விடுதலைப் புலிகளை பயங்கரவாதப் பட்டியலிட்டது தவறு - அமெரிக்க நீதிமன்றம் தீர்ப்பு

ஜனாதிபதி ஜோர்ஜ் புஷ்ஷின் அரசாங்கத்தினால், அமெரிக்க அரசயலமைப்புக்கு முரணான விதத்திலும், தெளிவற்ற நிலையிலும், பயங்கரவாதப் பட்டியலிடப்பட்ட இரண்டு குழுக்கள் குறித்து அமெரிக்க நீதிமன்றம் தீர்ப்பு வழங்கியுள்ளது.

US Judge strikes down provisions of terror act

U.S. District Court Judge Audrey Collins, in a 21st November decision, ruled as constitutionally vague provisions in the International Emergency Economic Powers Act (IEEPA) that blocked all the assets of groups or individuals the President named as "specially designated global terrorists" after the 2001 terrorist attacks. The Judge also struck down the provision that allowed Secretary of the Treasury to designate anyone who "assists, sponsors or provides services to" or is "otherwise associated with" a designated group, legal sources said.

The Center for Constitutional Rights (CCR), non-profit legal organization based in New York, which filed the case in US Courts against IEEPA. CCR represents Humanitarian Law Project, a human rights organization, and several Tamil- American organizations that seek to support the lawful activities of the Liberation Tigers of Tamil Eelam (LTTE) in Sri Lanka, especially in areas affected by the 2004 tsunami.

Professor David Cole who argued for the CCR said: "This law gave the president unfettered authority to create blacklists. It was reminiscent of the McCarthy era," Associated Press reported.

The Judge, however, allowed sections of the order that penalize those who provide "services" to designated terrorist groups. She said such services would include the humanitarian aid and rights training proposed by the plaintiffs.

The CCR plans to appeal this ruling, Professor Cole told AP.

Cole said the judge's ruling does not invalidate the hundreds of other designated terrorist groups on the list but "calls them into question," AP reported.

A Los Angeles federal judge has ruled that key portions of a presidential order blocking financial assistance to terrorist groups are unconstitutional, further complicating the Bush administration's attempts to defend its aggressive anti-terrorism tactics in federal courts.

U.S. District Judge Audrey B. Collins, in a ruling released late Monday, found that two provisions of an executive order signed Sept. 23, 2001, are impermissibly vague because they allow the president to unilaterally designate organizations as terrorist groups and broadly prohibit association with such groups.

The ruling marks a victory for the Humanitarian Law Project and other plaintiffs in the case, who are seeking to provide support for the "lawful, nonviolent activities" of two groups designated terrorist organizations by the U.S. government: the Kurdistan Workers' Party (PKK) in Turkey and the Liberation Tigers of Tamil Eelam (LTTE), also known as the Tamil Tigers, in Sri Lanka.

They argue that federal anti-terrorism laws put charities and individual donors at risk of prosecution for providing benign assistance to foreign groups that have been added to the government's terrorism list.

David Cole, a Georgetown University law professor who is helping to represent the plaintiffs in the case, said the executive order and a related federal statute improperly allow President Bush to create "blacklists" and engage in "guilt by association."

"The court's decision confirms that even in fighting terror, unchecked executive authority and trampling on fundamental freedoms is not a permissible option," Cole said in a statement.

The ruling is the latest setback for the administration's terrorism and detention policies, in lower courts and at the Supreme Court. In August, a federal judge in Detroit ruled that a National Security Agency warrantless wiretap program is unconstitutional. The government has appealed that ruling.

Collins has previously issued similar rulings in favor of the Humanitarian Law Project, a Los Angeles group that has filed legal challenges to a 1996 anti-terrorism law and to the 2001 USA Patriot Act. Those issues are still being litigated after Congress rewrote parts of the Patriot Act.

The latest case focuses on Executive Order 13224, which is aimed at cutting off financing to alleged terrorist groups and is based on the 1977 International Emergency Economic Powers Act. Twenty-seven groups and individuals were initially named as "specially designated global terrorists" under the order -- including the PKK and the Tamil Tigers -- and hundreds more since have been added to the list.

In her ruling, Collins said the order is unconstitutional because there is "no apparent limit" on presidential authority to designate groups or individuals as terrorists. In addition, the judge ruled, language banning those "otherwise associated" with such groups is "unconstitutionally vague on its face." Collins rejected a number of other claims by the plaintiffs, however, including that the order's definition of a terrorist group is too vague.

The Justice Department said it is too early to decide on an appeal.

"We are pleased that the court rejected many of the constitutional arguments raised by the plaintiffs," Justice Department spokesman Brian Roehrkasse said in a statement. "However, we believe the court erred in finding that certain other aspects of the executive order were unconstitutional."

Bruce Fein, a Justice Department official in the Reagan years who has criticized the Bush administration's broad assertions of executive power, said that appealing Collins's ruling may carry more risks for the government than simply changing the executive order's language.

Some time ago, in the Olympiad of Seattle, 9 athletes, all disabled mentally or physically, were on the starting line for the 100m race. at the starting signal, the race started. All were not running but had the desire to participate and win.

They ran in threes, one boy fell on the track, rolled over and started to cry. the other 8 heard him cry. they slowed down and looked back. they stopped and went back...All...

The girl with the Down syndrome sat down next to him, started to give cuddle him and asked him: "Are you better now?" then, all 9 held each other by the shoulders and walked together to the finish line.

