Subject: Sri Lanka's attack on students and peaceful demonstrations 

 

Dear UN Representative,

 

Four students from Jaffna University were arrested on December 1st in northern Sri Lanka and three are currently being detained in Vavuniya, where they are at extreme risk for torture and abuse. We are writing to urge their immediate release and to ensure that they are treated in accordance with international standards regarding police detention.

 

Police torture in Sri Lanka is alarmingly prevalent, despite universal legal prohibitions against torture. These students must be freed from potential torture and given access to their lawyers, families, food, blankets and medical care as needed.

 

On Maveerar Naal (Heroes Day) on November 27, Jaffna University students held a peaceful memorial ceremony to remember those killed in Sri Lanka’s war. Security forces violently broke up the ceremony while threatening students and brandishing guns at them. The following day, students organized a silent protest and short march, decrying Sri Lanka’s restrictions on freedom of expression. At least twenty undergraduates, including Sanmugam Solaman, were beaten by security forces.

 

These incidents demonstrate the pervasive climate of repression in Sri Lanka. Freedom of expression, association and peaceful assembly are suffering under an island-wide assault, as attacks against peaceful protesters and journalists continue with institutional impunity. These attacks must cease immediately and their perpetrators must be brought to swift justice.

EU data collecting on victims of VAW

 

Council conclusions on Combating Violence Against Women, and the Provision of Support Services for Victims of Domestic Violence

The Council of the European Union adopted its conclusions on Violence Against Women at its 3206th Employment, Social Policy, Health and Consumer affairs (EPSCO) Council meeting on 6 December 2012. The council calls to consider 2015 as the European Year on Zero Tolerance for Violence against Women.

Strong emphasis is placed to data collecting on victims and perpetrators and to developing of information’ sources. Information concerning violence against women is often hidden which limits understanding of the real extent of problem and its consequences. It also impedes the further development of policies, strategies and actions.

The ministers called on the Members States and the European Commission to develop and implementing action plans, programmes or strategies to combat all forms of violence against women and girls, involving all relevant legislative and non-legislative measures. Concerning the training, the Council calls to provide or strengthen appropriate training for relevant professionals.

 

The Council recommends a European helpline to assist victims of violence against women to be established by Member States and European Commission.

சம்பந்தரின் கட்சியான தமிழரசுக்கு கட்சி 1949 லிருந்து தமிழ் மக்களை பிரதிநிதிப்படுத்துகிறது. இது SLFP சிங்கள மக்களை பிரதிந்திப்படுதுவதிலும் பார்க்க எதனையோ ஆண்டுகள் காலத்திலும், மக்கள் வீத பரிமாணத்தில் பெரியது. தமிழரசுக்கட்சித் தலைவர்கள் தங்கள் மக்களை சரியாக அறிந்துவைத்துகொண்டு தேர்தலில் போட்டியிட்டுவருவதால் அன்றிலிருந்து இன்றுவரை அதன் தலைமைத்துவத்தை யாராலும் தகர்க்கமுடியவில்லை.

 

சிங்கள நாட்டில் சிராணியின் பாடு என்ன?, 18ம் திருதம் ஏன்? 20ம் திருத்தத்தில் அரசு என்ன கொண்டுவரபோகிறது? இன்னமும் எத்தனை திருந்தங்கள் அரசால் கொண்டு வரபடப்போகிறது? பொலிசு ஏன் பாதுகாப்பு அமைசுக்குகீழ்? யார் 13ம் திருத்ததை நிறைவேற்றுவது, திவிகும்ப என்ற சிங்கள பததிற்கு பொருள் என்ன? அதை அரசு தமிழிலும் சொல்லுமா?  என்பவற்றை பற்றி ஆராய்வது சம்பந்தரின் நோக்கமாக இருக்க கூடாது. சர்வேத அபிப்ராயம் மாறுவது என்பதற்காக 13ம் திருத்ததை எற்க முடியாது(13ம் திருத்தத்தை திணித்த இந்தியாவே அதை நிறைவேற்றுவத்தானால் 13+ ஆக் அது  இருக்க வேண்டும் என்பதை ஒத்துக்கொள்கிறது). கூட்டமைப்போ, புலிகள் இயக்கமோ 13ம் திருத்தத்தை ஏற்கவில்லை. ஐக்கிய இலங்கைக்குள் தீர்வு என்பதற்கு அரசு ஒத்து வந்தால் சுயநிர்ணய உரிமையை சம்பந்தர் அரசிடம் கேட்டு வாங்க வேண்டும். 

