Envoy denies transfer linked to condemned teen

RIYADH: Sri Lanka’s ambassador to Saudi Arabia said yesterday his imminent reposting was not related to a report criticising his handling of a mission seeking clemency for a teenager condemned to death.

A M J Sadiq told AFP he was scheduled to return to Columbo on Friday after having a transfer request accepted, dismissing a report he was being recalled.

“I’m not being recalled. I submitted a transfer request some months ago for personal reasons,” he said.

Last month, Sri Lanka’s The Sunday Times newspaper claimed Sadiq was being recalled early following his failure to arrange official meetings for Deputy Foreign Minister Hussein Bhaila in the run-up to a visit to Saudi Arabia.

Bhaila travelled to the ultra-conservative kingdom last month to try to secure clemency for Rizana Nafeek, a 19-year-old Sri Lankan convicted of strangling her employer’s baby in 2005.

Sadiq said Bhaila did meet officials from Saudi Arabia’s foreign ministry as well as religious leaders and senior members of the murdered baby’s tribe, who promised to approach the baby’s parents to try to secure a pardon.

Sadiq said his replacement had yet to be assigned and that he would spend his remaining time in Saudi Arabia pushing for Nafeek’s release.

“I put my heart and soul into whatever is entrusted to me to do,” he said. “I hope over the next few days to meet with her laywer, who is still preparing her appeal.”

Around 550,000 Sri Lankans live and work in oil-rich Saudi Arabia, many of them as domestic helpers or drivers. They are a key source of foreign currency for Sri Lanka. – AFP

சவூதி அரேபியாவில் மரணதண்டனை விதிக்கப்பட்டுள்ள 17 வயதுடைய பாத்திமா ரிஸானாவை அந்தத் தண்டனையிலிருந்து மீட்க வெளிநாட்டு அமைச்சு மேற்கொண்ட முயற்சிகள் தோல்வியைத் தழுவியுள்ளதால் அவரின் உயிரைக் காப்பாற்ற இலங்கையர் அனைவரும் ஒன்றுபட்டு குரல் கொடுக்க வேண்டுமென ஜே.வி.பி.பாராளுமன்றக் குழுக்களின் தலைவர் விமல் வீரவன்ச தெரிவித்துள்ளார்.

பாராளுமன்றத்தில் கடந்த வியாழக்கிழமை விமல் வீரவன்ச இது தொடர்பாக உரையாற்றுகையில் கூறியதாவது;

மூன்று தசாப்தங்களாக இந்த நாட்டில் பின்பற்றி வந்து கொண்டிருக்கும் திறந்த பொருளாதாரக் கொள்கை பொதுமக்கள் மீது தாங்க முடியாத வாழ்க்கைச் சுமையை சுமத்தியுள்ளது. நாணயத்தின் பெறுமதி வீழ்ச்சியடையும் போது அளவுக்கு அதிகமாக ரூபா நோட்டுகள் அச்சடிக்கப்படும் போது பல தசாப்தங்களாகப் பெற்றுக் கொள்ளப்பட்டிருக்கும் பெருவாரியான கடன் அதிகரிக்கும் போது பொதுமக்கள் மீது தாங்க முடியாத சுமையொன்று சுமத்தப்படுகிறது. அரசாங்கத்தின் வீண் விரயமும், ஊழலும், மோசடியும் அதன் மீது சுமத்தப்படும் போது நிலைமை மேலும் மோசமாகின்றது.

