Sri Lanka's UN mission has dismissed as “unfair and unethical” concerns raised by United Nations (UN) Human Rights Chief Navi Pillay about the appointment of Major General Shavendra Silva to an advisory panel on peacekeeping.

Pillay said she had informed UN Secretary-general Ban Ki-moon of her misgivings about Maj. Gen. Silva, Sri Lanka's deputy UN ambassador, who commanded the Sri Lankan army's 58th Division during the final assault against the LTTE in 2009.“We find it difficult to understand the concerns being articulated at present, on the basis of unconfirmed allegations and accusations,” the UN mission said in a statement on Tuesday.

“This is unfair and unethical,” it said. “It’s certainly not consistent with any notion of fair play.”

Sri Lanka has come under pressure from Western governments and human right groups to account for war crimes they suspect were committed as the army closed in on the LTTE, which retreated to a narrow strip of coast in northeastern Sri Lanka along with hundreds of thousands of civilians.

Silva Is Ruled "Not Appropriate" for UN Advisory Group

Major General Shavendra Silva, was yesterday (February 22) told by the Group's chair that his participation was "not appropriate," Inner City Press reported.

The move comes after UN Secretary General Ban Ki-moon told Inner City Press he could do nothing about being advised by Silva, whose Division 58 is repeatedly named in connection with alleged war crimes in Secretary General Ban Ki-moon's Panel of Experts report on Sri Lanka.

However, the Permanent Representative of Bangladesh told Inner City Press that Silva was "not acceptable," and said that his counterparts from India and Pakistan felt the same. Inner City Press asked High Commissioner Navi Pillay and US Ambassador Susan Rice and each said they had expressed concern to Ban's Secretariat.

So had Amnesty International, whose representative to the UN Jose Luis Diaz subsequently told Inner City Press:

"This development comes not a moment too soon. It was simply outrageous and unbelievable that a person named in the report of the UN Secretary-General's own Sri Lanka accountability panel as heading a military unit about which there were credible allegations of war crimes and crimes against humanity could serve in any capacity on behalf of the UN, let alone in a senior advisory group on peacekeeping. The appointment risked tarnishing the credibility and legitimacy of the United Nations and its peacekeeping role. We salute Ms Frechette's decision, which in fact is the only conscionable one."

The nomination of Silva, Sri Lanka's deputy UN ambassador, to the panel by Asia-Pacific countries at the UN set off a storm of protest by rights groups. A Canadian official who chairs the special advisory group said that Silva's presence was "not appropriate."

Silva has been accused of playing a central role in the Sri Lankan military's crushing of a Tamil separatist uprising in 2009 in which tens of thousands of people died, according to UN experts and rights groups.