 

தெரிவுக்கு குழுவுக்கு போவதுதான்நோக்கமாக இருந்தால் சம்பந்தர் பதவியை விட்டு விலகவேண்டும். அதன் பின்னர் சுரேஸ், சிறிதரன் போன்ற தெரிவு செய்யபட்டவர்கள் பதவியை ஏற்று பேச்சுவார்த்தைகளை நடத்த வேண்டும்.

 

பேச்சு வார்த்தைகள் பேச்சுவார்த்தைகளாக இருக்க வேண்டும். தெரிவு குழுவின் நிபந்தனைகளை பேச்சு வார்த்தைகளுக்குள் திணிக்க சம்பந்தர் இடம் கொடுக்க கூடாது. பேச்சு வார்தை முடிய தனது 2/3 பலத்தை வைத்து அதை நிறைவேற்றுவது அரசின் பொறுப்பு. இதை செய்ய அரசு தெரிவுக்குழுவை கருவியாக பயன் படுத்த போகிறதாக இருந்தால் அது அரசின் தீர்மானம் மட்டுமாக இருக்க வேண்டும். கூட்டமைப்பின் விருப்பாக இருக்க கூஈடாது. தெரிவு குழுவில் நடைமுறைப்படுத்துவதற்காக சம்பந்தர் இன்னொரு 13ம் திருத்தத்தை எழுத முடியாது. நீலன் திருசெல்வத்துடன் புலிகள் முரணியத்தற்கு காரணம் இன்னொரு 13ம் திருத்தம் எழுதி, J.R இன் 13ம்  திருத்ததிற்கு, சந்திரிக்காவின் மாற்றீடு காண முயன்றமையேதான். SLFP யாUNP யா தமிழரின் பிரச்சனையை தீர்த்து வைக்க வேண்டும் என்பது நமக்கு தேவை இல்லாத விடையம். சுய நிர்ணய உரிமையை தீர்மானிக்காத போது சம்பந்தர் அரசுடனா பேச்சு முடிவடைந்துவிட்டது என்றை வெளியே வந்து தமிழ் மக்களுக்கும் சர்வதேசத்திற்கும் தெளிவாக அறிவிக்க வேண்டும்.

 

மகிந்தா தனது அண்மைய பேச்சில் தெளிவாக சம்பந்தர் விரைவில் இறந்துவிடுவார்; அதன் பின்னர் கூட்டமைப்புடன் பேச வேண்டும் என்று சர்வதேசம் தனக்கு கொடுக்கும் அழுத்தம் இல்லாது போகும் என்று நசுக்காக சொல்லியிருந்தார். சம்பந்தர் ஜனநாய அமைப்பில் சரிவும் முனேற்றமும் வரும் என்பதை தெரிந்து வைத்திருக்கும் அரசியல் வாதியாகத்தான் இருப்பர். தமிழ் மக்கள் எப்போதும் ஒரு மனத்துடன் கட்சியையும் தலைவரையும் தெரிவு செய்யும் மனபாங்கை காட்டி வருகிறார்கள். இது உலகவழமைகளுக்கு மிகவும் ஆச்சரியமானது. யப்பான் கூட தான் தொடர்ந்து முன்னேறி வந்த காலங்களில்தான் ஒரேகட்சியை தெரிந்து வந்தது. முன்னேறத்தில் சிறிய பின்னேற்றம் கண்டவுடனே கட்சிகளை மாற்ற ஆரம்பித்தது. ஆனால் தமிழ் மக்கள் தமது கஸ்டமான 65 ஆண்டுகாலத்திலும் தமக்கு மாற்றுக்கட்சிதேட வேண்டியதேவையை தமிழரசுக்கட்சி, கூட்டமைப்பு அவர்களுக்கு இட்டுவைக்கவில்லை. எனவே சம்பந்தர் தனக்கு பின் வரபோகும் தலைமையை தமிழர்கள் எப்படி தெரிய போகிறார்கள் என்பதை பற்றிச அதிகம் சிந்தியாமல், தமிழருக்கான உரிமையை வென்றேடுக்க வேண்டும்.

