Selliah financially responsible for LTTE. Continued working for LTTE while it was on a list of criminal organisations. Used coercion - he was ideologially motivated and disturbed innocent Tamil refugees. He was key in destabilising sri lanka.

The court was packed with Tamil supporters as the three judges read out the verdict. Family members left the courtroom crying.

Prosecutors had accused the five men, all of whom now have Dutch citizenship, of raising funds for the separatist group LTTE (Tamil Tigers) by extorting money from the Sri Lankan disapora in the Netherlands by blackmail and under threat.

Other charges?

Prosecutors also alleged money laundering and incitement to violence. The men were charged of overseeing an international criminal and terrorist organisation involved in arson, bombings and murder, and prosecutors had demanded sentences of up to 20 years in prison.

But on Friday, the court convicted the men, all in leadership positions in the Dutch branch of the LTTE, of supporting a criminal organisation. By raising funds for it while they knew the organisation was on a EU ban list.

Therefore, the court ruled that the five violated a Dutch law that prohibits the support of banned organisations. Besides, the men ran illegal lotteries to raise money on violation of Dutch gambling laws.

The heart

At the heart of the case was the question whether the LTTE could be labelled as a criminal or terrorist organisation, as charged by the prosecutors. Despite the fact the Tamil Tigers are on the EU ban list for acts of terror, the Dutch court said the Sri Lankan conflict should be labelled as a civil war.

The public prosecutor was astonished by the verdict, saying it surprising, strange and unexpected that the court came to the conclusion that the LTTE was not considered a terrorist, but a criminal organisation.

Viktor Koppe, a lawyer for one of the defendants, said he will appeal the judgement, saying it is full of contradictions.

THE HAGUE, Netherlands — A Dutch court convicted five ethnic Tamils on Friday for raising illegal funds for the Sri Lankan rebel group Tamil Tigers, but in a ruling that ran counter to European and U.S. policy it refused to brand the Tigers a terrorist organization.

The defense attorney for two of the defendants said the decision by the Hague District Court “will have a huge impact” on a legal battle in the European Court of Justice to have the Liberation Tigers of Tamil Eelam, or LTTE, removed from the EU’s list of terrorists.

The court sentenced the five naturalized Dutch citizens to prison terms ranging from two to six years. Receiving the longest sentence was a man identified only as Selliah, described as the global bookkeeper for all LTTE operations outside Sri Lanka.

But in a decision that could have a broad impact, the three-judge panel acquitted them of membership of an international terror organization.

The court said the Tigers’ 26-year battle for an independent Tamil state, which cost an estimated 100,000 lives, was a “non-international armed conflict.” That means that any atrocities committed by either side should be classified as war crimes or crimes against humanity, and not terror attacks.

The ruling represented a significant public relations victory for the Tigers, who were notorious for launching suicide attacks on civilian targets during the conflict, and were widely accused of recruiting child soldiers.

Dutch attorney Victor Koppe said the outcome will be critical in his case to overturn the 2006 decision by the EU to put the Tamil Tigers on the terror list.

“For the LTTE, this is a very good judgment,” he told The Associated Press after the verdict. “It will be Exhibit A in the LTTE procedure in Luxembourg.”

Despite saying that the Tigers could not be considered terrorists under Dutch law, the Hague District court still convicted the five of fundraising for an outlawed criminal organization, basing their verdict on the EU terror listing.

The court said fundraisers used threats to wrest money from the Tamil community in the Netherlands. That continued even after the Sri Lankan military crushed the Tigers and killed their leader Velupillai Prabhakaran in May 2009.

Koppe said he would appeal the convictions.

“Basically what they are saying is that the LTTE should not be on the EU banned (terror) list and at the same time convicting them for membership of the group,” he said.

During the trial, Koppe called the Tamil Tigers “freedom fighters” and compared them to rebels who fought to topple Libyan leader Moammar Gadhafi from power.

Nonetheless, the trial supported a long-held view by the Sri Lankan government that LTTE front organizations continued to operate among the 800,000 Tamils in the diaspora, many of them in the wealthy countries in Europe, Canada and Australia.