இந்த நிலமைக்கு முகம் கொடுக்கக்கூடிய நிலைமையில் ஏழைகள் இல்லை. இந்த திறந்த பொருளாதாரத்துக்குள் தேசிய தொழில் முயற்சிகள் வீழ்ச்சியடைந்துள்ளது. விவசாயம் வீழ்ச்சியடைந்துள்ளது. 1977 தொடக்கம் இதுவரை 30 வருடகாலமாக பின்பற்றப்பட்டுக் கொண்டிருக்கும் இந்தப் பொருளாதார முறையில் சில மாற்றங்களைச் செய்து அரசாங்கங்களினால் செயற்படுத்திய இந்தப் பொருளாதார முறை , ஏழை மக்களை மனிதர்களாகவாவது வாழும் உரிமையையும் பறித்துக் கொண்டுள்ளது. இறுதியாக நடக்கப் போவது என்னவென்றால் ஏழை மக்கள் சமூக விரோதச் செயல்களை நோக்கித் தள்ளப்படுவதும் அல்லது பொருளாதார அடிமைகளாக மாறுவதுமேயாகும். ரிஸானா போன்ற அநேகமானோர் இந்தப் பொருளாதார அடிமைகளின் தலைவிதிக்கே தள்ளப்படுகின்றனர்.

எந்தவொரு பொருளாதாரத்தினாலும் அந்த மண்ணில் வாழும் மக்களின் வாழ்வை நம்பிக்கையோடு முன்கொண்டு செல்ல முடியாமல் போகும் போது அந்த மக்களில் பெரும்பாலானோர் அந்தப் பொருளாதார முறையின் மூலம் வெளிநாட்டு அடிமைகளாக ஆக்கப்படுகின்றனர். எம்மைப் போன்ற நாடுகளின் பெண்கள் மத்திய கிழக்கு நாடுகளுக்குப் பணிப் பெண்களாகச் செல்கிறார்களென்றால் அது இந்நாட்டில் செயற்படும் பொருளாதார முறை வெளிநாட்டு அடிமைகளாகத் தள்ளப்படுகின்றார்கள் என்று தான் கூற வேண்டும். மிக ஆபத்தான முறைகளைப் பயன்படுத்தி இத்தாலிக்கோ , ஐரோப்பாவுக்கோ அல்லது வேறு எந்த நாட்டுக்கோ இளைஞர்கள் சட்டவிரோதமாகச் செல்வது இந்தப் பொருளாதார முறை அவர்களை வெளிநாட்டு அடிமைகளாக்கி இருப்பதனால் தான்.

இந்தப் பிராந்தியத்திலுள்ள அநேகமான நாடுகள் அடிமைத்தொழிலுக்குத் தமது நாட்டுப் பெண்களை மத்திய கிழக்கு நாடுகளுக்கு அனுப்புவதை நிறுத்தியிருக்கின்றன. ஆனால் பல தசாப்தங்களாக திறந்த பொருளாதாரக் கொள்கையை சுமந்து கொண்டிருக்கும் எம்மால் அவ்வாறான ஒரு முடிவை எடுக்க துணிவில்லாமலிருக்கின்றது.

இந்த 17 வயது அப்பாவி சகோதரி முகம் கொடுத்திருக்கும் தலைவிதிக்கு நாம் அனைவரும் பதில் சொல்லியாக வேண்டும். அவரைப் போன்ற ஒரு சகோதரியைக் கூட பொருளாதார வெளி அடிமையாக்கிய இந்தப் பாழாய்ப் போன பொருளாதார முறையைத் தொடர்ந்தும் செயற்படுத்துவதில் நாமும் பங்கேற்றதனாலேயேயாகும். அந்தச் சகோதரியைக் காப்பாற்றுவதற்காக இலங்கை மண்ணின் அனைத்துப் பெண்களும், தாய்மார்களும் , தந்தையர்களும் , பிள்ளைகளும் முன்வர வேண்டியிருக்கின்றது. இந்தப் பிரச்சினை தொடர்பாக அரசாங்கம் இதனை விட அதிகளவில் தலையீடு செய்ய வேண்டும். அவரை விடுதலை செய்வதற்காக சவூதி அரேபிய அரசாங்கத்தை வற்புறுத்தும் இயக்கமொன்றை நாம் ஆரம்பிக்க வேண்டும். உயிரைப் பாதுகாக்க நாம் தவறினால் அந்தச் சகோதரியின் கழுத்தில் சுருக்குக் கயிற்றைப் போட்ட அவரை இந்தத் தலைவிதியை நோக்கி வெளி அடிமையாக்கிய பாழாய்ப்போன, கொள்கைக்கார பொருளாதார முறையை செயற்படுத்திக் கொண்டிருக்கும். அதற்கு ஒத்துழைக்கும் அதனை உருவாக்கிய அனைவரினது கைகளிலும் இரத்தக்கறை படிவதைத் தடுக்க முடியாது.

