இதில் உள்ள வழக்கு பட்டியலில் இலங்கை இனப்படுகொலை இடம் பெறவில்லை. முறைப்படி இதற்கான ஒரு வழக்கு தொடுத்தால் இவர்கள் நடவடிக்கை எடுக்க வாய்ப்பிருக்கிறது

2 கிழமைக்கு முன்னம் 1 மணியில் இருந்து 3.30 வரை ஆர்ப்பாட்டம் செய்து மனு கொடுக்கப்பட்டது( சர்வதேச நீதிமன்றம் முன்) ஜேர்மனியில் இருந்தும் பஸில் மக்கள் வந்ததர்கள்.

இதற்கு சில நடவடிக்கைகள் அமெரிக்காவில் தொடங்கப்பட்டிருக்கின்றன. இது 1948ம் ஆண்டுக்கு பின், எம்மின அழிவை இன்றுவரை சர்வதேச நாடொன்றின் நீதிமன்றுக்கு எவரும் கொண்டு வர முயலாத நிலையில், இம்முயற்சி மேற்கொள்ளப்பட்டிருக்கிறது!

ஆனால் எம்மில் .... துரோகிகளல்ல... தமிழ்த்தேசியத்தின் தூண்கள் என்று கூறி லண்டனில் திரியும் .... படிப்பறிவற்றதுகள் போல் செயற்படும் சிலதுகள், பல இடையூறுகளை விளைவிக்குதுகளாம்!! .... வேதனைதான்!!! நாம் இன்னும் திருந்தவில்லை!!!!!!!!!!! திருந்தவும் போவதில்லை!!!!!!!!!

....நாங்களும் செய்ய மாட்டோம், மற்றவர்களையும் விட மாட்டோம்!!!!!!......

Dear Prosecutor,

The 23rd of July of this year (2008) sees the 25th anniversary of what all Eelam Tamils will always remember 'Black July'. This date is permanently etched in the minds of all Eelam Tamils – never to be erased!

As was the case with all pogroms, the July 23rd pogrom in Sri Lanka was state planned. It was planned in the ministry offices of a government minister, by a team of specially selected persons who worked with copies of electoral registers and road maps.

The pogrom in 1983 was the culmination of a series of state sponsored race pogroms of 1956, 1958, 1977, 1979 and 1981 directed against the Tamil people designed to silence their aspirations meant to be gained constitutionally.

Conservative estimates said that 800 -1000 may have died in the pogrom; other figures quote 2000-3000.

At least 300,000 were made homeless at one stage or the other soon after the pogrom. Eighteen centres were opened in Colombo alone to house Tamils who had fled their homes. There were 15, 000 at the hanger in the Ratmalana Airport; schools.

"I am not worried about the opinion of the Jaffna people (meaning Tamils) ….Now we can't think of them. Not about their lives or of their opinion about us (meaning the Sinhalese)" (Daily Telegraph, London, 11 July 1983), Executive President JR Jayewardene, betraying his complicity in Black July, had to say in June 1983, to a British Journalist. This was an open declaration of the programme of Tamil genocide not only in July 1983 but in the years to follow.

What was more serious and irreplaceable was the loss of life. There were many instances of houses being set on fire with the occupants still inside. There were occasions when cars were set alight with the occupants still within. There was one reported instance, when a Tamil family comprising husband, wife and two young children had been attempting to make their way from the scene of slaughter. Their car was surrounded and, after it was drenched with a flammable liquid, set on fire. One of the crowd noticing two young children, opened the car door and took the children out. The father, immediately opened his door, took his children back into the car and shut the door. He had decided that if they were to die, they would die with dignity as a family. This tragic incident did not stop the arsonists and looters and murderers from their mission. They continued to spread havoc and destruction. Incidents like this should never be forgotten.

What Sri Lanka did not realise and apparently still does not, is that one cannot ever 'erase' an entire nation.

