ஐ.நா. பொதுச்சபைக் கூட்டத் தொடரில் கலந்து கொள்ள அமெரிக்காவுக்கு வருகை தர இருக்கும் ஜனாதிபதி மஹிந்த ராஜபக்ஸவை அமெரிக்கா கைது செய்ய முடியுமா? என அந்நாட்டின் பிரதம நீதியரசர் ஜோன் ரொபேட்ஸிடம் அமெரிக்கத் தமிழரின் அரசியல் குழுவான ஒபாமாவுக்கான தமிழர் அமைப்பு எழுத்துமூலம் அபிப்பிராயம் கோரி உள்ளது.

இலங்கையில் உள்நாட்டு யுத்தத்திபோது இடம்பெற்ற போர்க் குற்றங்களின் சூத்திரதாரி என்கிற வகையில் அவரை ஏன் கைது செய்ய முடியாது? என்று வினவி உள்ளது.

போர்க்குற்றம் புரிந்தனர் எனக் குற்றம் சாட்டப்பட்ட பலரை அமெரிக்கா முன்னைய நாட்களில் கைது செய்து உள்ளது. நாஸிகள் பலரையும் குற்றங்கள் இடம்பெற்று பத்தாண்டுகள் கழிந்த நிலையில் கூட அமெரிக்கா கைது செய்திருந்தது, ஆனால் ஜனாதிபதி மஹிந்த ராஜபக்ஸ விடயத்தில் முன்பு இடம்பெற்றிருக்கும் அக்கைதுகள் முன்னுதாரணங்கள் ஆகி விட முடியுமா? என்பதே இவ்வமைப்பின் சந்தேகம் ஆகும்.

ஏனெனில் மஹிந்தரின் விவகாரம் வித்தியாசமானது .மஹிந்தருக்கு எதிரான குற்றச்சாட்டுக்கள் எந்த நீதிமன்றம் ஒன்றினால் முன்வைக்கப்பட்டிருப்பவை அல்ல. மாறாக சர்வதேச மக்கள் அமைப்புகளான- சர்வதேச நெருக்கடிகள் குழு, சர்வதேச மன்னிப்புச் சபை, மனித உரிமைகள் கண்காணிப்பகம் போன்ற மனித உரிமைகள் முன்வைக்கப்பட்டு வருவன ஆகும்.

ஜனாதிபதி மஹிந்த ராஜபக்ஸவின் உத்தரவின் பேரில் இராணுவத்தினரால் போர்க்குற்றங்கள் புரியப்பட்டமைக்கான ஆதாரங்கள் ஏராளம் உள்ளன என இவ்வமைப்புகள் கூறுகின்றன.

இந்நிலையில் அகதிகளுக்கான பாதுகாப்பான பிரதேசங்கள், வைத்தியசாலைகள் ஆகியவற்றின் மீது வலிந்து குண்டுகள் வீசுதல், மனிதாபிமான உதவிகள் செய்யும் நிறுவனங்களின் மீதான வன்முறைத்தாக்குதல் போன்றவை அநேகமாக எல்லோராலும், எவ் வகையான வரைவிலக்கணங்களின் கீழும் போர்க்குற்றங்களாக கருதப்படுவன தானே? என்று பிரதம நீதியரசரிடம் ஒபாமாவுக்கான தமிழர் அமைப்பு கேட்டுள்ளது.

இலங்கையில் சிறைப்பிடிக்கப்பட்டோர் எதுவித விசாரணைகளுமில்லாமல் கொலைசெய்யப்பட்டமைக்கு ஆதாரங்கள் உண்டு என்றும் ஆனால் இவ்வாதாரங்கள் எந்த நீதிமன்றத்தினாலும் இதுவரை விசாரணை செய்யப்படவில்லை என்றும் இந்நிலையில் அமெரிக்க நீதிமன்று ஒன்று ஏன் விசாரிக்கக் கூடாது? என்றும் இவ்வமைப்பு கேள்வி தொடுத்துள்ளது.

பொஸ்னியாவில் போர்க்குற்றங்கள் நிகழ்ந்தன என்று அறிக்கைகள் தெரிவித்தபோது அமெரிக்க மற்றும் நேட்டோ நாடுகள் தலையிட்டன என்று இவ்வமைப்பு பிரதம நீதியரசருக்கான கடிதத்தில் சுட்டிக் காட்டி உள்ளது.

ஒபாமாவுக்கான தமிழர் அமைப்பின் ஊடகப் பேச்சாளர் இது குறித்து ஊடகங்களுக்கு முக்கியமாகத் தெரிவித்துள்ளவை வருமாறு:-

நாம் சட்டவல்லுனர்கள் அல்லர், பிரதம நீதியரசருக்கான எமது கடிதம் அவரின் கருத்தைக் கேட்கும் முகமாகவே எழுதப்பட்டது.எழுதப்பட்ட விடயம் மிகவும் சிக்கலான விடயம் ,எனவே உயர்-சட்ட ஆலோசனை தேவை.

பிரதம நீதியரசர் ரொபேட்ஸ் அவரது கருத்தை எம்முடன் பகிர்ந்து கொள்வார் என எதிர்பார்க்கிறோம். அவரது கருத்து பொதுக்கருத்தாடல் ஒன்றுக்கு இட்டுச் செல்லும் என நாம் நம்புகின்றோம். சட்டத்தரணிகளும்,நீதிபதிகளும் இது பற்றி பேசும் நிலை வர வேண்டும்."