Saudi body 'concerned' on Rizana

The independant human rights commission in Saudi Arabia is studying the death sentence imposed upon a Sri Lankan teenager, a rights watchdog said.

Asian Human Rights Commission (AHRC) told BBC Sandeshaya that Saudi Commission is empowered to advise the king on rights related issues.

"We understand that the Commission is of the opinion that there has been a mistake by sentencing Rizana Nafeek," AHRC Executive director Basil Fernando said.

Appeal to the family

The Commission will also be able to negotiate with the victim's family on a possible pardon, Fernando added.

"The victim's family has the ultimate responsibility on the fate of Rizana, according to Saudi law".

She was then sentenced a death penalty of beheading according to the Saudi Arabian High Court.

Vienna Convention

Basil Fernando says the Sri Lankan authorities have failed to offer legal assistance to the convicted people during their trials.

Sri Lanka government says it cannot intervene in judicial procedures of another sovereign country.

"But as a signatory to the Vienna Convention of Consular Relations, Sri Lanka have a right to provide them with legal assistance," Fernando told BBCSinhala.com.

Saudi authorities beheaded four Sri Lankans earlier this year despite repeated appeals by international human rights groups.

சவூதி அரேபியாவில் மரண தண்டனை விதிக்கப்பட்டிருக்கும் இலங்கை யுவதியான ரிஸானா நபீக்கை விடுவிக்கும் முயற்சிகளில் முழுமூச்சுடன் இறங்கப் போவதாக இலங்கை மாதாவின் புதல்விகள் அமைப்பு தெரிவித்துள்ளது.

இதற்கென எதிர்வரும் 18 ஆம் திகதி முதல் இலங்கை முழுவதும் கையொப்பங்களை திரட்டும் பணிகளில் இறங்கப்போவதாகவும் அந்த அமைப்பினர் தெரிவிக்கின்றனர். தேசப்பற்றுள்ள தேசிய இயக்கத்தின் அனுசரணையில் புதிதாக ஸ்தாபிக்கப்பட்டுள்ள இலங்கை மாதாவின் புதல்விகள் (லக்மவ தியனியோ) எனும் இந்த அமைப்பினர் நேற்று செவ்வாய்க்கிழமை கொழும்பு தேசிய நூலக ஆவணவாக்கற் சபை கேட்போர் கூடத்தில் நடத்திய ஊடகவியலாளர் மாநாட்டிலேயே இதைத் தெரிவித்தனர்.

இதன்போது பேசிய அமைப்பின் ஏற்பாட்டாளரான பௌசியா ஹசன் தெரிவிக்கையில்;

"ரிஸானா நபீக் விடயத்தில் அரசாங்கம் உரிய நடவடிக்கை எடுக்க தவறிவிட்டது. அரசாங்கத்தின் அசமந்தப் போக்கே ரிஸானா மட்டுமன்றி இலங்கையிலிருந்து பணிப் பெண்களாக வெளிநாடுகளுக்குச் செல்லும் பல பெண்களும் பல்வேறு கஷ்டங்களுக்கு முகம் கொடுக்க காரணமாக இருக்கிறது.

இதேநேரம், ரிஸானா நபீக்கை விடுவிக்கும் முயற்சிகளில் நாம் இறங்கத் தீர்மானித்துள்ளோம். இதற்கமைய எதிர்வரும் 18 ஆம் திகதி கொழும்பில் ஆரம்பித்து இலங்கை முழுவதும் கையொப்பங்களை திரட்டும் நடவடிக்கை மேற்கொள்ளப்படவுள்ளது. பாடசாலைகள் உட்பட பல இடங்களிலும் இது மேற்கொள்ளப்படும். கையொப்பங்கள் திரட்டப்பட்ட மனுவானது சவூதி தூதரகம் ஊடாக, சவூதி அரேபிய அரசாங்கத்துக்கு அனுப்பிவைக்கப்படும்.