The extent of the operation was revealed in a USB stick containing the LTTE’s 2010 financial plan seized from Selliah, whom the court described as “an unmissable link” in the LTTE. “Without Selliah’s work many millions of euros would not have gone to an outlawed organization — the LTTE,” the judgment said.

The other men all worked for groups that judges called front organizations that raised money in the Netherlands.

The United Nations and other groups also have called for an investigation of alleged war crimes by the government and the military, particularly in the final months of the war when thousands of Tamil civilians were killed in the shelling as the army closed in on the LTTE leadership.

Prosecutors also have an opportunity to appeal the sentences, but did not immediately say if they would.

Judges also acquitted the men of extortion, but convicted them of using nonviolent threats to force Tamil exiles to donate to the Tigers.

Groups of fundraisers would repeatedly visit the homes of Tamils and threaten that they would not be allowed to visit their relatives in the predominantly Tamil areas of Sri Lanka if they did not pay up.

Several among the many Tamils who packed the court’s public gallery rejected the verdicts as unjust and said they had voluntarily contributed money for humanitarian goals in Sri Lanka.

“I feel very sad,” said the wife of one of the suspects. She declined to give her name, saying she feared reprisals by government forces on family members in Sri Lanka.

“My husband was a humanitarian worker. This is not a humanitarian verdict,” she said.

After four emotional weeks in court and another two weeks of quiet deliberation, the trial against 5 Dutch-Tamil Sri Lankans in The Hague, charged with supporting the Tamil Tigers movement, ended in disappointment for both sides.

No one happy

The men were convicted of supporting a criminal organisation and sentenced from 2 to 6 years in prison. Dutch prosecutors had drawn up an ambitious indictment, charging the men with aiding and abetting terror, implicating them in the direct funding of suicide bombings and the training of child soldiers. For this part of the prosecution to succeed though, the men must have intended to terrorise the Sri Lankan population. If, however, they were shown to be supporting an internal armed conflict, then their actions were by definition, not terrorist in nature. The distinction is not easy to grasp. And both sides infer the judge in this case is confused about this distinction.

The upshot is that on October 21, the Specialist War Crimes Chamber in The Hague's Paleis van Justitie effectively supported the defence's notion that the Tamil Tigers (LTTE) of Sri Lanka was party to a civil war, and was not a terrorist organisation. This may be of some use to lawyer Victor Koppe in his application to the European Court of Justice to have the LTTE removed from the EU's list of banned terror organisations.

Irony writ large

If the case had ended there, both the Sri Lankan Tamil diaspora and Mr Koppe would have been happy. However, further down the charge sheet the men were found to have raised money for and supported an organisation on the EU's banned list – a criminal act under Dutch law. In other words, the trial judge in the present case believes the Tamil Tigers is not a terrorist group but the fact that the EU thinks they are means that Dutch criminal law is being broken.

Mr Koppe's office says it intends to appeal against the convictions. If between now and the appeal hearing the ECJ rules in favour of the application to have the LTTE removed from the EU's list of banned terrorist groups, then the conviction for supporting a banned terrorist group would seem insecure.

Pro-government newspapers in Sri Lanka cheered the convictions of the Dutch-Tiger 5 last weekend. But any sense of triumph has been tempered by the knowledge that more than a cursory glance at the verdict shows a Dutch court raising the LTTE to the status of combatants in a civil war. Colombo describes the Tigers as no more than criminal thugs, unrepresentative of the Tamil population.

Similarly, for the Sri Lankan Tamil community, convictions and sentences of up to 6 years represent a blow to an already defeated movement. They ask when they will see the first prosecutions of those responsible for atrocities committed by the Sri Lankan state. Pressure grows internationally for an independent investigation into the bloody denouement to the war in the spring of 2009, looking into evidence of war crimes on both sides. So far there have been hints of action being taken under domestic universal jurisdiction laws in the US and in Switzerland, against former Sri Lankan army generals, but nothing more. The great ICC-style tribunal called for by leading justice advocates seems a long way off.

As for the Netherlands and its case against the Dutch-Tamil 5, democrats commend the use of its war crimes chamber, albeit rare and sporadic. The investigation and subsequent trial cost the Dutch taxpayer millions of euros, and yet it won very little media attention. For some it was an exercise in post-colonial dogma. For others a necessary statement of intolerance towards international criminality.
