UN committee bars Lankan general linked to atrocities

UNITED NATIONS: A top UN peacekeeping committee on Wednesday barred a Sri Lankan general accused of carrying out a military onslaught against civilians.

But Major General Shavendra Silva still attended the first meeting Wednesday of a special advisory panel to UN leader Ban Ki-moon. He sat in the room but no other member spoke to him and no documents were given to him, diplomats said.

Silva's nomination to the panel by Asia-Pacific countries at the UN set off a storm of protest by rights groups. A Canadian official who chairs the special advisory group (SAG) said in a statement that Silva "will not participate" in the panel's work.

Silva has been accused of playing a central role in the Sri Lankan military's crushing of a Tamil separatist uprising in 2009 in which tens of thousands of people died, according to UN experts and rights groups.

"Following careful consideration and consultation with other SAG members, the chair, Louise Frechette, has advised Major General Shavendra Silva of Sri Lanka, that his participation is not appropriate or helpful for the purposes of this group. He will not participate in its deliberations," said a statement released by Frechette.

Frechette is a former UN deputy secretary general and top Canadian diplomat who was named by Ban to chair the committee.

"If Frechette had not acted this panel would just have fallen apart, nobody wanted him on the panel," said one diplomat, speaking on condition of anonymity.

Silva, who has not faced any charges over his role in the military campaign, was not immediately available for comment.

The peacekeeping panel, which is to set payments to countries that contribute troops to UN missions, has 10 members, half named by Ban and half nominated by regional groups.

Silva's nomination was strongly condemned by Human Rights Watch and other rights groups. UN human rights chief Navi Pillay also wrote a letter condemning the appointment.

But the UN secretariat had previously said it could do nothing about Silva's appointment as it was decided by member countries. (Source: AFP)

ஐ.நா. தலைமையதிகாரியான பான் கீ மூனுக்கு ஆலோசனை வழங்க நியமிக்கப்பட்ட விசேட ஆலோசனைக் குழுவின் முதல் கூட்டம் புதன்கிழமை நடந்தபோது மேஜர் ஜெனரல் சவேந்திர சில்வா அங்கு போயிருந்தார். அவருடன் யாரும் பேசவில்லை. அவருக்கு ஆவணங்கள் எதுவும் கொடுக்கப்படவும் இல்லை என இராஜதந்திரிகள் கூறினர்.

ஐ.நா.வின் அமைதி காக்கும் படைக்கு ஆசிய பசுபிக் நாடுகள் சவேந்திர சில்வாவை நியமனம் செய்தபோது மனித உரிமைக்கான பல குழுக்கள் ஆட்சேபம் தெரிவித்தன. இந்த விசேட ஆலோசனைக் குழு கூட்டத்துக்கு தலைமை வகித்த ஒரு கனேடிய அதிகாரி இந்த குழுவின் செயற்பாடுகளில் சவேந்திர சில்வா பங்குபற்றமாட்டார் என தனது உரையின்போது கூறினார்.

மனித உரிமைகள் குழுக்கள் மற்றும் ஐ.நா. நிபுணர்களின் கூற்றுப்படி 2009ஆம் ஆண்டு ஆயிரக்கணக்கான மக்கள் உயிரிழந்ததாக கூறப்படும் தமிழ் பிரிவினைவாதிகளுடனான யுத்தத்தின்போது இலங்கை இராணுவத்தின் நடவடிக்கைகளில் முக்கிய பங்கு வகித்தார் என சில்வா மீது குற்றஞ்சாட்டப்பட்டது.

கூட்டத்துக்கு தலைமை வகித்த லூயிஸ் பிறெச்செட் ஏனைய குழு அங்கத்தவர்களுடன் கலந்தாலோசித்த பின், மேஜர் ஜெனரல் சவேந்திர சில்வாவிடம் சென்று அவர் கூட்டத்தில் இருப்பது ஏற்புடையது அல்ல எனவும் ஆலோசனைக் குழுவின் நோக்கத்துக்கு உதவக்கூடியது அல்ல எனவும் கூறி அவரிடம் கூட்டத்தில் பங்குபற்றக் கூடாது என கூறினார்.

முன்னர் ஐ.நா. பிரதி செயலாளர் நாயகமும் உயர்மட்ட கனேடிய இராஜதந்திரியுமான பிறெட்செட்டை இக்குழுவுக்கு தலைமை தாங்குமாறு பான் கீ மூன் நியமித்தார்.

பிறெச்செட் இவ்வாறு செய்திராதுவிடின் இந்த விசேட ஆலோசனைக் குழு கலைந்து போயிருக்கும். சவேந்திர சில்வா குழுவில் இருப்பதை ஒருவரும் விரும்பவில்லை என பெயர் குறிப்பிட விரும்பாத இராஜதந்திரி ஒருவர் கூறினார்.

இதுவரை முறையாக குற்றஞ்சாட்டப்படாத சவேந்திர சில்வா, இது பற்றி கருத்து எதனையும் இன்னும் கூறவில்லை. ஆனால் சவேந்திர சில்வா அங்கத்துவ நாடுகளால் நியமிக்கப்பட்டவர். இதனால் எதுவும் செய்வதற்கு இல்லை என ஐ.நா. தலைமையகம் முன்பே கூறிவிட்டது.

Louise Frechette, a Canadian official who chairs the special advisory group (SAG) at the United Nations in New York, said in a statement released at the UN Head Quarters today, that she has advised Major General Shavendra Silva of Sri Lanka, that "his [silva's] participation is not appropriate or helpful for the purposes of this Group [sAG]. He [silva] will not participate in its deliberations." Shavendra Silva, who was recently rescued from a civil litigation in a New York court over war-crimes allegations, is the second Sri Lanka Military Commander, after deputy Counsel in Sri Lanka’s embassy in Germany, Jegath Dias, to be barred from high level positions outside SriLanka for alleged complicity in war-crimes against Eezham Tamils.

However, Professor Boyle, an expert in International

Law

, debunked this excuse in an earlier note to TamilNet, where he said, "Ban to appoint a presumptive war criminal to his Staff would be ultra vires his powers under the terms of article 101(3) and thus a violation of the

Charter

itself."

Inner City Press (ICP) which mounted a sustained campaign of questioning the evasive UN spokespersons on Silva's appointment, had noted Silva attending the SAG meeting mid-morning and had sent a formal question to the UN Department of Peacekeeping Operations, about where the meeting was and who attended.

Frechette's Press statement announcing the "dismissal" of Mr Silva followed ICP's inquiry.

ICP quoted several paragraphs, including the following, from the UN Expert Panel's report that pointed to alleged complicity of Shavendra Silva in committing war crimes in Sri Lanka:

ஜெனீவாவில் வைத்து சவீந்திர அவளை மடக்கியதாகவும் அவள் ஏதோ கண்ணகி போல ஓடித்திரிந்ததாகவும் வந்த செய்திகள் சிங்கள அரசால் சவீந்திரவை அடக்க கசிய விடப்பட்டவை.அவளைப் பொறுத்தவரை இதைப்போல எத்தினை சவீந்திரவைப் பார்த்திருப்பாள்???
