இலங்கையின் போர்க்குற்ற விசாரணைகள் கருணா அம்மான் என அழைக்கப்பட்டும் விநாயகமூர்த்தி முரளிதரனிடமிருந்தே ஆரம்பிக்கப்பட வேண்டும் என மனித உரிமைகள் கண்காணிப்பகம் தெரிவித்துள்ளது. தமிழ்த் தேசியக் கூட்டமைப்பினர் மீது யுத்த குற்ற விசாரணைகளை மேற்கொள்ளப்பட வேண்டும் எனவும் அவர்கள் புலிகள் இயக்க அமைப்பினருடன் தொடர்பு கொண்டுள்ளதாகவும் பிரதியமைச்சர் விநாயகமூர்த்தி முரளிதரன் கருத்து வெளியிட்டிருந்தார். இது குறித்து இன்று அறிக்கை ஒன்றை வெளியிட்டுள்ள மனித உரிமை கண்காணிப்பகத்தின் ஆசிய நாடுகளுக்கான பணிப்பாளர் பிரட் அடம்ஸ், கருணாவின் கருத்தை வைத்துக் கொண்டு அவரை சுதந்திரமாக செயற்பட விட முடியாது என தெரிவித்துள்ளார்.

  

கருணா தமிழீழ விடுதலைப் புலிகள் இயக்கத்தில் இருந்த போது, பல குற்றச் செயல்களுடன் தொடர்புபட்ட ஒருவர் என்பதனால் இலங்கை அரசின் போர்க் குற்ற விசாரணை அவரிடமிருந்தே ஆரம்பிக்க வேண்டும் என பிரட் அடம்ஸ் குறிப்பிட்டுள்ளார். 1990ஆம் ஆண்டு ஜூன் மாதம் 400 தொடக்கம் 600 பொலிஸார் விடுதலைப் புலிகள் அமைப்பினரிடம் சரணடைந்ததாகவும், அவர்களில் பலர் கருணாவின் கட்டுப்பாட்டின் கீழ் இருந்த போது சித்திரவதை செய்யப்பட்டதாகவும் சிங்கள முஸ்லிம் பொலிஸர் கொலை செய்யப்பட்டதாகவும் மனித உரிமைக் கண்காணிப்பகம் தெரிவித்துள்ளது. எனினும் பீபீசிக்கு பேட்டியளித்துள்ள கருணா, அந்த சம்பவங்களோடு தன்னை தொடர்பு படுத்தாமல் கருத்து வெளியிட்டுள்ளதாகவும் பிரட் அடம்ஸ் சுட்டிக் காட்டினார்.

 

1990ஆம் ஆண்டு 75 முஸ்லிம்கள் படுகொலை மற்றும் மட்டக்களப்பில் 200 பொதுமக்கள் படுகொலை என்பவற்றுடன் கருணா குழுவினர் தொடர்பு இருப்பதாக மனித உரிமைகள் கண்காணிப்பகத்தின் அறிக்கையில் குறிப்பிடப்பட்டுள்ளது. விடுதலைப் புலிகள் சிறுவர்களை படையில் இணைத்துக் கொண்டதாக 2004ஆம் ஆண்டு மனித உரிமைகள் அறிக்கையில் தெரிவிக்கப்பட்டுள்ளதாகவும் வீடு வீடாகச் சென்று சிறுவர்களை படையில் சேர்க்குமாறு கோரிக்கை விடுக்கப்பட்டமைக்கு கருணா முக்கிய பங்கு இருப்பதாகவும் இன்றைய அறிக்கையில் தெரிவிக்கப்பட்டுள்ளது.

 

விடுதலைப் புலிகள் வடக்கு, கிழக்கில் குடும்பங்களை அச்சுறுத்தி, பாடசாலை செல்லும் சிறுவர்களை கடத்தியதாக மனித உரிமைக் கண்காணிப்பகம் குற்றஞ்சாட்டியுள்ளது. கருணா தமிழீழ விடுதலைப் புலிகள் அமைப்பிலிருந்து விலகிய பின்னரும் இலங்கை அரச படைகளுடன் இணைந்து குற்றச்செயல்களில் செயற்பட்டதாக அறிக்கையில் கூறப்பட்டுள்ளது. யுத்த காலத்தில் மோசமான குற்றச் செயல்களில் ஈடுபட்ட கருணா, இப்போது அரச வரப்பிரசாதங்களை அனுபவித்து வருவதாக பிரட் அடம்ஸ் குறிப்பிட்டார்.

அத்தோடு நாடுகள் வாரியாக.. சீனா.. ரஷ்சியா.. உக்ரைன்.. செக்குடியரசு.. இந்தியா.. பாகிஸ்தான்.. இஸ்ரேல்.. அமெரிக்கா.. பிரிட்டன்.. லிபியா.. ஈரான்.. போன்ற நாடுகளும் வரனும். இவர்கள் தான் படைப்பயிற்சிகளும் கொடுத்து மனித உயிர்களைப் பலிகொள்ளும் ஆயுதங்களையும் தந்திரங்களையும் சப்பிளை செய்தவர்கள்..! இதனையும் மனித உரிமைகள் கண்காணிப்பகம் வலியுறுத்துமா..???!

