விடுதலைப்புலிகளிற்கு ஆதரவானவர்கள் என குற்றம்சாட்டப்பட்ட 12 பேரிற்கும் எதிரான குற்றச்சாட்டுகளை கைவிடுவதற்கு மலேசிய சட்டமா அதிபர் திணைக்களம் தீர்மானித்துள்ளது.

குற்றம்சாட்டப்பட்டவர்களிற்கு எதிரான குற்றச்சாட்டுகளை தொடரவேண்டிய தேவையில்லை என்பதற்கான வலுவான காரணங்கள் உள்ளன என சட்டமாஅதிபர் டன் சிறீ தொமி தோமஸ் தெரிவித்துள்ளார்.

12பேருக்கும் எதிரான 34 குற்றச்சாட்டுகளின் அடிப்படையில் அவர்களிற்கு எதிராக தண்டனை வழங்குவதற்கான யதார்த்தபூர்வமான வாய்ப்புகள் இல்லை எனவும் அவர்தெரிவித்துள்ளார்.

இதன் காரணமாக அவர்களிற்கு எதிரான நடவடிக்கைகளை உடனடியாக கைவிடுவதற்கு தீர்மானித்துள்ளதாக சட்டமா அதிபர் தெரிவித்துள்ளார்.

நபர்களை துதிப்பதும் போற்றுவதும் கொண்டாடுவதும் வழமையான விடயம் என மலேசிய சட்டமா அதிபர் தெரிவித்துள்ளார்.

இசைக்கலைஞர்கள், விளையாட்டு வீரர்கள் நடிகர்களை மாத்திரம்  மக்கள் போற்றுவதில்லை என  தெரிவித்துள்ள மலேசிய சட்டமா அதிபர் வரலாற்று நாயகர்கள்,அரசியல்வாதிகளும் ஆராதிக்கப்படுகின்றனர் என சுட்டிக்காட்டியுள்ளார்.

அவர்களின் படங்களையோ ஏனைய குறியீடுகளையோ கையடக்கதொலைபேசியிலோ முகநூலிலோ வைத்திருப்பது ஒருவரை பயங்கரவாதியாக மாற்றாது எனவும் சட்டமா அதிபர் தெரிவித்துள்ளார்.

இந்த தலைவர்கள் ஒவ்வொருவரும் தங்கள் அரசியல் இலக்குகளை அடைவதற்காக வன்முறைகளை பயன்படுத்தினார்கள் என்பதற்காக அவர்களின் தீவிர ஆதரவாளரை பயங்கரவாதியாகவோ அல்லது பயங்கரவாத செயலில் ஈடுபட முனைந்தவர் என்றோ கருத முடியாது எனவும் மலேசிய சட்டமா அதிபர் தெரிவித்துள்ளார்.

விடுதலைப்புலிகளின் தலைவரினதும் இலங்கையின் உள்நாட்டுபோரின் போது கொல்லப்பட்ட பயங்கரவாத அமைப்பின் தலைவர்களின் படங்களையும்தங்கள் முகநூலிலும் வைத்திருந்தனர் என குற்றம்சாட்டப்பட்ட 12 பேருக்கும் இது பொதுவான விடயம் எனவும் அவர்தெரிவித்துள்ளார்.

இதனை கிரிமினல் குற்றமாக கருதினால் அது சட்டத்தினை அவமதிக்கும் விடயமாக காணப்படும் எனவும் அவர் தெரிவித்துள்ளார்.

The Attorney General’s Chambers (AGC) in Malaysia has decided to drop all charges against 12 people who were accused of supporting the Liberation Tigers of Tamil Eelam (LTTE).

Attorney General Tan Sri Tommy Thomas said there were compelling reasons not to pursue charges against the accused, foremost of which was that “there is no realistic prospect of conviction” against any of them for the 34 charges they were facing.

“Accordingly, in the exercise of my discretion pursuant to Article 145(3) of the Federal Constitution, I have decided to discontinue proceedings against them with immediate effect,” he said in a lengthy statement today.

Thomas said it was commonplace for people to have idols to which hero worship is displayed.

“It is not just pop stars, sportsmen or actors who are admired; historical personalities and politicians too are often the subject of adoration. Thus, millions of people across the globe admire Lenin, Stalin, Mao Tse Tung or Che Guevara, and the like.

“Having their photos and other representations in one’s mobile phone or on a Facebook account does not transform one to being a terrorist.

“Just because each of these leaders used terror or violence to achieve their political goals does not mean that an ardent supporter online should be regarded as a terrorist or is planning a terrorist act,” he said.

Thomas said this was the exact common theme of all the 12 LTTE accused where each of them had in his mobile phone or Facebook account photos of slain LTTE leader V. Prabhakaran and other leaders of the terrorist organisation killed during the Civil War in Sri Lanka.

Thomas said if such conduct was constituted as a criminal offence, it would bring the law into disrepute.

“But even if there were elements of a ‘terrorist act’ on the part of all or any of the 12 LTTE accused by possessing, distributing or displaying such photos or Prabhakaran, it would be impossible for the prosecution to establish that they do not fall within the excluded category of Section 130B(4) of the Penal Code in that they merely constitute ‘advocacy, protest or dissent’,” he said.

It was reported that the 12 were charged on Oct 29, 2019 with supporting the LTTE. All of them have since been held in detention under the Security Offences (Special Measures) Act 2012 (SOSMA), and will face trials in the coming months. (New Straits Times)

Malaysia’s Home Minister says LTTE remains a terror group

Malaysia's Home Minister Muhyiddin Yassin on Saturday (Feb 22) said the defunct organisation Liberation Tigers of Tamil Eelam (LTTE) will remain listed as a terrorist organisation, setting aside a suggestion by Malaysia's Attorney-General Tommy Thomas for a review.

Tan Sri Muhyiddin said countries including India, Canada, the United States and Britain continue to list the LTTE as a terrorist group.

He issued a statement a day after Tan Sri Thomas controversially dropped charges against 12 individuals, including two state lawmakers from the Democratic Action Party, a component party of Malaysia's ruling coalition Pakatan Harapan.

The 12 men had been charged for being alleged sympathisers of the LTTE, including allegations that they had collected funds to revive the militant group.

The LTTE was defeated by the Sri Lankan army in 2009.

Mr Thomas in his 11-page statement explaining the rationale for dropping the charges, had also asked the Home Ministry to review the list of gazetted terrorist organisations in Malaysia.

Home Minister Muhyiddin's reply, as cited by Malaysiakini online news: "The Malaysian government listed the LTTE as a terrorist group since Nov 12, 2014.

"Based on the latest information from the authorities, I as the home minister feel there is a strong basis to retain the LTTE listing as a terrorist organisation.

"This group is believed to still espouse an ideology that can threaten public order and national security."

He added that it is the responsibility of the authorities to take measures to curb the group's activities and ideology.

"I would like to stress that the listing of LTTE as a terrorist organisation is under the purview of the home minister in accordance with the law.

"The attorney-general has no power under the law to interfere in the jurisdiction of the home minister," he said.( The Straits Times)