அது மட்டுமல்லாது, சர்வ மத ஸ்தலங்களிலும் ரிஸானாவின் விடுதலைக்காக மத வழிபாடுகளை நடத்தவும் திட்டமிடப்பட்டுள்ளது. அத்துடன், ரிஸானாவை விடுவிக்க ஏனைய முஸ்லிம் நாடுகளூடாக சவூதி அரேபிய அரசாங்கத்திடம் வேண்டுகோள் விடுக்கவும் நடவடிக்கை எடுக்கப்பட்டுள்ளது"என்றார்.

A people's petition seeking release of Sri Lankan housemaid facing death sentence

Aug 20, Colombo: Lakmawage Diyaniyo, a women's organization linked to Patriotic National Movement today launched a people's petition signing campaign seeking the release of Rizana Nafeek, the Sri Lankan housemaid who is facing death sentence in Saudi Arabia.

Nafeek is alleged of murdering an infant while under her care. She has migrated to Saudi Arabia as an underage girl.

The signing of the petition was commenced near the Pettah Bodhi in Colombo and would be held a weeklong. The petition is to be forwarded to the Embassy of Saudi Arabia.

Meanwhile the Central Bank of Sri Lanka last week boasted that worker remittances, the second highest foreign exchange earner to the country, increased by around 18 per cent to US$ 1.3 billion during the first half of 2007 helping to finance over 80 per cent of the trade deficit in the first half of 2007.

The worker remittances would have favourable impact on current account balance for the first half of 2007, stated the Central Bank.

Most of the Sri Lankans migrating for foreign employment are unskilled housemaids. Sri Lanka Foreign Employment Bureau says around 130,000 housemaids leave for jobs annually. Of the nearly 1.5 million Sri Lankan expatriate workers, the majority is housemaids.

Signing of a massive petition to demand Saudi Arabian government to release Rizana Nafeek, the Sri Lankan teenage girl who has been condemned in that country to be beheaded, and distribution of a leaflet to make the masses aware of the harassment many employees in Middle Eastern countries have to undergo was held in Colombo yesterday.

The campaign organized by “Lakmawa Diyaniyo” (Daughters of Mother Lanka) commenced at Fort Railway Station and Pettah Bo Tree.

People of all walks of life and from all communities showed great interest in signing the petition.”Lakmawa Diyaniyo” expects to continue the campaign in many towns during the next few days.

“Lakmawa Diyaniyo” has requested the people to send e-mails to foreigners.dep@mofa.sa or send telegrams to Saudi Arabian Embassy at No. 39, Ernest de Silva Mawatha, Colombo 07 appealing to release Rizana.

Ms. Madhurangika Koswatte, Secretary of “Lakmawa Diyaniyo” said their struggle would not stop with the campaign to get Rizana released as the plundering economy in the country would produce more Rizanas. Hence, their struggle is to demand that a solution be found to stop the plight of more Rizanas she added.

இதேசமயம், றிஸானா மீதான மரண தண்டனை இரத்துச் செய்யப்பட வேண்டுமென இலங்கை தரப்பில் சவுதி அரேபிய நீதிமன்றத்தில் மேன்முறையீடு செய்யப்பட்டுள்ளது.

எனினும் இம்மேன் முறையீடு தற்போது விசாரணைக்கு எடுத்துக் கொள்ளப்படமாட்டாதெனவும் அறியவருகிறது.

சவுதியில் இக்காலப்பகுதியில் கடும் வெப்பமான காலநிலையால் நீதிமன்றங்களின் செயற்பாடுகள் அங்கு நடைபெறுவதில்லை என்பது குறிப்பிடத்தக்கது.

Embassy Official Visits Rizana Nafeek in Jail

RIYADH, 27 August 2007 — Rizana Nafeek, the Sri Lankan maid whose death sentence is currently being reviewed in an appeal court, looks confident and says Almighty Allah will protect her, according to a senior Sri Lankan Embassy official who visited the maid in Dawadmi Jail on Saturday.