ஆனால் எதிர் காலத்திலாவது, அரசியல் பொது விடயங்களில் தமிழர் தரப்பு தனிப்பட்ட நபர்களின் பின்னால் வால் பிடிக்கும் வகையில், கில்லரி பின்னாலும், ஒபாமா பின்னாலும், பிரதமர்களாக உள்ளவர்கள், பதவிகளில் உள்ளவர்கள் பின்னால் அலையும் கீழ்தர தந்திரங்களை கைவிட முன்வரவேண்டும்.

தமிழர் தரப்பு ராஜதந்திரமாக, அரசில் உள்ளவர்களுடன் மட்டுமல்லாது, பிரதான எதிர்க்கட்சியினருடனும் நட்பான தொடர்புகளை பேணி அந்த நாட்டு அரசியலினுள் தமிழர் பிரச்சினையை கலக்காமல், அந்த நாட்டு அரசியல்வாதிகள் சகலரும் தமிழர் பிரச்சினையை அறியும் வண்ணம், சகலரும் தமிழர் பிரச்சினையில் ஒத்த கருத்துக்கள் கொள்ளும் வண்ணம் பார்க்கவேண்டும்.

இந்திய, இலங்கை அரசியலுக்குரிய சாக்கடைத் தனத்துடன், ஒருவர் பின்னால் அலைவது குறுகிய நன்மையை தருவது போல இருந்தாலும், நீண்ட காலத்தில் பின்னடைவுகளையே தரும்.

Tamils for Obama to Supreme Court: Can the U.S. Arrest Rajapaksa?

Tamils for Obama, a political group of American Tamils, wrote to Chief Justice of the Supreme Court John Roberts asking for his opinion on whether Mahinda Rajapaksa (president of Sri Lanka and possible author of crimes committed during the recent Sri Lankan civil war) can be arrested as he travels through the U.S. this fall.

Can the U.S. arrest Sri Lankan President Mahinda Rajapaksa as he travels through this country to visit the United Nations this fall?

Tamils for Obama asked that question in a letter to Supreme Court Chief Justice John Roberts.

"The United States has arrested and deported accused war criminals in the past," explained a spokesman for the Tamil American group. "Our country arrested accused Nazis decades after the crimes they were supposed to have committed took place, so this is not unprecedented.

"We guess that this is different because the accusations come from international civilian organizations--the International Crisis Group, Amnesty International, Human Rights Watch, and so forth--rather than courts of law. They say that there is plenty of evidence that Sri Lankan government forces, which were ultimately commanded by President Rajapaksa, committed what would probably be considered war crimes.

"The international organizations mention the government's intentional shelling of civilian refugees in protected areas, intentional shelling of hospitals, and violent actions against humanitarian organizations," the spokesman said. "Those would be war crimes by almost anybody's definition."

The spokesman also said that "There was also evidence of execution without trial of prisoners. The evidence hasn't been tested by any court yet, but we hope an American court will be willing to look at it."

"We also noted that the U.S. and NATO intervened when there were reports of atrocities being committed in Bosnia," the spokesman added. "Armed intervention is at least as serious as legal intervention, or so we think.

"We know we are not legal experts," said the Tamils for Obama spokesman. "Our letter to Chief Justice Roberts is to ask his opinion. This is a complicated matter, so we know that high-level legal knowledge is required. We hoped that Mr. Roberts would share his thoughts with us."

"We also hope this matter will become something for public discussion. If we can get lawyers and judges talking about it, we think that this is step in the right direction."

The spokesman mentioned that similar letters had been sent to U.S. Attorney General Eric Holder and Acting Solicitor General Neal Katyal , New York State Attorney General Andrew Cuomo, Senator Patrick Leahy (Chairman of the Senate Judiciary Committee) and the other eight Supreme Court justices.

Dear Justice Roberts:

President Mahinda Rajapaksa of Sri Lanka is expected to visit Manhattan this fall to speak at the United Nations.

Amnesty International, Human Rights Watch, various United Nations officers, and the International Crisis Group have all accused Sri Lankan functionaries and military men of war crimes committed during the recent Sri Lankan civil war. All of these purported criminals, of course, reported to and took their orders from President Rajapaksa. If they are guilty of the crimes of which these numerous international bodies claim they are guilty, then the moral and legal responsibility for these crimes rests with President Rajapaksa.

The accusations arise from the government’s intentional shelling of civilian refugees, intentional shelling of hospitals, and violent actions against international observers and humanitarian organizations. There was also evidence of execution without trial of prisoners.

We are seeking your opinion. Is it possible to arrest a criminal who is a foreign national passing through the United States for crimes of which he has not yet been tried or convicted? Rajapaksa certainly will also have some form of diplomatic status, which will further complicate this issue.

The United States has arrested and deported, even decades after the alleged crimes, individuals accused of crimes committed during the Nazi era. When a crime is ongoing and/or in progress, as in Bosnia, the United States has intervened to prevent the crime from continuing. These precedents occur to us when we hear of President Rajapaksa’s visit to our country, but we are not experts. We are therefore asking you if it is possible for American officials to place President Rajapaksa under arrest as he passes through the United States.