அப்ப நீங்க கருணாவை விசாரிக்க கூடாது என்றிங்களா?

நெடுக்ஸ் இவையை விட்டுட்டியள் யுத்த நேரத்திலை மக்களைப் பாதுகாக்கத் தவறிய ஐ.நா மக்களோடு மக்களாக இருந்து மனிதாபிமானப்பணிகளை மேற்கொள்ளாமல் விட்டுட்டு ஓடி வந்த செஞ்சிலுவைச்சங்கம் உட்பட்ட .இன்ன பிற தொண்டு நிறுவனங்கள்.

கருணாவிலிருந்து ஆரம்பித்தால் போயிற்று. தொடக்கி வைக்க என்ன வேண்டுமென்கிறார்? அதை நாமே தேடிக்கொடுத்துவிடலாம்.

முக்கிய போர்குற்றவாளிகளில் கருணாவும் ஒருவர். அதில் மாற்றுக்கருத்தில்லை. கருணாவை விசாரிக்க உள்ள credibility மேற்குறிப்பிட்டவர்கள் மீதும் மேற்கொள்ள இருக்கு என்றே கூறுகின்றோம். அவர்களையும் விசாரணைக்கு உட்படுத்த வேண்டும்..! ராஜீவ் காந்தி எல்லாம் திட்டமிட்டு தப்புவிக்கப்பட்டவர். சந்திரிக்கா செய்த.. செம்மணிப் புதைகுழிகளுக்கு 200 பொதுமக்களைக் கொன்ற நவாலித் தேவாலயப்படுகொலைக்கு.. 70 பள்ளிச் சிறார்களைக் கொன்ற நாகர்கோவில் பாடசாலை மீதான குண்டு வீச்சிற்கு.. மேலும்.. புதுக்குடியிருப்புப் படுகொலை.. பெரியமடு அகதி முகாம் மீதான செல்வீச்சுப் படுகொலை.. என்று எவற்றிற்காகவும் அவர் மீது விசாரணைகள் பற்றி மனித உரிமைகள் கண்காணிப்பகம் கருத்துச் சொன்னதில்லை.

 

மேலும்.. 80 தமிழ் மக்கள் வரை முஸ்லீம் ஜிகாத்தால் கொல்லப்பட்ட கல்முனைப்படுகொலைகளுக்கு... ஏன் விசாரணை இல்லை.. என்ற கேள்வியும் எழுகிறது..!

 

டி பி விஜேதுங்க காலத்தில்.. நடந்த.. கிளாலிப்படுகொலைகள்.. இன்று வரை விசாரணையின்றி உள்ளன.

 

இந்தியப் படைகள் அதனை அனுப்பிய அதற்கு உத்தவிட்ட தலைமைகள் மீதும் விசாரணைகள் வரவேண்டும். இந்தியப் படைகள் மேற்கொண்ட யாழ் வைத்தியசாலைப் படுகொலை.. பருத்தித்துறை படுகொலை.. பொற்பதி வீதிப்படுகொலை.. சாவகச்சேரி சந்தை மீதான உலங்குவானூர்த்திப் படுகொலை.. காங்கேசந்துறை.. மருதனார்மடம் வதை முகாம் படுகொலைகள்.. மண்டையன் குழு நடவடிக்கைகள்.. என்று எல்லாமே விசாரணைக்குள் வர வேண்டும்.

 

சிறீலங்காப் படைகளோடு.. முஸ்லீம் ஊர்காவல் படையும் போர்க்குற்ற விசாரணைக்கு உட்படுத்தப்பட வேண்டும்..! வடக்குக் கிழக்கில்..வவுனியாவில் யாழ்ப்பாணத்தில் இயங்கிய அனைத்து தமிழ்.. முஸ்லீம்..ஒட்டுக்குழுக்களும் விசாரணைக்குள் கொண்டு வரப்பட வேண்டும்..! வெறுமனவே புலிகள் மீது மட்டும் குற்றம் சுமத்திவிட்டு மனித உரிமைகள் கண்காணிப்பகம் தப்பிக்க முடியாது.

நாங்கள் எப்பவும் பேயர்களாக்கப்படக்கூடியவர்கள் என்பதை மனித உரிமைகள் கண்காணிப்பகம் கூட அறிந்துவைத்திருக்கோ என்று சந்தேகமாக இருக்கு.எங்கள் கவனத்தை பிரதான எதிரியிடம் இருந்து திசை திருப்பி அதை எமக்குள்ளேயே உருவாக்கப்பட்ட எதிரிகளில் எம் சக்தியை வீனடிப்பதில் சிங்களவன் அன்று தொட்டு கைதேர்ந்தவன்.அதுதான் எம் பலவீனமும்கூட.