இப்போது சீமேந்தை இந்தியாவுக்கு ஏற்றுமதி செய்வதற்காக காங்கேசந்துறை சீமெந்து ஆலையை திறக்க முயற்சித்ததாகக் கேள்விப்பட்டேன்,அத்துடன் மன்னாரில் காணப்படும் எண்ணெய் வளத்தை ஒரு அதே நாட்டிற்கு தாரைவார்க்கவே மனிதாபிமான போர் மன்னாரில் ஆரம்பிக்கப்பட்டது!

உலக நாடுகள் இன்னொரு நாட்டின் மீது தமது பொருண்மியம் சார்ந்த ஆதிக்கத்தினை செலுத்துவதே நவீன காலனித்துவம் என்று சொல்லலாம் இதற்கு குவைத்,ஈராக்,சவுதி என்பவற்றில் தலையிட்ட அமெரிக்காவும்,கிழக்கு தீமோரில் தலையிட்ட அவுஸ்திரேலியாவும் நல்ல உதாரணங்கள்.அவர்களது தேவைகளை நிறைவு செய்வதற்கே ஐ நா மாதிரி பொதுஸ்தாபனங்கள் உள்ளது.

இவற்றையெல்லாம் தாண்டி எமது நியாயம் அரங்கேற நாம் அனைவரும் ஒற்றுமையாகப்போராடவேண்டும்.

தேசத்தில் எழுந்துள்ள இன்றைய நெருக்கடி நிலையினை மாற்ற உலகத்தமிழினமே தன்னினத்தைக்காக்க ஆதங்கத்துடன் போராடும் போது அனைவரயும் அரவணைத்து ஓரணியாகப்போராடினால் வெற்றி நிச்சயம் ஏனோ சிலர் மட்டும் மாறவில்லை என்பது நெல்லையனின் ஆதங்கத்தில் புரிகிறது.

இப்படித்தான் ஒரு பெரியவரை அண்மையில் எதேச்சையாக சந்தித்த போது எப்படி இருக்கிறீர்கள் எனக்கேட்டேன் அதற்கு அவர் சம்பந்தமில்லாமல் நாங்கள் வெண்டுகொண்டுதானிருக்கிறோம் ஆனால் மக்களை நினைத்தால்தான் கவலையாகவிருக்கு என்றார்.இவர்கள்தான் ஒரு மக்கள் போராட்டத்தை மக்களிடமிருந்தே எங்கோ எடுத்து சென்று விடுகிறார்கள்.

Dear Prosecutor,

The ongoing 'efforts" by Sri Lanka is called "fight to the end" or "War On Terror" and it is simply a smoke screen to wipe out Tamil civilians.

On 8 December 2008 the New York based, Genocide Prevention Project released a ''red alert'' list of 8 countries that included Sri Lanka along with Sudan, Myanmar, Somalia, Iraq, Pakistan, the Democratic Republic of Congo and Afghanistan.

The systematic elimination of tens of thousands of Tamils over the last 35 years is well documented. And the time is right we move to protect remaining Tamils from imminent Genocide.

As per definition, Genocide includes the following acts committed with:

1. the intent of eliminating, in whole or in part, a national, ethnic, racial or religious group: killing members of the group

2. causing serious bodily or mental harm to members of the group

3. inflicting in a deliberate fashion certain harsh conditions of life calculated to physically destroy the group in whole or in part

4. imposing measures that would prevent births within the group, forcing a specific group out of its homeland, and forcibly removing children from that group to another group.

The memory of Black July is today deeply embedded in the Tamil psyche. Many Tamil or pro-Tamil authors refer to the event as the "genocide" or the "holocaust" of Tamils. The Black July riots of 1983 were not the first of its kind in independent Sri Lanka. Anti-Tamil riots had previously taken place in 1958, 1977 and 1981. However, the magnitude of violence during these riots was far lesser than the riots of 1983. Even though the origins of the 1983 riots were widely attributed to the killing of 13 Sinhalese soldiers by Tamil rebels, many Tamils point out that it was the abduction and rape - by government forces - of three Tamil schoolgirls that led Tamil rebels to attack government forces. This incident took place in Jaffna during the week of July 18, 1983, following which one of the victims committed suicide.

The 1983 riots themselves had a highly corrosive and destructive impact on the polity in general and on Sinhala-Tamil relations in particular. The government's inability to provide its citizens with basic protection distanced the Tamil population from the country's leaders. Still worse, although not acknowledged, was the widely believed fact that the Jayawardene government had a role to play in the 1983 riots.