The whole stadium stood up and highly praised. and the clapping lasted very long.

The people who saw it still talk about it? Why?.

Because deep down inside us, we know that the most important thing in life is much more than to win for ourselves living along.

The most important thing in this life, is to help others towin. Even if it implies slowing down and modifying our race. So one day whole world will see our problem this way if we go as a united people all around the world...

2001 செப்டெம்பரில் அமெரிக்காவில் நடந்த பாரிய பயங்கரவாதத் தாக்குதலை அடுத்து, அமெரிக்காவின் "அந்நிய பயங்கரவாத இயக்கப் பட்டியலில்' இடம் பெற்றிருந்த தமிழீழ விடுதலைப் புலிகளுக்கு ஆதரவான அமைப்புகள் அல்லது தனிப்பட்டவர்களின் சொத்து களை, அமெரிக்க சர்வதேச அவசரகால பொருளாதார அதிகாரச் சட்டத்தின் கீழ் முடக்கி வைப்பதற்கு, அமெரிக்க ஜனாதிபதி ஜோர்ஜ் புஷ் எடுத்த நடவடிக்கை அமெரிக்க அரசமைப்புக்கு ஒவ்வாத ஒரு செயல் என்று அமெரிக்கா வின் மாவட்ட நீதிமன்றம் தீர்ப்பளித்துள்ளது.

சர்வதேச அவசரகால பொருளாதார அதிகாரச் சட்டத்தி லுள்ள சில ஷரத்துகள் தெளிவற்ற விதத்தில் அரசமைப் புக்கு முரணான முறையில் காணப்படுகின்றன. இந்த ஷரத்துகளை அடிப்படையாக வைத்தே சொத்துகள் முடக் கப்பட்டிருக்கின்றன என்று மாவட்ட நீதிபதி ஒட்றே கொலின்ஸ் தனது தீர்ப்பில் தெரிவித்திருக்கிறார்.

நியூயோர்க்கைத் தளமாகக் கொண்டுள்ள சட்ட நிறுவ கமான அரசமைப்பு உரிமைகளுக்கான மத்திய நிலை யமே, இந்தச் சொத்து முடக்கத்துக்கு எதிராக அமெரிக்க மாவட்ட நீதிமன்றத்தில் வழக்கைத் தாக்கல் செய்திருந்தது.

மனித உரிமைகள் அமைப்பான "மனித நேய சட்ட நிறுவகம்' மற்றும் விடுதலைப் புலிகளின் சட்டபூர்வமான நடவடிக்கைகளுக்குக் குறிப்பாக ஆழிப்பேரலை யின் பின்னர், இலங்கையில் அதனால் பாதிக் கப்பட்ட பகுதிகளில் மேற்கொள்ளப்படும் பணிகளுக்கு உதவும் பல்வேறு அமெரிக்க தமிழ் அமைப்புகளும் இந்த அரசமைப்பு உரிமைகளுக்கான மத்திய நிலையத்தில் அங்கம் வகிக்கின்றன என்பது இங்கு குறிப் பிடத்தக்கது.

மத்திய நிலையத்தின் சார்பில் பேராசிரி யர் டேவிட் கூல், நீதிமன்றில் ஆஜராகியி ருந்தார்.

பட்டியலிடப்பட்டுள்ள பயங்கரவாதி களுக்குச் "சேவைகள்' புரிவோர் தொடர் பான தண்டனைக்குரிய சட்டப் பிரிவை நீதிபதி அனுமதித்திருக்கிறார். ஆற்றப் படும் சேவைகளின் கீழ் மனிதாபிமான உதவிகள், மனித உரிமைகளுக்கான பயிற்சி களும் உள்ளடங்கும் என்று பெண்மணியான இந்த நீதிபதி குறிப்பிட்டிருக்கிறார். நீதிபதி யின் குறிப்பிட்ட இந்தத் தீர்ப்பை எதிர்த்து மேன்முறையீடு செய்யப் போவதாகப் பேராசிரியர் கூல் தெரிவித்திருக் கிறார்.

நீதிபதியின் இந்தத் தீர்ப்பு, அமெரிக்கா வின் அந்நிய பயங்கரவாதப் பட்டியலில் இடம்பெற்றுள்ள நூற்றுக் கணக்கான இதர பயங்கரவா தக் குழுக்களின் கரும்புள்ளிப் பட்டி யலில் பதிவைச் செல்லுபடியாக்கி விடாது. ஆனால், அவற்றைக் கேள்வி கேட்க வைக்கும் என்று பேராசிரியர் விளக்க மளித்திருக்கிறார்.

பங்கரவாதப் பட்டியலிடப்பட்டுள்ள குழுக்களுக்கு உதவும், ஆதரிக்கும் அல்லது சேவைகளை வழங்கும் அல்லது ஏதாவது ஒரு விதத்தில் குழுக்களுடன் தொடர்பு வைத்திருப்போரைக் கரும்புள்ளி குத்திப் பயங்கரவாதப் பட்டியலில் சேர்ப்பதற்கு அமெரிக்கத் திறைசேரிச் செயலாளருக்கு சட்டத்தின் மூலம் வழங்கப்பட்டிருக்கும் அதிகாரத்தையும் நீதிபதி தமது தீர்ப்பில் நிராகரித்திருக்கிறார்.