Nafeek, who had arrived in the Kingdom underage, was convicted of murdering an infant under her care by a three-member bench at a high court in Dawadmi on June 16. An appeal was filed against the judgment on July 15, a day before the deadline set out by the court.

“She was poised and calm, and never showed any qualms about her death sentence,” W.S.M.S. Wijesundera told Arab News.

Nafeek told the official that she was being well looked after by prison officials and that she learned Sinhalese (the language spoken by the majority of Sri Lankans) through a fellow inmate who taught her the island’s official language during her two-year stay in jail. The woman was released last week and was repatriated to Sri Lanka three days ago. “This has given more confidence to Nafeek,” said Wijesundera.

The diplomat said Nafeek was wearing a black abaya and looked serene. Wijesundera also said he gave chocolates to the maid with the permission of the chief jailor, who was present throughout the meeting. K.B.G. Premadasa, labor secretary of the Sri Lankan Embassy, also attended the meeting.

Wijesundera thanked Saudi officials who were instrumental in making the meeting a reality. He also added that he would send a detailed report of the meeting to Nafeek’s parents through the Sri Lankan Foreign Ministry, which he hoped would console them a great deal at this crucial period.

Meanwhile, Lakmawage Diyaniyo, a women’s organization linked to the Patriotic National Movement in Sri Lanka, launched a people’s petition signing campaign on Friday seeking the maid’s release. The signing of the petition was commenced near the Pettah Bodhi in the heart of Colombo and would be held for a week. The petition is to be forwarded to the Saudi Embassy in Sri Lanka.

SRI LANKA - Church Joins Others In Seeking Reprieve For Maid Condemned To Death In Saudi Arabia

COLOMBO (UCAN) -- Church people are sending thousands of postcards requesting clemency for a Muslim Sri Lankan housemaid condemned to death by a Saudi court for killing her employer's baby.

Caritas Kandy, also known as SETIK (Social and Economic Training Institute Kandy) has been campaigning for Rizana Nafeek, 19, who was 17 when the baby died in her care. SETIK joined other NGOs and the United States-based Human Rights Watch in calling for clemency.

On Aug. 24, thousands of people attended special prayers in mosques, temples and churches in Kandy, 100 kilometers north of Colombo.

The previous day, a weeklong postcard campaign ended. The aim is to "save a Muslim girl, a breadwinner for an impoverished family," Father George Sigamoney told UCA News. He is director of the Catholic National Commision for Migrants as well as director of Kandy diocese's Commission for Justice, Peace, Human Development and Human Rights.

For the postcard campaign, 1,500 cards were sent to Catholic institutions. But on Aug. 23, they took the campaign to the streets in the hilly city of Kandy, where passers-by stopped and signed more than 7,000 postcards. Kandy's mayor, parliamentarians, human rights activists, and Catholic priests and Religious signed the Church postcards, which will be sent to Rizana's Saudi Arabian employer.

According to media reports, the 17-year-old maid traveled to Saudi Arabia in 2005 with a fake identity card that put her age at 23. She soon began work as a maid with a Saudi family.

Even though she was inexperienced in child care, she was left alone with the employer's 4-month-old baby. The maid claimed the baby started choking when she fed it, and choked to death. The family accused her of strangling the baby.

On June 16, she was sentenced to death by beheading. She was to be beheaded on July 16, but the sentence has yet to be carried out.

She could not afford a lawyer and could not understand the court proceedings in Arabic, since she is a Tamil speaker. She was given one month to lodge an appeal.

According to the international media, while executions are "commonplace" in Saudi Arabia -- where four Sri Lankans were beheaded for armed robbery - the young age of the convicted woman, the summary trial and the severe sentence have sparked international sympathy and a debate about the treatment of South Asians in the Middle East.

"This is a tragedy, misunderstood as a crime," Father Reid Shelton Fernando told UCA News. He is a member of Asian Human Rights Commission (AHRC) and chaplain of the International Young Christian Workers (IYCW) movement in Sri Lanka.