The root cause of Genocide of Tamils in Sri Lanka is Sinhala Buddhist Chauvinisim, that extracted from Mahavamsam. It provides the intention to kill Tamils or mental element to commit genocide. Elements of Sinhala Buddhist Chauvinism

* Island of Sri Lanka only belongs to Sinhala nation

* Aryan supremacy

* To preserve Buddhism and Sinhala heritage the country has to be unitary state and ruled by Sinhala Buddhist

* Tamils are not the original people of Island. They are aliens and invaders. Therefore they don't have any rights on Island

Even when Jaffna peninsula was liberated in 1995, some 40% of land is under what is called High Security Zone. Now generations have born in refugee camps, not seen their homes or land for decades. It is documented more than 1000 youths were disappeared in 2008, where the real numbers could be as high as 3000.

The systematic and well-planned nature of the attacks against the Tamils - to which the government itself later alluded - ruled out the spontaneous outburst of anti-Tamil hatred within the Sinhalese masses. Moreover, the possession of electoral lists by the mobs - which enabled them to identify Tamil homes and property - not only implied prior organization, for such electoral lists could not have been obtained overnight, but it also pointed to the cooperation of at least some elements of the government, who had been willing to provide the mobs with such information.

The draconian Prevention of Terrorism Act has been widely misused to abduct Tamil youth, only to be disappeared. The frequent military check points are another tool of harsh condition on Tamils. The act of standardization, a system that limits Tamils from higher education is still in place. No Tamil areas have seen any real economic development since the independence.

a) Plight of IDPs in Vavuniya camps

According to the latest information from the Vanni, over 800 pregnant women have been the subject of a medical termination of pregnancy deliberately decided by the Sri Lankan military. An act performed in poor conditions in a fortune in the Vanni and sometimes in hospitals in Vavuniya and Trincomalee.

"All have been forced to sign a document attesting that they were raped by combatants of the LTTE and not by government soldiers," said a witness.

A physician Sinhala remained anonymous says with anguish and horror violence and sexual abuse suffered by these women in the IDP camps, also known as concentration camps by the civilians in the north-east of the island.

The army, for its part, welcomes this initiative and boasts of having been the source of this "aid and relief for the Tamils. The soldiers of the Sri Lankan army will not hesitate to violate the Tamil women to satisfy their sexual appetites.

Moreover, orders given by the military in this direction. The Secretary of Defense, Rajapaske Gothabaye asked loud and clear to the generals of the army to destroy the lives of youth. "When you have girls Tamil, they will be owned and Tamil boys is to transform the Indian Ocean in Red."

Conclusion

The world has not forgotten Rwanda's tragedy, but it has not examined it in much detail, either. And there are still lessons to be learned. Many often assume that the genocide sprang spontaneously from primeval ethnic antagonism. On the contrary, it was planned over many months—Mr Bagosora sketched out part of the programme in his appointment book in early 1993. After the Rwandan genocide, we were told this “As we attempt to learn the lessons of the genocide in Rwanda, two messages should be paramount. First, never forget. Second, never stop working to prevent another genocide".

ICC must intervene in Sri Lanka now.

BEIJING, (AFP) – China called for an International Criminal Court case against Sudanese President Omar al-Beshir to be suspended and said it was concerned about an arrest warrant issued for him.

"China expresses its regretfulness and worry over the arrest warrant for the Sudan president issued by the International Criminal Court," foreign ministry spokesman Qin Gang said.

Qin called on the UN Security Council to "respect calls by the African Union, Arab League and Non-Aligned Movement... and call on the International Criminal Court not to hear this case for the time being."

The tribunal issued a warrant Wednesday for the arrest of the 65-year-old Beshir "for his alleged responsibility for crimes committed in Darfur". It was the first-ever warrant for a sitting head of state.

The United Nations says up to 300,000 people have died since conflict broke out in Sudan's Darfur region in 2003, when ethnic minority rebels took up arms against the Arab-dominated regime for a greater share of resources and power.
