanka, anxious to put the trauma of its civil war behind it, has yet to provide a full account of its role in alleged atrocities, and the world's attention has been elsewhere. But what happened in Sri Lanka in those nightmarish days of 2009 has put governments everywhere, dictatorships and democracies alike, on notice. When suppression mutates into war crimes, they will be recorded on mobile phones and disseminated across the web. It will be increasingly difficult for bodies such as the UN to refuse an investigation when billions of people can access compelling evidence of crimes at the click of a mouse .

Investigate war crimes? How, when it’s difficult to find two hard disks!

The international community expects Sri Lanka to investigate allegations of war crimes even while the country is unable to figure out how information pertaining to finances of the ICC Cricket World Cup has gone missing.

Murder, theft, robbery, rape, assault, threat and intimidation, kidnapping, abduction, bribery and corruption-crimes go routinely unpunished in Sri Lanka. All it often takes is a phone call to the police. Sometimes not even that. Still, we do put on an entertaining show. For instance, a Presidential Commission of Inquiry was appointed in 2006 to probe sixteen serious violations of human rights. Among them were the killing of Lakshman Kadirgamar, the murder of seventeen aid workers in Mutur, the shooting of five university students on the Trincomalee beach and the disappearance of Rev. Nihal Jim Brown of Philip Neri’s Church at Allapidi.

This was to be screened inside the UN in New York on June 21, just before a vote is taken in the General Assembly on Ban Ki-moon getting a second five year term as Secretary General. (As of June 15,Ban had not watched the filmAs of June 15, Ban had not watch the film, Nesirky told Inner City Press.)

But now the screening has been moved outside of the UN, to the “Church Center” across the street. Sri Lankan Ambassador Palitha Kohona told Inner City Press he was going to attend the screening if it was inside the UN. Apparently, he will not attend across the street. Of the scenes of extrajudicial execution, he said one cannot prove who is Sinhalese and who is Tamil. There is, of course, a sound track. Watch this site.

Take Action : Sri Lanka’s Killing Fields

There has been a huge response to the film, with over 800,000 viewers tuning in on Tuesday evening and questions asked during Wednesday’s Prime Minister’s Questions. So the film is keeping the issue of war crimes in Sri Lanka on the global agenda. But despite this footage and the recent UN Panel of Experts report showing that there are credible allegations that both the Government of Sri Lanka and the LTTE committed serious war crimes, there has been no serious attempt to bring the criminals on either side to justice - or even to fully investigate what happened. In place of any tribunal, Channel 4 have been the ones collecting, investigating and processing the evidence of war crimes.

This process is doubly important as some of the perpetrators are still in positions of authority, and some of the crimes are still taking place - nearly 4,000 people are being held in camps to which the international community has no access.

The Government of Sri Lanka insists that the footage is fake. But in fact it is genuine, in all its horror: 5 forensic experts commissioned by the UN's High Commissioner for Human Rights have testified that they believe the footage to be authentic.

Now it is the responsibility of the international community to harness the power and horror of this film, to act and demand a war crimes investigation from the UN. For there are global repercussions from the way Sri Lanka’s government is held accountable for its actions. As the film’s director states ‘if the UN fails yet again, the message to every tyrant and repressive government will be clear: if you want to kill your own people with impunity, you will probably get away with it.’

Video might change reader’s mind

Re: These refugees are not victims, Letter June 20

Last Tuesday, Channel 4 TV (Britain) aired a documentary entitled “The Killing Fields of Sri Lanka.” This morning I ran a Google search on that title and found approximately 908,000 hits. I strongly suggest caution in viewing this material. As a physician in a cancer clinic, I have been well acquainted with death, but the visual evidence of murders, torture, and rape of captive Tamil men, women, and children shown in this documentary made me feel physically sick.

Evidently members of the British Houses of Parliament and the United Nations reacted in a similar manner.

In his letter about the proposed human smuggling bill, J. Richard Wright stated, “Let’s be clear about one thing. These so-called refugees are not victims.” Let him first view this documentary and the associated material, and then state plainly that, if he were a Tamil in Sri Lanka, he would never try to bribe his way out of the country, and he would never pay anyone for transport to Canada.

In my opinion, those who succeeded in getting here were very lucky, and most of them should be welcomed with open arms, no matter how they got here.

By the way, there is no queue that refugees can join in Sri Lanka. Refugees who are still living within the borders of Sri Lanka (those who have not yet managed to bribe their way off the island) are not allowed to apply for status at the Canadian High Commission in Colombo. They must first escape from Sri Lanka, and then apply somewhere else.