AHRC came forward to pay the cost of the appeal and is currently pursuing that process.

A nun who works for Caritas Colombo helping migrant workers is also involved. "Our organization's request to pardon Rizana is one way to save her," Our Lady of Perpetual Help Sister Rita Janet told UCA News. Caritas, the Church's social-service agency, helps migrant workers in trouble, often through its women's desk

"She may be of a different faith, but we want to rescue her. This is what Jesus taught," Father Sigamoney reiterated.

"The employment agency, which sent an underage girl for a job, should be brought to the book," the priest added.

Messenger, the island's English Catholic weekly, highlighted Rizana's plight in its Aug. 12 editorial. At the same time it spoke of the difficulties facing more than 1 million Sri Lankans in the Middle East, who remit an estimated US$2.4 billion back home ever year. The Sri Lanka Foreign Employment Bureau says around 130,000 housemaids annually leave for jobs in the Middle East.

Of the nearly 1.5 million Sri Lankan expatriate workers worldwide struggling with different languages, cultures, customs and laws, the vast majority are unskilled housemaids.

Rizana's parents are distraught. When UCA News spoke with them, her father, Mohamed Sultan, 42, appealed: "She is the breadwinner. Please pardon my daughter."

Her mother, Sultan Razeena, 37, called the Church involvement a great help. "Save my daughter in the name of Allah," she added.

Rizana Bides Her Time Reading Qur’an, Watching TV

RIYADH, 10 September 2007 — Rizana Nafeek, whose death sentence by a Dawadmi court is currently on appeal at a higher court, looked cheerful and was hopeful that she would be released soon, according to a social worker who visited her in jail over the weekend.

“Rizana was so confident that she told me to bring some good clothes to wear when she comes out of jail,” Dr. Kifaya Ifthikar told Arab News yesterday.

“She also wanted a Tamil translation of the Holy Qur’an, which I gave the woman jailor to hand to her,” he added.

Dr. Kifaya said that Rizana told her that the jailors, who are all women, look after her well. “It does not look like a jail at all; it looks like an urban home with two rooms. The place is fully air-conditioned and there is a TV for Rizana to pass her time,” Dr. Kifaya said.

In prison, Rizana was in normal clothes and said that she spends her time reciting the Qur’an, praying and watching television.

Rizana is given SR60 a month by the prison to buy toiletries. “She saves some money from it to take home,” the social worker said, adding that Rizana is anxious to see her brother and sister back home.

Meanwhile, the Saudi Human Rights Commission has assigned an officer to look after Rizana’s case. Sources said that it would also try to negotiate with the parents of the infant who is alleged to have been killed by Rizana.

Sri Lankan Ambassador A.M.J. Sadiq had met Chairman of the Human Rights Commission Turki Al-Sudairi prior to his final departure to Colombo seeking his intervention in Rizana’s case.

Basil Fernando, executive director of Asia Human Rights Commission (AHRC), told Arab News from Hong Kong that he is awaiting a reply from the Saudi legal firm, Kateb Fahd Al-Shammary, about the case. “We have already written to the lawyers and they will keep us posted regarding their next step,” Fernando said.

The AHRC has paid SR50,000, one third of the total legal fees, to the firm. The total cost of SR150,000 was collected by AHRC from a Sri Lankan philanthropist and charitable and business organizations.

“Meeting Rizana Nafeek will be high on my agenda,” said Sri Lanka’s new consul general, A.L.M. Lafir, who assumed duties at the country’s consulate in Jeddah on Saturday. “Rizana’s parents met me before my departure to Jeddah and requested me to meet their daughter and console her in whatever way possible,” Lafir said.

He pointed out that the embassy in Riyadh, headed by W.S.M.S. Wijesundera, is currently looking after her interests and that his meeting with her would boost her morale.

Lafir succeeds Masihudeen Inamullah, who left the Kingdom on completion of his tour of duty in June this year. Regarding his new posting, Lafir said, “I am thrilled to work in a place like Jeddah which is the commercial hub of the Kingdom.”