ஏன்தான் உந்த கருணா சும்மா கிடந்த சங்கை ஊத்தி கேடுக்குதோ தெரியாது.

aதன் வினை தன்னை சுடும் என்று இப்ப என்றாலும் புரியடா இழி பிறப்பே

என்னிடம் முழு லிஸ்ட் இல்லை. ஆனால் நெடுக்காலை போவானின் சொல்பவற்றில் பலவற்றை  சர்வதேச மன்னிப்பு சபை ஆரம்பத்தில் ஒழுங்காகத்தான் நிரைப்படுத்தி வந்தது. சந்திரிக்காகாலத்தின் பலவற்றை நிரைப்படுத்தியிருக்கு. கதையை பிற்காலம் தான் மாற்றத்தொடங்கியவர்கள். பிரதானமாக சந்திரிக்கா, பொன்சேக்கா கொலை முயற்சிகளும் திருசெல்வத்தின் கொலையும் கதிர்காமருக்கு ஆயுதமாக மாறியிருந்தன. இன்று அம்நேஸ்டி புலிகளின் கொலைகளை மட்டும்தான் தூக்கிப்பிடிக்கிறது. ஆனால் நாம் அசந்து போய் ஆனைக்கு பானை சரி என்று ஆக்க விட்டுவிடாமல் விசாரணையை வரவளைக்க வேண்டும். நீதி கனக்க பிறளாது எனபதை ஐ.நா.உள்ளக விசாரணைஅறிக்கையில் தெரிவிக்கப்பட்டிருக்கும் விபரங்கள்  காட்டுகின்றன.

தெனாலி படம் போலிருக்கு .என்னவோ அவர்கள் ராசி அப்படி போல .

Sri Lanka: Amnesty International appeals for an immediate halt to use of

unauthorized places of detention

 

Amnesty International said today that it was high time that the government of Sri Lanka took

decisive action to bring a halt to the persistent use of unauthorized places of detention, particularly

by armed Tamil groups opposed to the Liberation Tigers of Tamil Eelam (LTTE), currently fighting

the security forces.

 

The appeal comes after recent reports of the spectacular escape of a prisoner who had

been held in the custody of members of the People’s Liberation Organization of Tamil Eelam

(PLOTE) in Vavuniya, northern Sri Lanka.

 

Pararajasingham Kugathasan had been held at the “Lucky House” PLOTE camp in

Rambaikulam, Vavuniya since 13 June 1998. He escaped around 7am on 31 August 1998 and ran

into the nearby Saint Anthony’s church. According to eye-witnesses, there were signs of torture all

over his body, including bleeding wounds on his legs and arms. Three armed members of the

PLOTE followed him into the church and threatened the priest requesting that Pararajasingham

Kugathasan be handed over. Both their lives were saved after the timely intervention of police from

a nearby checkpoint.

 

In the last few years, Amnesty International has repeatedly raised concern about the

persistent practice on the part of the army and the police in the north and east to allow (if not

encourage) members of armed Tamil groups opposed to the LTTE to carry out search operations

or screen civilians. Such operations have often lead to human rights violations, including illegal

arrest, prolonged detention and torture, “disappearances” and extrajudicial executions.

 

The then army brigadier in Vavuniya told Amnesty International in March 1996 that

members of PLOTE have the task of “identifying LTTE infiltrators” and “keeping the security forces

informed”. He maintained that armed members of PLOTE did not come directly under his control;

instead he liaised with PLOTE’s political leadership. Amnesty International subsequently

recommended that existing command and control structures in the security forces be reviewed to

ensure strict control over home guards and armed cadre of anti-LTTE militant Tamil groups.

Since then, there has been some change in the situation in the Batticaloa area in the east,

where members of the Eelam People’s Revolutionary Liberation Front (EPRLF) have apparently

been brought under direct control of the military commander. However, there remains serious

concern about the situation in Vavuniya and about human rights violations by EPRLF members and

Frequently members of more than one state agency would work together. The victims of

sexual violence almost always knew whic

h part of the security establishment the

perpetrator belonged to and which camps or

detention sites they were taken to: the

security forces responsible for the mistreat

ment made no attempt to hide their unit

identities from the victims.

There were exceptions. SA, for example,

told Human Rights Watch that he was

apprehended in Colombo

in 2012 by men in civilian clothes. Even in such cases the

evidence of security force involvement was

strong. In SA’s case, the men who abducted

him carried T56 military assault rifles, and di

splayed them openly at checkpoints manned

by the army. During his interrogation, SA said

, his abductors mentioned each other’s ranks,

and while blindfolded he heard his interrogators stand up and address others as “Sir”

when they entered the room.

In some cases reported to Human Rights Watch,

former detainees also

pointed to the role

played by members of pro-government Tamil

paramilitary or armed groups, namely the

Eeelam People’s Democratic Party (EPDP), People’s Liberation Organization of Tamil Eelam

(PLOTE), and the Karuna group. These groups ac

ted in conjunction with

security forces by

providing information on

alleged LTTE sympathizers and th

eir families. Detainees frequently

secured their release from detention by paying bribes to security forces using members of

these groups as interlocutors. Often Tamil

parliamentarians woul

d play this role.

The perpetrators of sexual abuse were male, but uniformed female police officers assisted in

the torture and rape of both men and women. For example, women police officers tied up and

shackled detainees to expose them, stripped them

of their clothes, threw chili powder in their

faces, and participated in their near asph

yxiation with petrol-infused plastic bags.
