பாகிஸ்தானைப் பயங்கரவாதத்தை ஊக்குவிக்கும் நாடு என்று சொல்லும் இந்தியா என்ன சொல்லப் போகிறது. நடுநிலமை என்று நழுவல் போக்கைக் கடைப் பிடிக்குமா?அல்லது அது வேற இது வேற என்று சிறிலங்காவிற்கு ஆதரவளிக்குமா?

இலங்கைக்கு ஆதரவாக பாகிஸ்தான் – என்ன செய்யப்போகின்றது இந்தியா?!

மனித உரிமைக்கூட்டத்தில் இலங்கையில் ஏற்பட்ட மனிதப் பேரழிவுகளுக்கு உரிய விசாரனைகள் வேண்டும் என வாதங்கள் முன்வைக்கப்பட்போது. எந்த நாடும் எதிர்ப்புத் தெரிவிக்காத போது பாகிஸ்தான் மட்டும் இலங்கை விவகாரம் முடிந்துபோன விடயம் என இலங்கையின் இனப்படுகொலைகள் போர்க்குற்றங்களுக்க ஆதராவாக குரல் கொடுத்துள்ளது.

பாகிஸ்தானின் பல தீவிரவாத அமைப்புக்கள் இலங்கையில் பயிற்சி பெற்றுவருவதாக பல உலக உளவுத்துறைகள் தகவல் வழங்கியிருந்ததும் இங்கு குறிப்பிடத்தக்கது.

சர்வதேச விசாரனைகள் என வந்தால் பாகிஸ்தானின் இந்தியாவிற்கு எதிராக இலங்கையில் எடுத்து வரும் முயற்சிகள் வெளிவந்துவிடும் என்பது மட்டுமல்ல பாகிஸ்தானின் கவலை தடைசெய்யப்பட்ட மற்றும் சர்வதேச சட்டங்களுக்கு அப்பால் ஆயுதங்கள் விற்றது என பல உண்மைகள் வெளிவரும் என்பதே பாகிஸ்தானில் இந்த ஆதரவுக்கு முக்கிய காரணம்.

பாகிஸ்தானின் இச் செயற்பாடுகள் இந்தியாவுக்கு தெரியாமல் இருக்குமா என்பது சந்தேகமே தமிழீழ பிரச்சனையில் காங்கிரஸ் தனது குடும்ப நலனை கருத்தில் கொண்டே நோக்குகின்றதே அன்றி இந்தியாவில் நலனில் அக்கரை கொண்டு அல்ல என்பது இந்தியர்கள் அனைவரும் அறிந்துகொண்டு செயலாற்ற வேண்டும்.

UN High Commissioner for Human Rights, Ms Navi Pillay, is now in Australia. The Australian Human Rights Commission organised an event called "Human Rights 2011" - http://www.humanrights.gov.au/hr2011/

where Ms Pillay was the chief guest speaker. Mr Paris Aristotle (refugee advocate and expert on asylum seeker issues + torture) and Mr Patrick Dodson (expert on Aboriginal rights) were also guest speakers. The event was hosted by popular TV broadcaster Indira Naidoo.

We had to register for the event and while registering there was an opportunity to submit a question. I received a call saying that my question was shortlisted to be asked! Upon arrival I was informed that 15 questions were selected from hundreds of submissions. My question was No. 14. During the event, by the time the interview of the guest speakers finished, there was only about 15mins left for questions. I was resolved to the fact that my question would not get asked. Imagine my surprise when the host, Indira Naidoo announced that since it was nearing the end of the session she would skip through the questions and to my delight she said, "Last question is from Dr Sam Pari".

My question was along the below lines:

It is quite interesting to hear you speak of persecution in South Africa, genocide in Rwanda and war crimes tribunals for Libya. As you know, a UN Expert Panel released a report in April stating that war crimes had occurred in Sri Lanka and had called for an international independent inquiry. Sri Lanka ofcourse has rejected this. Despite other western nations having supported the findings and the recommendations of this report, our Foreign Minister Kevin Rudd and Prime Minister Julia Gillard have remained silent on this issue. Infact, Australia recently accepted a former military official as the next Sri Lankan High Commissioner to Australia. My question is "With war crimes and human rights violations forcing thousands of Tamils to jump on boats and come to Australia seeking asylum, should Australia be more vocal on the issue of war crimes?"

The audience seemed quite taken aback back such a strongly worded question. Ms Pillay answered it well confirming that Australia should be speaking up on such issues, especially since it had signed the Rome Statute. She answered this question at length and did not beat around the bush. Mr Aristotle also signalled to Indira that he wanted to answer too, and he answered in quite a bit of length on how Tamil refugees being held back due "security clearance" was unfair and from his experience over the past 25 years no Tamil refugee has ever posed a threat to Australia. He also added that since the Tamil Tigers controlled the Northern areas, anyone from that area would have had some association with the Tigers and it was unrealistic to consider the entire population as a terrorist threat.

My question was the last question for the evening so I'm hoping most people went home with our issue resonating in their mind. After the event, several people came up to me and thanked me for discussing this issue (most seemed grateful to have been educated on a new human rights issue). Furthermore, I got to meet and speak to Ms Pillay one-on-one and unlike other "celebrities", she did not rush off but took time to discuss the issue with me at length. Mr Aristotle too spoke to me about his experience on the issue.

Of hundreds of questions, our question got chosen. And of 15 finalised questions, only 5-6 got asked - one of which was ours. This shows that it is an issue that is starting to be acknowledged as an important issue. 1700 people who had interest in human rights attended the event and today they all went home knowing about war crimes in Sri Lanka and of the persecution of Tamils and the need for Australia to speak up. There was media present as well and I will keep you all informed of the broadcast.

Standing among the 1000 plus Australian Tamils at Martin Place last week (18th May) to remember the Tamils massacred in the 2009 war in Sri Lanka, it was very obvious that the trauma for the community is still so deeply devastating.

What has become clear to me is that the Australian Government's silence during and since the 2009 war adds to the pain the community is enduring.

My Greens colleague in NSW Parliament David Shoebridge in an adjournment speech last night addressed this point. While the UK, US and European countries are taking a stand against the human rights abuses committed under the Rajapakse Government, the Australian Government's concern regarding Sri Lanka is minimal.

It was encouraging to see that at the recent forum organised by the The Australian Human Rights Commission the issue of Australia's voice on Sri Lanka's war crimes was discussed.

The question submitted by Dr Sam Pari from the Australian Tamil Congress was: "With war crimes and human rights violations forcing thousands of Tamils to jump on boats and come to Australia seeking asylum, should Australia be more vocal on the issue of war crimes?".

UN High Commissioner for Human Rights, Navi Pillay responded saying: "In this region Australia has a crucial responsibility to urge respect for rule of law and urge a end to impunity for serious crimes. Australia has ratified the Rome Statute which set up the ICC and in the preamble to the Rome Statute is that there has to be a determination to end impunity for serious crimes. So on one level you have countries like Australia ratifying and committing to ending impunity. There is a responsibility then for it to speak up and call for accountability in this region."

As my colleague David Shoebridge said:

"A generation of Tamils have been killed, brutalised and marginalised right under the gaze of the world, including Australia, and those who have been left behind are subject to a brutal military rule ... I hope that soon the survivors are respected and remembered by the Australian Government as it belatedly raises its voice for justice for the Tamil people".

When I enter Federal Parliament on July 1 I will continue advocating for the equal rights of the Tamils and all those living in Sri Lanka. The Greens have a deep commitment to speak up for those who suffer the injustice of discrimination, marginalisation and state sponsored terror.