 

தீர்வுக்குழுவில் விமல், சம்பிக்க, மேர்வின் சில்வ,  ரிசாட் பதியுதின், தேவானந்த, சோமவன்ச போன்றவர்களுடன் அமர்ந்து பேசுவதை கனவிலும் நினைக்கக் கூடாது. மகிந்தா பதவிக்கு கொண்டுவந்த சிரானியின் விடயத்திலேயே தான்  தீர்வுக்குழுவை விட்டு வெளியேற வேண்டி வந்தது மட்டுமல்ல, அதனால் பாரளுமன்ற நடவடிக்கைகளால் தண்டிக்கப்பட போகிறார் என்பதையும் சம்பந்தர் மறக்க கூடாது. இனி வரும் தெரிவுக்குழுவில் சம்பந்தர் தண்டிக்கப்பட நேர்ந்தால் அவரின் பதவி போவது மட்டுமல்ல அரசு இவரை பொன்சேக்கா, அமிர்தலிங்கம் மாதிரி அரியலில் இருந்து ஒதுங்க வைக்ககூடத் தயங்காது என்பதை சம்பந்தர் மறக்க கூடாதுதீழ வேந்த நாட்டை விடே ஓடியவர். எனவே பேச்சுவார்த்தைகளில் தமிழரின் உரிமைகளை வென்றேடுக்க முயலவேண்டுமேயல்லாது தவிச்சு தவிச்சு தெரிவுக்குழுவில் ஓடிப்போய் மாட்டி தண்டிக்கப்பட்டு அரசியலில் இருந்து ஒதுக்கிவைக்கப்பட்டுப்போய்விடகூடாது. 

 

இந்த மௌளியின் ஆலோசனைகளை கேட்ட இவர் தமிழ் மக்களுக்கு எந்தவையில் பொறுப்பு கூறத்தக்க நிலையில் தன்னை போட்டிருக்கிறார் என்பது தெரிய வேண்டும். குறைந்தது யாழில் அகுதா வேண்டும் இடிகளுக்கு தக்க அளவிலாவது இந்த மௌளி தன்னை தமிழ் மக்களில் முன்னர் வைக்க தயாராக வேண்டும். அரச பாதுகாப்பு படைகளை விட்டு தேர்தல் கூட்டங்களில் கூட்டமைப்புக்காக மேடை ஏறத் தயாராக வேண்டும். இல்லையேல் மௌளி ஜனநாயக முறைப்படி தனக்கு ஒரு கட்சியை அமைத்து தேர்தலில் கூட்டமைப்பை எதிர்க்க வேண்டும். அது வரைக்கும் கூட்டமைப்பு மௌளியின் பிரதி நிதியாகாமல் தமிழ் மக்களில் பிரதிநிதியாக மட்டும் கடமையாற்ற வேண்டும்.

Subject: Sri Lanka: New Chief Justice, Mr. Mohan Peiris, and independence and impartiality

 

 

Dear UN Representative,

The removal of the Chief Justice through a flawed process is gross interference in the independence of the judiciary and a calamitous setback for the rule of law in Sri Lanka. Chief Justice Shirani Bandaranayke was served notice of her dismissal and removed from her chambers and official residence on 15 January, in spite of a Supreme Court ruling that the parliamentary procedure to remove her violated the Constitution.

 

The jurist sworn in by the President as the new Chief Justice on 15 January, the former Attorney-General and Legal Advisor to the Cabinet, Mr. Mohan Peiris, has been at the forefront of a number of government delegations to Geneva in recent years to vigorously defend the Sri Lankan government’s position before the Human Rights Council and other human rights mechanisms. This raises obvious concerns about his independence and impartiality, especially when handling allegations of serious human rights violations by the authorities.

 

The international community should do all it can to aid the people of Lanka preserve what they have left of 60 years of albeit imperfect democracy before it is shackled further.
