The petition remains open for signature until the White House responds (and they haven't given themselves a deadline for doing so!), so I'd still encourage people to sign the petition while it remains open. We also have a second petition on the AIUSA website on the same subject; this one is targeted at the State Dept. instead of the White House. Accountability for the Alleged Violations of International Humanitarian and Human Rights in Sri Lanka

The United States shares your concern about accountability for the alleged violations of international humanitarian and human rights law that occurred during Sri Lanka's recent conflict and is committed to working with the government of Sri Lanka, the United Nations, and the international community to implement a just and equitable reconciliation process for all Sri Lankans.

At the request of Congress, the Department of State prepared two reports in 2009 and 2010 on alleged violations of international humanitarian law and international human rights law during Sri Lanka's recent conflict. These reports can be found at State.gov. As we noted in both reports, the United States takes these allegations very seriously. We believe individual accountability for such violations is a critical component of reconciliation, and meaningful steps in this regard will advance Sri Lanka's own efforts to heal after decades of conflict.

In the September 2011 session of the United Nations Human Rights Council, we made clear our view that Sri Lanka must adopt measures necessary to achieve national and ethnic reconciliation. We expressed the need for Sri Lanka to quickly and credibly address allegations of violations of international humanitarian law and international human rights law that occurred during the war, regardless of which side committed them. We have highlighted the need for Sri Lanka to take concrete steps, such as providing to family members an account of those missing and detained as well as promptly issuing death certificates for those killed in the conflict. We will continue to urge the government of Sri Lanka to work constructively on these issues with the United Nations and the international community.

Finally, we hope the Government of Sri Lanka will address these reconciliation and accountability issues in a manner commensurate with its international obligations, and we will continue to reiterate to the government of Sri Lanka that, while domestic authorities have primary responsibility to ensure that those responsible for violations of international humanitarian law and international human rights law are held accountable, international accountability mechanisms can become appropriate in circumstances in which a government is unable or unwilling to meet its obligations.

போரின்போது இடம்பெற்ற மீறல்களுக்குப் பொறுப்புக் கூறும் விவகாரத்தில் இலங்கை அரசு தனது கடமையை நிறைவேற்றாத அல்லது நிறைவேற்ற விரும்பாத சூழ்நிலையில் அனைத்துலக விசாரணைப் பொறிமுறையை உருவாக்க முடியும். இலங்கையின் யுத்தக் குற்றங்கள் தொடர்பில் அனைத்துலக விசாரணை ஒன்று அவசியம் என்பதை அமெரிக்கா ஏற்கனவே தெரிவித்துவிட்டது.

இவ்வாறு அமெரிக்க இராஜாங்கத் திணைக்களத்தின் ஜனநாயகம், மனிதஉரிமைகள், தொழிலாளர் விவகாரங்களுக்கான உதவிச்செயலர் மைக்கல் எச்.போஸ்னர் தெரிவித்திருக்கிறார்.

இலங்கையில் இடம்பெற்ற போர்க்குற்றங்கள் தொடர்பாக அனைத்துலக விசாரணைப் பொறிமுறையை உருவாக்கும் விடயத்தில் தலையிடக்கோரும் மனு அமெரிக்க ஜனாதிபதி ஒபாமாவுக்கு இணையத்தளம் மூலம் அனுப்பப்பட்டது. வெள்ளை மாளிகையின் இணையத்தளம் மூலம் இந்தக் கோரிக்கை மனுவில் 5000இற்கும் அதிகமானோர் ஒப்பமிட்டிருந்தனர்.

இந்தக் கோரிக்கை மனுவுக்குப் பதிலளிக்கும் வகையில், மைக்கல் எச்.போஸ்னர் அறிக்கை ஒன்றை வெளியிட்டுள்ளார்.

அதில் மேலும் கூறப்பட்டுள்ளதாவது:

இலங்கையில் அண்மைய மோதல்களின் போது இடம்பெற்ற அனைத்துலக மனிதாபிமான மற்றும் மனிதஉரிமைச் சட்டமீறல்களுக்குப் பொறுப்புக்கூறுதல் தொடர்பான உங்களின் கவலைகளுடன் அமெரிக்காவும் பங்கு கொள்கிறது.

