British newspapers Sun and Daily Mail, represented by their Counsel at the Royal Court of Justice in London on Thursday, apologised sincerely and unreservedly for untrue and highly defamatory allegations against Parameswaran Subramanyam, who was on a 23-day hunger strike April, last year, demanding international community to stop Colombo’s war on Tamils. The newspapers also agreed to pay substantial damages and legal costs, according to Carter-Ruck solicitors. “The false allegations about Parameswaran were not just hurtful but clearly aimed at undermining Parameswaran’s credibility and the credibility of the whole Tamil protest,” commented Liberal Democrats' Deputy Parliamentary Leader Simon Hughes. According to Labour MP, Siobhain McDonagh, the ‘authorities’ who gave the information to the newspapers, “did it to undermine and shame the Tamil demonstrators in Parliament Square”.

OUR article of 9 October 2009 falsely alleged that throughout a 23 day hunger strike, Mr Parameswaran Subramanyam secretly ate takeaway burgers when dishonestly claiming he was on hunger strike in support of Sri Lankan Tamils, in a campaign which was policed at considerable expense and caused the police to waste public money.

We now accept that these allegations are totally untrue. Mr Subramanyam, whose sole aim has always been to promote the Tamil cause, did not eat any food at all during his hunger strike.

We apologise to Mr Subramanyam and his family for any upset and embarrassment caused and are paying him a substantial sum in damages.

We now accept that there was no truth in these allegations and we and other media have agreed to pay him damages and have apologised to Mr Subramanyam for the distress and embarrassment caused.

லண்டனில் உண்ணாவிரதம் இருந்த இலங்கை தமிழ் இளைஞர் பரமேஸ்வரன் சுப்ரமணியம், உண்ணாவிரத நாட்களில் பர்கர் சாப்பிட்டதாக செய்தி வெளியிட்ட பத்திரிக்கைகளுக்கு எதிரான வழக்கில் வெற்றி பெற்றுள்ளார்.

இலங்கையில் போரை நிறுத்தக் கோரி 2009 ஆம் ஆண்டு லண்டனில் வாழும் இலங்கை தமிழர்கள் பிரிட்டிஷ் நாடாளுமன்ற வளாகத்தின் முன் நடத்திய போராட்டத்தின் ஒரு பகுதியாக பரமேஸ்வரன் 23 நாட்கள் உண்ணாவிரதம் இருந்தார்.

ஆனால் இந்த உண்ணாவிரதப் போராட்டத்தின் போது அவர் ரகசியமாக பர்கரை சாப்பிட்டதாக லண்டனில் வெளியாகும் டெய்லி மெயில் மற்றும் சன் பத்திரிக்கைகள் செய்தி வெளியிட்டிருந்தன.

இதற்கு எதிராக பரமேஸ்வரன் வழக்கு தொடர்ந்திருந்தார். இந்த வழக்கில் இன்று வியாழக்கிழமை லண்டன் நீதிமன்றம் தீர்ப்பளித்தது. இந்த வழக்கு விசாரணையின் போது சம்மந்தப்பட்ட இரு பத்திரிக்கைகளின் சார்பில் வாதாடிய வழக்கறிஞர்களும் தாங்கள் வெளியிட்ட செய்திக்கான ஆதாரங்கள் இல்லை என்று ஒப்புக் கொண்டார்கள். இது குறித்த மறுப்பை வெளியிடவும், பரமேஸ்வரனுக்கு 77,500 ஆயிரம் ஸ்டெர்லிங் பவுண்ட் நஷ்ட ஈடு தரவும் அந்த இரு பத்திரிகைகளும் ஒப்புக்கொண்டதாக பரமேஸ்வரனின் வழக்கறிஞர் மேக்னஸ் பாயிட் தெரிவித்தார்.

இந்த பத்திரிக்கைகளின் பொய்ச்செய்தி காரணமாக, கடந்த எட்டு மாதங்களாக தான் மிகுந்த அவமானங்களை சந்தித்ததாகவும் இந்த நிலையில் இன்று வந்துள்ள தீர்ப்பு தனக்கு மகிழ்ச்சி அளிப்பதாகவும் பரமேஸ்வரன் பிபிசி தமிழோசையிடம் தெரிவித்தார்.

போராட்டத்தின் போது பல தமிழ் அமைப்புக்கள் பங்கேற்றாலும் தனக்கு தனிப்பட்ட முறையில் அவை உதவ முன்வரவில்லை என்றும், வெற்றிபெற்றால் வக்கில் சன்மானம் என்ற அடிப்படையிலேயே தான் வழக்கறிஞரை அமர்த்தி இந்த வழக்கை எதிர்கொண்டதாகவும் அவர் கூறினார்.

A Tamil refugee hunger striker has accepted £77,500 in damages over newspaper reports he secretly ate burgers during his protest.

The articles in the Daily Mail and The Sun struck at the heart of Parameswaran Subramanyam's integrity and achievement, the High Court was told.

He began his 23-day protest outside the Houses of Parliament on 7 April 2009, in a bid to raise awareness of the plight of Sri Lankan Tamils.

The newspapers have apologised.

Mr Subramanyam was treated in hospital for five nights after ending his hunger strike.

Six months later, the Daily Mail and The Sun ran stories which reported claims that specialist monitoring equipment had caught Mr Subramanyam secretly eating McDonald's burgers and that he had caused the police to waste a fortune in public money.

Mr Subramanyam's solicitor Magnus Boyd told Mr Justice Eady said the allegations were "entirely false", which both newspapers now accepted.

The Metropolitan Police superintendent who was in charge of the operation in Parliament Square confirmed that there was no police surveillance team using "specialist monitoring equipment" and that no video evidence existed.

Victoria Jolliffe, counsel for News Group Newspapers and Associated Newspapers, said they withdrew all the allegations and apologised sincerely and unreservedly for the hurt and distress caused.

"The Sun has agreed to pay £30,000 in compensation and the Daily Mail will pay £47,500," Mr Boyd told the BBC.

Ms Jolliffe said that Associated published the article - upon which News Group's article was then based - in good faith based on information that, at the time, was understood to be reliable.

Afterwards, Mr Subramanyam said: "The past eight months have been an unbearable strain on my life, to the extent that at times I have even contemplated taking my own life.

"As a result of the lies that the newspapers published about me, and through no fault of my own, I have lost friends, been shunned by family members and completely ostracised from the Tamil community.

"I felt I had a responsibility to all those who had supported me during the hunger strike, and were sullied by association with me, to take legal action against both newspapers to prove that the allegations that were published were false."