In addition to providing services to Haj and Umrah pilgrims to the holy cities of Makkah and Madinah, Lafir hopes to broaden economic cooperation between the two countries.

He said a large section of the 550,000-strong Sri Lankan community in the Kingdom live in the Western Province. “I hope to do my best to serve my community as well as to develop cordial relations with the locals and other expatriates,” he said.

Sri Lanka Minister to leave for Saudi Arabia to seek pardon for the housemaid

Sept 14, Colombo: Minister of Foreign Employment Promotion and Welfare Keheliya Rambukwella is to leave for Saudi Arabia soon to seek ways to obtain a pardon for the Sri Lankan housemaid who is facing a death sentence in the kingdom for murder charges.

The ill-fated 19 year old teenager Rizana Nafeek left for Saudi Arabia on a forged passport while being an underage. She was sentenced to death for allegedly killing a baby she was made to look after and the appeal for mercy is to be heard in the Saudi courts.

The attempt by the Deputy Minister Hussein Bahila who visited Saudi Arabia last month to seek pardon for the woman failed.

Rizana Case: No Date Set for Minister’s Visit

RIYADH, 16 September 2007 — A date for the forthcoming visit by Sri Lankan Minister of Foreign Employment Promotion and Welfare Keheliya Rambukwella has not been set. Rambukwella is planning to meet if possible with the parents of an infant who died while under the care of Rizana Nafeek, a Sri Lankan woman facing the death penalty for murder.

The maid, whom the parents accuse of murdering their newborn during her second week on the job, contends that the death of the baby was accidental, that the baby died from choking during a bottle-feeding session.

Officials at the Sri Lankan Embassy confirmed that Rambukwella would come sometime after Ramadan.

Nafeek reportedly came to the Kingdom as a minor on a forged passport claiming she was in her early 20s. She was 17 at the time of the incident, according to her Sri Lankan birth certificate.

Meanwhile, a prominent Sri Lankan philanthropist has offered a house, tractor and Rs100,000 in cash for Nafeek’s parents. Deshamanya Lalith Kotelawela, chairman Ceylinco Group, gave the money to help cover two-thirds of the lawyer’s fees. The money to pay the lawyers involved in Nafeek’s defense is being raised by the Hong Kong-based Asian Human Rights Commission.

Nafeek had no legal representation in the first trial, and signed a confession at the police station with no translator present after her arrest.

Lawyers confident of saving Rizana

There is a strong possibility of Rizana Nafeek, charged by a court in Dawadmi for murdering a four-month-old infant, being spared the gallows, according to her lawyers.

Khateb Al-Shammary, a law firm retained by the Hong Kong-based Asian Human Rights Commission (AHRC), filed an appeal against the death sentence handed out to Rizana by a three-member Bench on June 16 and her case is under review at a Court of Appeal.

“In a letter addressed to us, the legal firm has said that there is strong likelihood of Rizana being spared,” Basil Fernando, executive director of AHRC, told Daily News. However, he added that the lawyers believed that she could be given a five-year jail term for “death caused without intention”.

“Sometimes, all these charges may be set aside by the Appeal Court and Rizana could be released unconditionally,” Fernando said, adding that the final verdict is yet to be heard from the court. According to the lawyers the date of the trial for appeal has to be determined by Dawadmi court in due course.

Fernando said due to the steady progress of the case, AHRC had already paid SR100,000 in two installments to the legal firm. The balance SR50,000 will be paid after the final verdict. The money was contributed by Sri Lankans working abroad.

The director also appreciated the efforts made by the Saudi Human Rights Commission to save Rizana from death. “Officials from the Saudi commission have met the relatives of the infant regarding the issue.”

During the month of Ramadan, the lawyers took time in meeting the tribal leaders in Dawadmi to negotiate with the members of the victim’s family. Following a formal Iftar party, the lawyers explained the leaders of Rizana’s plight and told them why Rizana should be pardoned on humanitarian grounds.