அத்துடன் இலங்கையில் எல்லாக் குடிமக்களுக்குமான நியாயமான நல்லிணக்கத்தை ஏற்படுத்துவதற்கான நடவடிக்கைகளை நடைமுறைப்படுத்துவதற்கு இலங்கை அரசு, ஐ.நா மற்றும் அனைத்துலக சமூகத்துடன் இணைந்து பணியாற்றுவதிலும் உறுதியாக இருக்கிறது.

அமெரிக்க காங்கிரஸ் கேட்டுக் கொண்டதற்கிணங்க, இலங்கையில் அண்மைய மோதல்களின்போது இடம்பெற்ற, அனைத்துலக மனித உரிமை மற்றும் மனிதாபிமான சட்டமீறல்கள் குறித்து 2009 மற்றும் 2010ஆம் ஆண்டுகளில் அமெரிக்க இராஜாங்கத் திணைக்களம் இரண்டு அறிக்கைகளைத் தயாரித்தது.

இதுதொடர்பான இலங்கையின் அர்த்தமுள்ள சொந்த முயற்சிகள் பல பத்தாண்டுகளாகத் தொடர்ந்த மோதல்களால் ஏற்பட்ட காயங்களை ஆற்றுவதில் முன்னேற்றத்தை அளிக்கும். ஐ.நா மனிதஉரிமைகள் பேரவையின் 2011 செப்ரெம்பர் கூட்டத் தொடரின்போது, இலங்கை தேசிய மற்றும் இன நல்லிணக்கத்தை ஏற்படுத்துவதற்கு நடவடிக்கைகளை மேற்கொள்ள வேண்டும் என்ற எமது நிலைப்பாட்டை தெளிவாகக் கூறியிருந்தோம்.

போரின் போது இடம்பெற்ற அனைத்துலக மனிதாபிமான மற்றும் மனிதஉரிமைச் சட்ட மீறல்கள் குறித்த குற்றச்சாட்டுகளுக்கு பக்கம்சாராத வகையில் இலங்கை துரிதமாகவும் நம்பகமாகவும் பதிலளிக்க வேண்டும் என்றும் வெளிப்படுத்தியிருந்தோம்.

காணாமற்போனவர்கள், தடுத்து வைக்கப்பட்டுள்ளவர்கள் குறித்து அவர்களின் குடும்பத்தினருக்கு வெளிப்படுத்துவதற்கும், மோதல்களில் கொல்லப்பட்டவர்களுக்கு மரணச் சான்றிதழ்களை வழங்கவும் இலங்கை உறுதியான நடவடிக்கைகளை எடுக்க வேண்டும் என்று சுட்டிக்காட்டியுள்ளோம்.

இந்த விவகாரங்களில் ஐ.நா மற்றும் அனைத்துலக சமூகத்துடன் இணைந்து இலங்கை ஆக்கபூர்வமான முறையில் பணியாற்ற முன்வர வேண்டும் என்று தொடர்ந்து கேட்டுக் கொள்வோம். இறுதியாக, இலங்கை அரசு இந்த நல்லிணக்க மற்றும் பொறுப்புக் கூறல் விவகாரங்களுக்கு அனைத்துலக கடப்பாடுகளுக்கு அமைய பதிலளிக்கும் என்று நாங்கள் நம்புகிறோம், பொறுப்புக் கூறுவதற்கு இலங்கை அரசை தொடர்ந்தும் நாம் வலியுறுத்துவோம்.

அதேவேளை, அனைத்துலக மனிதாபமான மற்றும் மனிதஉரிமைச் சட்டமீறல்களுக்கு பொறுப்புக் கூறுவதில் தமக்குள்ள அடிப்படைப் பொறுப்பை உள்ளக அதிகாரிகள் உறுதி செய்ய வேண்டும். ஒரு அரசினால் தமது கடமையை நிறைவேற்றாத அல்லது நிறைவேற்ற விரும்பாத சூழ்நிலையில் தான் அனைத்துலக பொறுப்புக்கூறும் பொறிமுறையை உருவாக்க முடியும். என்று அந்த அறிக்கையில் மேலும் கூறப்பட்டுள்ளது.