A social service women’s group headed by Dr. Kifaya Iftikhar met Rizana on Saturday in the Dawadmi jail.

“ The maid looked cheerful and was anticipating the day of her release,” Iftikhar told Daily News.

Iftikhar said Rizana was worried about the social stigma that she would have to endure because of the case once she was out of jail.

“I do not know how the people in my village would react when they see me back home,” Ifthikar quoted Rizana as saying referring to her conservative rural community near Muttur.

Rizana arrived in Riyadh on May 4, 2005, to work as a maid in the household of Naif Jiziyan Khalaf Al-Otaibi. A few days later, she was transferred to work in her sponsor’s family home in Dawadmi, about 390 km west of Riyadh.

Apart from performing the daily household chores of cleaning, cooking, washing and ironing clothes, Rizana had also been entrusted with the responsibility of looking after the sponsor’s four-month-old infant son, which she was not trained to do.

The incident in which the infant died occurred around 12.30 p.m. on May 22, 2005, while Rizana was bottle-feeding the infant. She had been arrested by Dawadmi police the same day, and had allegedly confessed to killing the child.

Rizana had repeated her confession in open court. However, at the court hearing on February 3, 2007, Rizana retracted her confession and informed the court that her original confession admitting to killing the child had been obtained by the police under duress.

In her statement to the court, the maid also claimed that at the time of her arrival in Saudi Arabia, she was 17 years and that a recruitment agent had falsified her documents and obtained her passport by overstating her true age by six years.

According to Rizana’s passport, her date of birth is stated as February 2, 1982, whilst the certified copy of her birth registration indicates her actual date of birth as February 4, 1988.

Rizana, now 19, is a resident from Muttur, who two years ago altered her actual age to 22 and obtained employment in Saudi Arabia.

She was on death row after being convicted on June 16th this year of murdering the four-week-old infant son of her employer while bottle-feeding him.

However, requests have been made by many human rights groups as well as at diplomatic level for clemency

அதேநேரம், றிசானாவின் விடுதலைக்காக நீதிமன்றில் வாதாடவென நியமிக்கப்பட்ட சட்டத்தரணி ஆசிய மனித உரிமை ஆணைக்குழுவின் தலைவர் பசில் பெர்னாண்டோவுக்கு எழுதியுள்ள கடிதத்தில், ரிசானாவின் விடுதலைக்காக சமர்ப்பிக்கப்பட்ட மேன்முறையீடு சவூதி நீதிமன்றத்தினால் அதன் சட்ட விதிகளுக்கமைவாக ஏற்றுக் கொள்ளப்பட்டுள்ளதால் நாம் கவலைப்படத் தேவையில்லை.

இவற்றுக்கு அப்பால், அவருக்கான மரண தண்டனை உறுதி செய்யப்படுமாயின் அதைத் தடுப்பதற்கும் சில ஏற்பாடுகளை நாம் செய்துள்ளோம். இறைவனின் பெயரால் அல்லது பாதிக்கப்பட்ட குடும்பத்தவருக்கு அவர்களுக்கேற்பட்ட இழப்புக்காக நிதித்தொகை ஒன்றை வழங்குவதன் மூலம் றிசானாவின் விடுதலைக்கு வழி செய்ய முடியும் என்றும் தெரிவித்துள்ளார்.

இதேவேளை, றிசானாவின் விடுதலைக்காக நிதிஉதவி செய்யும் நிறுவனத்தின் ஆலோசகரான மொஹமட் மஃரூப் இதுபற்றி கருத்து தெரிவிக்கையில், சில நாட்களுக்கு முன்பு றிசானாவின் விடுதலைக்காக அக்கறையுடன் நீதிமன்ற செயற்பாடுகளில் ஈடுபட்டு வரும் ஒருவர், றிசானா விரைவில் விடுதலையாவார் என கூறியதாக தெரிவித்தார்.

மேலும், சிறைச்சாலை அதிகாரிகள் றிசானாவை நல்ல நிலையில் பராமரித்து வருவதாகவும் அவர் மேலும் தெரிவித்தார்.
